I think this claim was fully answered months ago but to go over old news again, Marc apparently does have witnesses, affidavits and proof that will make it very difficult for the BB's to beat the State case against them. This evidence did not quite fit the specifics of the Federal case which was on a different subject (allocation of preferred shares) and thus it would not have been helpful to Marc's case. Thus the evidence is likely being held for use in the State case since it specifically supports the charges against Energy Supreme.

To interpret this legal strategy as saying "damaging evidence does not exist" is being legally naive to say the very least.
