Judges interpret laws. That needs to be the focus at this time. To 'conduct an investigation' into other issues not established in the record and which does not allow for rebuttal by the other side can prejudice a case and open it up for appeal.

The judge needs to focus on the NCE. Depending in the language of his decision - there may or may not be other avenues for AMRN legal to explore at that time.

They need to keep the case clean and not muddy the waters for appeals.
