It's confusing, no doubt. I called my broker, he answered quickly and seemed well versed on the topic. Maybe he was wrong, I did run it through AI and got a similar answer. But I did not ask if the short seller actually sold the share to a buyer if the buyer would get the voting rights. So I don't know. It makes sense that you don't have voting rights if you lend out your shares, and it makes sense that the short seller would have the voting rights, but not if he sold the share and had not covered/returned the share. Once he covers, your voting rights would be restored.

The way I see it, it' an easy decision to make. I think longs just have to ask themselves if they see a scenario where voting against would have a real benefit to them? And if the answer is "no", then I would vote the same way you did when we voted on it last time. If you are a newer investor that did not vote last time, then abstain. If you answered "yes", then vote against.
This isn't about the compensation package. We already voted for (as a majority anyway) the package and approved it. It wasn't an issue until we were sued and now being asked to ratify it...right? So don't be confused, it's not about whether-or-not management gets the shares (they will get theirs one-way or another). It's about fighting back against the scammer that bought 1,100 shares (or whatever small amount it was) so he could bring a lawsuit against us.
Doesn't really make sense to ruminate on the legalities and emotions and, and,and's.... It's a simple question for the shareholders, yes or no, pick your side. But it will be a distraction for everyone on here until June 29th. It's going to heat up to a rolling boil soon on here. The fudsters are going to spin all of the longs up with this topic, just watch. Ask yourself when they do, why they even care. They all will tell you they do not own any shares.

Great idea. Vote no and support that "big" investor that is suing us. You do realize that we already voted (and approved them) long ago.
A lawsuit from someone that holds a whopping 11k shares no less. We already approved these, the vote is simply to shut down the lawsuit by saying "yes, we did approve them".

@tryn2 We lost our golden lab last fall, he was 11.5 years old. Bentley was his name. "Big Ben", "Benjamin", "Benjamin Button", "Benny", the really great ones get a lot of nick names over the years :) He was the best there ever was, the best there ever will be.
It's been ~8 months and we are still navigating life without him. The house is too quite. Every since the kids grew up and moved on, he was the only child. Instead of running to soccer, volleyball, football, baseball games and golf tournaments, we took Ben to the mountains or to the river... every chance we had. He had a water entry like a trials dog, loved the mountains and loved our family.
I remember when I had to have vitrectomy surgery (both eyes, but not at the same time of course). I came home and when my wife opened the door to get us inside he looked up at me like "Huh? Dad, whattt the hell". I rubbed his ears and said "I'll be down in a few hours Benny, gonna take a nap and recover". I laid down in bed and Ben jumped up and laid his body right against mine as tight as he could. It was summer, so that was a little warm, but I didn't mind, he as there for me. Did the same thing countless times - 2nd vitrectomy surgery, cataract surgery, broken ribs (motorcycle story), fractured vertebrae (snowmobile story), . Big Ben was always there by my side, 24 hours a day, until I was up and around again. He wouldn't leave my side until I was.
Last summer, my wife was diagnosed with stage 1 colon cancer. Scary time for us. Ben could sense it. He would not leave us even to eat, we had to stand in the laundry room with him so he would. Crazy because anyone that has ever raised a lab knows that there isn't much that gets in the way of feeding time. When my wife came home from the hospital after surgery, it was the same story as it was for me. He laid next to her 24-7 (actually my wife is so tuff it was more like 24-3) until she was up and around and able to go for a walk. It was his last gesture to our family. After Kasie recovered, he really started showing his age. Arthritis was getting worse, I was giving him Adequan injections 3x/month. It kept him moving and able to go for walks.
We were blessed in a way. At a minimum, we took Ben for a walk every day. He passed while we were driving to Oregon to help my father in law (health issues) that Saturday morning in September. We had taken him for a quick walk that morning and he was his normal self. We were half way along on the trip and my wife thought he was acting funny. I got out and tried to get him out of car to walk for a minute and he couldn't get up. I checked his gums and they were white as a sheet. I knew we didn't have long, he needed oxygen and as fast as I could drive, we were too far away from help.
I know I rambled here, I haven't really talked about it to anyone except my wife. So when I started writing, I guess it came out like a fire hydrant.
Some advice that may help: Talk about it with your wife/family whenever you are feeling sad about him/her. It seemed to help us a lot. We talked about Ben, the memories, his passing, etc. continuously for several months before we started to be able to get back to our daily routine. Remember, he/she was never going to out-live you, and now that time has come. I am sure you have a million+ memories you made with that dog, focus on those now, they will bring you comfort. Best to you and your family.
