From Federal Appeals court experience, "writ[ing] a precedent setting opinion against the big government agency that will withstand an appeal?" takes longer and is more difficult. More legal research is required, and the opinion should satisfy[in my view] the objectives of 1) being educational to the tribunal below and, most important, 2) presenting better rationale on law applied to facts than the agency did. The court for which I once worked for a good many years had/has direct appellate court review of agency opinions/decisions.
