False, as long as he follows this filing up with a Schedule 14D-1 (Tender Offer Stmt) disclosing the necessary information in regards to the target company and acquiring, this could very well be the start of an acquisition announcement.

SEC must be notified within 15 days... It's the 10th. There is still time to follow up with the 720M share increase.

Still, I'd be lying if I didn't say I was anxious... This could either be huge or back down to wherever the market evaluates the new bottom.
