If Alaska isn't getting any love from the home team (Rep. Murkowski and Stevens) "C.J" and or "R.D" can not force the issue on State land. Sure they can issue approval with permits from ACE & EPA but hey can't force the State to allow digging. Because Pebble is on State land, not Federal land, and because the State owns the minerals until they are mined, NAK does not, it seems to me that the bigger issue is not Joe or Don but Lisa & Dan. Yes, ultimately the courts will get involved and yes the courts could side with NAK, but how long will that take?
...and for what its worth, their replacements are not gonna sweeten the prospects one bit.

So far 2.2% have been or are currently infected. To achieve 70% in the US there are 200,000,000+ members of our herd that need to be immune (get sick), and this only works if the infected stay immune (which has not yet been proven). Vaccines may be the only way to achieve such a high number.
With a current death rate of 2.8% the death rate to achieve H.I. would be approximately 5,600,000...That is a mighty high price in my opinion.

Where are you getting this news? Local(AK) news organizations have not picked this up yet.
The ambler road project is a good example of where NAK may be headed if the northern route is used. In that project Alaska Industrial Development and Export Authority (AIDEA) does not have eminent domain authority. There are limits on the use of eminent domain for economic development, but there are exceptions, and the Alaska State Legislature has the authority to create new exceptions. I think creating a toll service would be better suited than ED in my opinion.
