Lots of companies function daily with law suits for and against them.Look at BlackBerry when it was in a suit against the email patent issue that they infringed on for years only to settle at a later date knowing htey were wrong for some 700 million dollars

The defendents a long time ago called this a nuisance law suit with no meat to it,and here we are almost 2 and some years later have it going to trial by jury.
I cannot fathom a judge allowing or even permitting a senseless case taking up valuable court time

I think we have all said our peace about the law suit for TMMI vs Panik and Dmension et al.
We like our chances but you don't.This is both of our opinions which we are entitled to with freedom of speech
It is now going to Jury trial who will have to listen to all facts and then as it has always been will be out of our hands and then once the court speaks and the jury renders its decision we will have a conclusion to this whole process.
To use words like begging over and over is more your own opinion it is never mentioned like this in the courts
At the end of the day i keep to what i last posted,either we pony up with some contracts or in the world of tech the first one who has a sellable product and gets contracts that are valid and money making then we can say the fat lady has sung!!!!!

I know your passionate as i am about TMMI but since nothing really new is coming out from TMMI speculation is just that.
I think all pro TMMI'ers applaud your drive and desire to offset what is being bashed by others but if i might suggest that the continued links to companies where there is no mention of TMMI even if it is Raytheon which to date has yielded TMMI a big fat zero to date regardless what has been stated ,we should just stay current with all our news.
The past is just that and it will be for lawyers and judge to resolve until it goes to court.

I think that Gerry just pick bad wording and we could only hope on future releases that his wording is more guarded or more carefully worded so not to have what he states in a given time frame not happen.
Am i disappointed that Gerry our President did that yes very much so .because it leaves a hanging shroud over the news release we are expecting but now have extreme doubt as to what is occurring
But those who have done contract negotiations realize that what might be looking like a done deal just when it comes down to the last minute lawyers probably need to make a few more dollars then say oops we need to change this or that and we know this process when dealing with any company involves a process again of there own DD in the wording of things.

Core Technology
Our development team has made remarkable progress in both Research and Product Development on our TRUDEF product offering during the past year. Through diligent experimentation and relentless testing, it became clear that in order to make our technology fully scalable, we had to develop a new proprietary algorithm for our TRUDEF with more extensible features, greater flexibility for integration and compatibility with large-scale platforms already in widespread use. The outstanding results show that this development initiative has been worth the effort.
As a valuable by-product of this development initiative, extracting performance features not only served to streamline our core technology, but also led to development of new solutions, which we have reconfigured as a portfolio of stand-alone products that can be marketed immediately. COTS (Commercial Off-The-Shelf) products:
A COTS workflow solution that will reduce file size selectively without sacrificing visual quality of desired focal points: By enabling users to set multiple focal points within a frame, users can reduce overall file size of a video by an additional 35-40%. It is an agnostic GUI (OSX, Linux, Windows) with customization available for use with other CODECs.
A real-time solution to higher resolution video with no increase in file size:Users will access 2x and 4x zoom mode to scale video. This solution will be available on any CPU based system or any AMD equipped GPU system, with customization available for use on other players. Through VLC or Widows, both commonly available, users can zoom by image or region.
An ISO zoom feature compatible that works with TRUDEF or with other popular codec: Users will have picture-in-picture control of individual stop-action frames or active video with zoom capabilities of 2x, 4x and 8x.
Customer Engagement
In April, we entered into a joint research program with Raytheon Company (RTN-NYSE) for Intelligence, Surveillance and Reconnaissance to test, research and develop technology for deployment within the realm of U.S. military operations. That relationship continues.
In November, we successfully demonstrated our new TRUDEF Digital Video Compression software to Raytheon with 250:1, 500:1 and 1000:1 as target compression ratios. Using these parameters, TRUDEF outperformed their test criteria, with 3,900:1 compression ratio while maintaining good image quality. As of January 2015, Raytheon conducted head-to-head comparison testing against its current technology. Results were outstanding, with compression ratios 3 to 5 times better than current.
We installed our TRUDEF™ technology into VideoBank’s operating environment. VideoBank is a leading Digital Asset Management provider and will test our technology as our first beta site and embed TRUDEF and our COTS solutions in their presentations to customers and prospects to demonstrate how our compression technology works within their customer’s system.
In November, Geppetto Avatars, Inc. agreed to a reciprocal sales and marketing program with TMM. GA will include our TRUDEF™ technology in their workflow and identify it in their customer presentations.
We have been working closely with other major contractors using customer supplied test files, and have successfully demonstrated the TRUDEF™ codec, as well as our COTS solutions.
Audit
An Auditor has been engaged to prepare audited financial statements. The firm has been working with outside legal counsel, who has provided historical documents for the audit. Since TMMI has not had an audit statement filed since 1993, it has entailed significant time and effort to produce the necessary backup materials. This will go a long way toward validating our efforts and establishing a baseline valuation for TMM.

