Apparently you have not been in many actual settlement discussions .

In my experience ( looking back now ...way to much experience as in I wasted to much of my time fighting this ) ...you do not enter settlement talks if you are absolutely convinced you can win and can afford to fight it out to the better end .

The FDA has a lot at stake here ...biotech biz is watching .
If I was the FDA I would be saying ..
" Listen you may have a case but you have only been up against our second bench players . If we can't settle this on terms that work for us ...we will appeal every decision and fight it out with our best legal talent until the bitter end .
After all our legal budget is practically unlimited .
How about yours "

JMO based on my experience of being either a plaintiff or defendant in more cases then I want to remember ( well when you sign over 600 contracts in the course of your business life ....not all will turn out like peaches and cream )
