Not to mention he was speaking very rapidly trying to get all his information in. I didn’t take it as meaning they manufacture test kits (especially when I saw SS post on LinkedIn 4 days ago, “ How can we order these? Can you send the the FDA certification information? We require 3M kits asap” in response to a claim made by Vicky Zeng that they had 1,000,000 CE, FDA certified test kits available “.
It really depends on what specific records he is trying to seal. It’s highly unlikely that the court would agree to have “all” records sealed but there may be some records that, for example, might contain , per se, trade secrets, or personal information that’s disclosure could cause undue harm. I’ve done a couple of civil suits many years ago but nothing of this nature. Unfortunately the docket doesn’t specify which records they want sealed so it’s really impossible to say whether it’s normal or justified.
Incomplete I’m sure. On further research it appears they have 6 months after publication to either use the mark in commerce or file statement of use.
Notice of allowance issues for applications based on an intent to use the mark
If the mark is published based upon the applicant's bona fide intention to use the mark in commerce and no party files either an opposition or request to extend the time to oppose, the USPTO will issue a notice of allowance about eight weeks after the date the mark was published. The applicant then has six months from the date of the notice of allowance to either:
Use the mark in commerce and submit a statement of use (SOU); or
Request a six month extension of time to file a statement of use (extension request).
That’s not what they indicate:
PUBLISHED FOR OPPOSITION; trademark published; published for opposition; publication review committee complete; trademark review complete; trademark approved; trademark published; published for opposition; trademark refusal withdrawn; trademark published for opposition; approved trademark; trademark approval; non-final trademark refusal; refusal to register a trademark; published for third-party opposition; oppose a trademark; federal trademark application; federal trademark registration
You filed a federal trademark application. The application may have gone through various refusals that you overcame; or your application may have sailed through smoothly without any objections. Either way, the good news is that your trademark is approved from the standpoint of examination. But, the USPTO allows third-parties to oppose every trademark application before the mark is allowed to register.
Your application has been published for opposition. A third-party who feels that they may be damaged by registration of your mark may oppose registration within thirty (30) days of notice of publication. However, a third-party may also extend the time to oppose your mark and then use additional time to consider whether or not to actually file an opposition to your registration. The applicant does not need to take any action during publication, nor is there any action to take prior to the end of the publication period.
It appears that the old application went one for years without ever being finalized (or whatever term they use to assign a trademark to a company); whereas, conversely, it appears (at least to me), that if no one challenges this new one in 30 days from 2/12, it gets finalized.
QDX trademark published for opposition on 2/11/20. 7 months ago it was showing Abandoned for No Statement of Use Filed.

I would assume it accurately indicates the date listed. Even if they were from a few weeks ago, it’s easy to tell that considerable construction has taken place. What all that means in regards to the future of QTMM is anyone’s guess but I definitely look at it as a positive.
On my phone I discovered the links only take you to Tech City on google maps, not directly to the photos I wanted to link. All the photos are still available through either link.
There are a number of new photos posted on Google Maps over the past 2 days, one was posted today. The 2 I found most interesting are linked below. Although there has been considerable construction at Tech City, it they are a ways off to completion.

This photo was posted on google maps 5 months ago for Tech City Guwahati. It looks like a large structure is being built to me.

Those pictures aren’t dispositive one way or the other. There are some other older photos (in the recent past), that do appear to show considerable construction. I don’t like that we have no financial reports and information is extremely limited. I found some things a little while ago from “Bricpoint” that sound awful familiar. I’ll post the links, but at this point all I can say is, we’ll see. Hopefully some revenue will be forthcoming this year but I’m not going to get my hopes too high.

The judge granted plaintiff’s motion to quash defendant Hartigan's First Amended Subpoena for A. Candelario (with Ex. 1-2)
We don’t know the reason because they never deigned to inform us. However, the most likely seems to be what BigE said. Ultimately, with all the recent events that tend to show promise if one is to take them at their word, I wholeheartedly believe we would have been higher except for the fact that they not only didn’t timely file, they let us go to the pink sheets. These actions aren’t, imo, inspiring and the sp is reflecting that others aren’t inspired either.
I’d call him brilliant if the price jumps up to where he is 1000% higher; or maybe just lucky. Maybe sometimes all we need is some luck. Personally I like the recent advents, with the exception of their lack of filing the annual report (I could name a slew of other things I’m displeased at); but I am trying to remain optimistic despite some of their failings. If I lose it all, no big sweat. I’ve more than made it up elsewhere. But if things go as hoped, I, and most of you, will be happy campers.
The only thing that just doesn’t make sense to me, if they have 90 days (I guess that would be the end of December) why file the NT-10K to begin with? Ultimately I hope you’re correct as I would like to see what payments we may or may not have received. Had he timely filed, rather than leaving investors completely in the dark, with all the recent announcements we would likely be higher than we are now (sp wise). Time will tell.
Actually, according to the January 2019 shareholders update he gave guidance of 7-10 million for 2019, not 2020. Of course without the 10k it’s anyone’s guess as to what they may or may not have received. From a shareholders standpoint, not timely filing filing financial reports doesn’t promote confidence.
It even has a photo of Squires at the stone laying ceremony.

