So, yes, you are correct that it should not have come as a surprise to him. I would note that it is referenced somewhat obscurely in the filings. But you are right, a thorough review should have identified it and perhaps it wasn't a surprise to him.

Now, fun fact:

That's not the reason given for denying his candidate, Mr. Leary, for the board appointment (the reported COI was with Ondra).

But, as it turns out, Mr Leary's company (Freeh Group) merged with the company (Pepper Hamilton) that helped Malik and Minhas incorporate their company (Regen Med). And Regen Med is (IMHO) involved with the most concerning of all the Phase 5 allegations.

Not sure what to make of that but it is curious.

Did they all realize this (somewhat obscure) conflict and withdraw his name from consideration? I mean, if Linda put forth someone from the firm that provided legal advice to Regen Med to investigate allegations of impropriety related to Regen Med that would have been highly criticized (by me at least). But Woodford put him forth and Linda apparently objected.

Just throwing this out there that perhaps the relationship between NW and LP isn't as strained as we might think. Maybe Linda didn't thumb her nose at NW. Maybe they both realized/agreed that Mr. Leary would be inappropriate to conduct the internal investigation and agreed on someone else similarly qualified. And publicly offered instead the reason that he has no biotech experience and no desire to be on the board long term.

Just a thought.
