judge sneezed? was that in a court filing? if dbmm had not answered then the court filing would have indicated something along those lines... 'in light of dbmm not producing requested information it is the courts decision to proceed and render its decision' etc etc. instead

On February 7, 2018, Respondent Digital Brand Media & Marketing
Group, Inc., submitted new evidence pursuant to the Securities and
Exchange Commission’s order ratifying my appointment and remanding this
case to me. See Pending Admin. Proc., Securities Act of 1933 Release
No. 10440, 2017 SEC LEXIS 3724 (Nov. 30, 2017). The Division of
Enforcement’s response is not due until February 21, 2018. After reviewing
the parties’ filings, I may need to schedule further argument. As such, for
good cause, I EXTEND the date by which I will issue my order on ratification
as it applies to Digital Brand to April 20, 2018. Id. at *3-4.
