I quite agree and it's well documented this was the reason the BB's took the case to the Fed Level. There's absolutely no other reason why they would take the case in play to a higher court. They wanted this evidence excluded.

The evidence against them is damaging to them and they literally went out and hire a criminal defense team...not that it'll do any good (I like Martin's "even Perry Mason could save them" comments).

In truth, they knew going in they couldn't win, they admitted they were losing the state case. Going to the federal courts only prolonged the inevitable. That's all done! Very soon we move forward and be done with these two for good (after the shareholders get done with them).
