A class action lawsuit naming an Alva man and others as plaintiffs has been filed in Woods County against Chesapeake, SandRidge and Tom L. Ward. Filed on March 29 the suit, on behalf of Harold Koppitz and all others similarly situated alleges the entities named violated Section 203 (A) of the Oklahoma Antitrust Reform Act. No claims are asserted under federal law.
The alleged conspiracy to rig bids and depress the market for purchases of oil and natural gas leasehold interests in Oklahoma was during a period from Feb. 1, 2007, until at least March 31, 2012, called the class period.
The suit seeks to recover treble damages, equitable relief, costs of suit and reasonable attorneys’ fees. Lead attorneys listed in the case are Mark A. Wolfe and Kandi Jepsen Pate of Oklahoma City. A Drumwright attorney is also listed as well as attorneys in New York, Mississippi and California.
Named as defendants in the lawsuit are Chesapeake Energy Corporation; Chesapeake Exploration, L.L.C.; as successor by merger to Chesapeake Exploration, , L.P; SandRidge Energy, Inc. and Tom L. Ward. Ward is the former chief executive officer of SandRidge.
The suit lists Aubrey McClendon as an unnamed co-conspirator. McClendon was the co-founder of Chesapeake and served as its CEO until April 2013. He died on March 2, 2016, shortly after being indicted on federal bid-rigging charges accusing him of conspiring to suppress prices for oil and natural gas leases.
“While serving as CEO of a major oil and gas company, the defendant (McClendon) formed and led a conspiracy to suppress prices paid to leaseholders in northwest Oklahoma, “ said U.S. Assistant Attorney General Bill Baer in a statement. “His actions put company profits ahead of the interests of leaseholders entitled to competitive bids for oil and gas rights on their land.”
The Woods County lawsuit alleges conspiracy between Chesapeake and SandRidge to depress the prices of leasehold interests by acquiring mineral interests at “collusive and noncompetitive prices” and thus keeping prices down for other companies acquiring leases. It further alleges McClendon derived considerable personal benefits from the combination and conspiracy through Chesapeake’s “Founder Well Participation Program (FWPP).”
Ward also participated in that program until August 10, 2006, when he resigned from Chesapeake (before the class period of the lawsuit). However, Ward participated in a similar program at SandRidge called the “SandRidge Executive Well Participation Program.
