No one is suggesting a judge issuing a summary judgement on one matter ..The NCE exclusion...is going to add an opinion concerning a different issue..the SPA..

What might happen is the judge in his travels through the NCE issue sees a pattern that suggests the FDA is not following the statutes laid down by congress, and is at the very least, a wild horse or possibly is operating under a hidden agenda..The judge under this condition has the right, nay the duty to report this to the authorities..DOJ, AG, etc..

Case in point, you are undergoing a painful divorce. The former love of your life turns to the judge and says "My husband has $400 K stashed in a safety deposit box that nobody knows about, and I want half." Does the probate judge have the right, the duty to report this to the IRS?...The answer is as an officer of the court.... yes. Even though the court session is about the divorce if unlawful behavior is discovered the Judge must report it.
