Needing more time isn't necessarily the judge considering the filing (which would be a huge undertaking).

There are all those other claims that DBMM made that they were ordered to answer to but to our knowledge have not been addressed.

Perhaps it is that. No reason to think that every time the judge sneezes its something positive for the company.
