Safe Harbor, Watchful, Safe Harbor

I've looked thru SEC filings and can't find the verbiage "Safe Harbor" but that does not mean it is not there I just can't find it.

The term and the action to which it refers seem to be an umbrella covering a wide variety of circumstances and uses.

Under which circumstances has SPCL "Safe Harbored" or are we relying solely on an email or phone conversation between a CEO with too much free time on his hands and a message board poster?
