I read the article twice and I do not see where it states Rader personally REQUESTED to speak to the judge. Can you please post the quote from the article that you are referring to.
He has to show up. If he doesn‘t the judge can hold him in contempt and issue a bench warrant for the US Marshal service to pick him up and bring him to court in Delaware. He doesn‘t have a choice anymore.
If you Google SEC Memorandum Circular No. 23, Series of 2019, every hit is from the Philippines and the SEC of the Philippines. You might want to try that. The Memorandum seems to be from the SEC of the Philippines, not America’s SEC.
Can you post a link for that? All I find with Google on that is from the Phillippines SEC. I cannot locate it on SEC.gov (the American SEC website).

Any distribution of cash to shareholders would be a dividend not a share purchase, so capital gains tax basis is irrelevant. Besides that, any distribution would need to be authorized by UnifiedOnline, Inc. which is controlled by Billy. Otherwise UnifiedOnline is free to spend the Chanbond money as it deems appropriate.
The point is that capital gains/loss basis for UOIP stock is irrelevant with regard to any payment of lawsuit proceeds left over, if any. Not that we are going to see a penny in any case.
Consult an accountant for further information. As regards UOIP, this is an academic question.

If Billy has already received 20 percent of the gross, $18,000,000, he would be wise to take his money and himself out of the United States and not care whatever happens in all the lawsuits. That is what I would do. The Costa del Sol in Spain is nice year around. I hope the IRS withheld tax from his 20 percent and his lawyers are prepaid with a retainer. We won't hear from Billy again.
After Mishcon and Bentham, the rest of the money will be split between all the lawyers. All these filings cost serious money. There are so many court cases and the arbitration that I finally found out about from this case that a lot of lawyers will be buying new cars and houses from all this.
If Rader doesn't file a response tomorrow the judge might declare him in contempt and issue a bench warrant to have the US Marshals take him into custody and sit him in jail for 30 days. He will file something. It might be a flimsy excuse but he has to file something. You don't just ignore a Federal judge's order.
Rader better have a more believable excuse than was in his motion to attend by video. His excuse was that Philadelphia had a COVID outbreak and the Philadelphia airport was the closest to Wilmington. He could have flown into any of Boston Logan, Newark, Washington Dulles, Baltimore (BWI) all via direct flights from LA and then taken the Acela high-speed train to Wilmington. Or he could have flown from LA to Wilmington on a one-stop flight connecting in Chicago, Atlanta, Houston, or DFW. His excuse regarding Philadelphia was an insult to the intelligence of the judge. It is not surprising she denied his motion. What was this guy thinking?
