La--Actually, I did mean it that way. Loop was right on point when he said that the mediator will try to resolve this case period.

I haven't done any CAMP mediations, but with those I've been involved in the mediator ALWAYS tries to get both sides to give in, and in doing so they ALWAYS bad mouth your position.

In this one I'm guessing that the mediator will stress to IDCC that nothing is guaranteed in the law, that IDCC would be much better off reducing its claim so that Nokia will have some incentive to settle; that IDCC will save time and energy with a negotiated settlement, and the like.

In the end, though, when he has to be objective, the mediator IMHO has to come down on Nokia hard. At least privately he's gonna have to tell them there's a possibility of sanctions in this case, esp. if IDCC is yelling for them.
