I also suspect that the capital raises at the end of 2017 were already in the back of their minds, and something that Nasdaq would never have agree with.



They left Nasdaq all the way back at the end of 2016.

They likely did have advice from their own attorneys as well. That's why it's so weird that the completely separate funding from different time periods with completely different institutions should be aggregated.

In the end, it seems like so much of law is a matter of interpretation, with one being subject to either the best argument; and sometimes an interpretation is simply at the whim of the judge, govt. agency, or stock market review council overseeing things.