It’s the right company. On the right lower side of the home page there is a link to photos of Tech City project.
The red map location looks like the intersection leading into tech city. The two pictures seem to show a big difference in construction activities (from my take on them.) Also you can go to google maps, type in “Tech City Guwahati “, and see photos local guides have taken that show considerable construction, at least as far back as July, 2019.
You may be correct that the facility won’t open by years end. With construction, not many finish on time. There is an unlimited number of reasons that can be guessed at as to why the 10k is late. What it may or may not show is anyone’s guess. Hopefully they’ll get their act together in regards to (a) providing investors with timely information; and (b) get their sec filing done in a timely manner.
“ I wish I was wrong, but the reality of the situation is becoming more apparent daily”.
The reality of the matter is we don’t know. The last statement based on his previous opinionated conjectures sounded to me like a conclusion, that what he said, is what’s happening.
Your opinion my opinion his opinion.
It wasn’t stated as an opinion, though, of course, that’s your opinion, lol
You’re making a “Statement of Fact” based wholly on conjectures and innuendos. Fact is, until we see the 10k we don’t know exactly what may or may not have been received. Moreover, you are completely discounting the million dollar LOC. Personally, I’ll wait and see what the 10k says .
Notice of Service: just means they received the certified mail slip back verifying that the 10/01 subpoena was received by recipient.
Not seeing anything in the paper’s isn’t dispositive one way or the other. I know less than 3 weeks ago Pete Harris responding to a question about Tech City stating, “ I will make sure Steve S sees this. India is progressing but an update is due. This blog would be a good place for that.”
Not seeing anything in local papers doesn’t hold any negative connotations for me; but, Yes, an update on that is due and an update on previous announcements made earlier this year regarding displays are way overdue.
For Capstan? I believe it was $375,000
I’m with you on that! Be happy to see .05 :)
Absolutely I agree with you on that for a number of reasons. Here’s to hoping we go far!
You are correct about that. I asked them about the statement they made in the January 2019 investor release concerning, needing a few more weeks to perfect the Remote QD on chip phosphor 65” display before making its public debut; my blog wasn’t put up nor responded to. Although I am happy with the current blockchain and licensing deal in India endeavors, there are some things that still weigh on my mind. Maybe their 10k will illuminate some of the questions regarding the 2nd $150,000 initial licensing fee, etc., I think transparency is important. Personally I’d rather see them under promise and over deliver than over promise and under deliver.
Based on the limited view of the night images depicted, it’s difficult to ascertain what may or may not be going on at the present moment; however, there’s at least 2 prior pictures that show a multistory building in progress of being built. One of the guides for that area recently posted “ The construction here is going at a very good rate”. Whether they finish by the end of the year is anyone’s guess. I know from looking at weather reports it looks like it rains (sometimes severely), almost every day. I’m satisfied that (a) the deal was made and (b), construction is in progress. Since this deal is largely just a licensing deal; I’m also assuming, (based on earlier releases)that they have received, at minimum, the First $150,000 and $1,000,000 (or the main bulk of it as authorized by the LOC) and will receive more once the reactors come on line. We only get to see whatever the local guides deign to post on any particular day. The current night pictures seem to be that guides attempt to show a picturesque scene as opposed to a informative construction based scene (of course, all in my opinion). Hopefully one will post more detailed photos depicting the progress made on the structures in the near future.

Yeah, they obviously put the cart in front of the horse.
Not according to what Steve Chan said to me in response to an inquiry I sent him back in March. Specifically, he stated that their due diligence came to the conclusion that it wouldn’t be a good fit for them or QMC.
I actually wondered about the 12,000 vs 120,000 statement to justify late payment of the 1st 500k as well. I guess what I’d like to see, “factually”is receipt of the second payment 500k payment. If it was part of the 1,000,000, then they should have said so. Since they didn’t, imo, it’s not reasonable to assume it was.
I don’t know how many of you keep track of local events in Guwahati but they have been experiencing extremely bad weather. It certainly could have some impact on completion date. I think saving lives will take precedence, as it should.

That is ultimately what I don’t want to occur. But yes they could
I probably over reacted. I don’t particularly like someone telling or implying I should sell my shares because I might have a more conservative view of things.