Administrative and Legal
Our outside counsels have been engaged to protect our current corporate assets through litigation and preparing and submitting contracts for new customer business.
New patent rules have been recently introduced by the USPTO that rewards the first to file as the owner of the patent.
These new patent “first to file” rules also state that the inventor must not reveal the potential discovery in any detail with any potential customer prior to filing at least a provisional patent.
Until recently, this new ruling has limited our ability to fully demonstrate and announce all the codec attributes in development and disclose new products to customers.
With guidance from our technology development team and specialized legal counsel on intellectual property to research prior art, we have identified new patentable program methods and made the appropriate filings for provisional patents on TRUDEF and on our new COTS technology with the USPTO.

Wilmington, Delaware – February 23, 2015 - TMM, Inc. (TMMI-PK) (“TMMI”) or (the “Company”) is pleased to announce that the Inter Partes Review (“IPR”) Petition that TMMI filed with the USPTO Patent Trial and Appeal Board (“Board”) in June 2014 seeking to invalidate the operative claims of Dimension, Inc.’s Patent Number 8,639,053 on the basis of prior art has resulted in the cancellation by Dimension of each of its operative patent claims. On February 18, 2015, Dimension as the Patent Owner advised the Board to cancel its claims 1-16 and 22-30, which are all of Dimension’s ‘053 Patent claims challenged in TMMI’s IPR Petition. On February 19, 2015, TMMI filed a petition that requests that the Board construe Dimension’s actions as a Request for Adverse Judgment under 37 C.F.R. Sec. 42.73(b) to formally end the proceedings since Dimension as Patent Owner has canceled all of its patent claims involved in the IPR Petition such that there is no remaining claim in the trial (37 C.F.R. Sec. 42.73(b)(2) and Dimension has stated to the Board its decision to abandon the contest (“Patent Owner, has elected… not to defend its interests in this Proceeding.”); 37 C.F.R. Sec. 42.73(b)(4).
On the basis of such actions by Dimension, TMMI has petitioned the Board to take the following actions to formally conclude the cancellation of Dimension’s ‘053 patent claims:
1) Grant Dimension’s Request for Adverse Judgment against its patent claims;
2) Enter judgment against Dimension with respect to its claims 1-16 and 22-30 of U.S. Patent No.8,639,053; and
3) Issue a certificate canceling Dimensions’ claims 1-16 and 22-30 of U.S. Patent No. 8,639,053 pursuant to 37 C.F.R. Sec. 42.80.
Going forward, TMMI will continue to aggressively protect any threats to TMMI’s intellectual property assets.
Adverse Judgment under 37 C.F.R. § 42.73(b).
Under 37 C.F.R. § 42.73(b) the following actions, inter alia, are construed as a Request for Adverse Judgment:
? “Cancellation or disclaimer of a claim such that the party has no remaining claim in the trial,” 37 C.F.R. § 42.73(b)(2); and
? “Abandonment of the contest,” 37 C.F.R. § 42.73(b)(4).
In its response, Patent Owner took at least two actions that constitute a Request for Adverse Judgment under 37 C.F.R. § 42.73(b). First, Patent Owner canceled all of the claims involved in the IPR such that there is no remaining claim in the trial. See Patent Owner’s Response (Paper 17) at 1-2; 37 C.F.R. § 42.73(b)(2). Second, Patent Owner stated its decision to abandon the contest. Systems For Up-Scaling A Standard Definition (SD) Video To High Definition (HD) Quality” was duly issued by the United States Patent and Trademark Office (“USPTO”) on January 28, 2014. The ‘053 Patent issued with 30 claims.
On May 23, 2014, Petitioner filed a Petition (Paper No. 1) pursuant to 35 U.S.C. §§ 311 to 319 to institute an inter partes review of claims 1 – 30 of the ‘053 Patent. The Board instituted an inter partes review of claims 1-16 and 22-30 (the “Involved Claims”). The Board declined, however, to institute inter partes review of claims 17-21. The Board has not made a final determination of the patentability of the Involved Claims. (Paper No. 6, p.2).
2. Cancelation of the Involved Claims and Statement of Intent Not to Defend its Interests in this Proceeding
The Patent Owner does not ascribe to any of Petitioner’s arguments or agree with the correctness of the Board’s decision to institute inter partes review of the Involved Claims. However, solely to avoid a lengthy and costly legal proceeding
