Gump, IF the O/S is now accounted for and bone fide shareholders identified, why would the count be extended? Are we saying that the size of the NSS will affect the size of the settlement? What am I missing here?

Investorman, another "hands up" on another board where there are more CMKX investors would certainly be proof enough for me, as far as #1 is concerned.
As for #2, can you think of any legitimate reason why the brokers would hold onto shares that they are mandated to deliver? That may be happening, I'll agree, but why that might be happening raises some very serious questions, to my mind at least. Clearly, they want to derail the cert pull - Why???
Thanks Gump, you may well be right there. What I was questioning might work if the end result here was a buyout, but with us retaining our CMKX certs, a more creative solution is probably in order. I agree with you - It sure is getting interesting! GLTY

Famulus, if you choose to believe that, then that is your perogative. My reading of the update indicates quite the opposite. Anyway, I am not here to prove anything to anybody - only to listen to others to see if I come away with a different perspective. So far, you haven't convinced me of anything, other than that I might well be right.
Buzz, so you are saying that these sells would not be recorded on the TA list that Frizzell is in possession of?
Famulus, you should maybe get out a bit more and look around to see what's what's happening elsewhere. Lots of folks complaining about not getting their certs from ETrade on the other boards, and judging by their mood, I'm inclined to believe them.
Famulus, the DTCC document shows ETrade having a whopping 38,594 shares outstanding, while there are many shareholders waiting for delivery of shares totalling a great deal more than that from them. Would that not be an FTD?
Gump, got a question for you. We are looking at numbers here and what we don't see yet is an accounting of any NSS shares that may have already been settled with the company. If there has been an NSS is it realistic to believe that there have been no settlements to date?
We have seen no outward signs yet of Shorty trying to obtain shares of CMKX or to cover our dividends, so could we assume that a cash settlement might be taking place in the background? Not clear on all the mechanics of this... do you have any thoughts? TIA and GLTY

Exactly Investorman - Once the cert pull is complete and this distribution is ready, the brokers won't have to do a thing apart from answering to NSS holders who would not be receiving dividends, LOL! No NSS? No problem...
Jim, it would probably be a settlement rather than a squeeze, as CMKX is not trading at the moment. The divvies and any short that might be associated with them, however, might be an entirely different matter.
Are we assuming that the T/A does not have our addresses simply because they don't appear on the NOBO list? It doesn't make sense to me that they would not have the addresses but it does make sense that they would not publish them.
Gump, considering what you have written, why do you not believe the T/A was not provided with your address when the certs were ordered? Have I missed something? Aren't the certs just going back through the broker as a final confirmation to the broker that they have indeed been issued? Seems like a logical (but slower) process to me.

Call it what you want, Janice, however the fact remains that these were 111B UNREPORTED sales. That's 111B out of a 703B A/S that were "missed" by only a single MM. Don't you think that is stretching credibility more than just a little?
Jimmy, to be fair, perhaps we should allow that some of those 30,000 certificates may have been surrendered. If you think about it though, the count is of little importance really as all current cert holders are all listed on the current NOBO list. Of Prime importance (IMHO) are the cert requests that have gone in and how they are dealt with, along with finalizing a NOBO list containing the names of individuals owning 703B CMKX shares. That will verify whether or not there is a short, which is probably why certain individuals here wish to downplay the importance of the pull.
The other question that hasn't been answered here though, is why the SEC and DTCC are forcing the company to resort to a cert pull to prove/disprove the NSS question to begin with, by witholding critical shareholder information? Is there any legitimate excuse, particularly now that the company has been revoked and is no longer trading? If there is no NSS and nothing to hide, disclosure would simply allow the company to identify and settle with ALL shareholders, would it not? Withholding this information only makes sense if there is something really rotten to hide, IMO.

Nuffy, got mine back in April. The restricted notation will take $200 or so to clear up but if having CIM certs helps establish the NSS or secure the investment, this certainly seems like the way to go. What would happen if we ALL pulled our CIM certs? LOL!

Investorman, Back in Feb/March 05, Jeffries publically admitted (http://www.cmkxownersgroup.com/JefferiesLetter.pdf) to illegally selling (what was it.. 111 BILLION?)counterfeit CMKX shares, due to an "ACCOUNTING ERROR"? Please note that Jeff was only one of several MM's "making a market" with CMKX shares at the time, who may 'possibly' have had similar "problems"! Is a measley 100B out of a 700B O/S NOT SIGNIFICANT???
Some may ask "Why have we seen any correction to this "error" yet?"... Why not indeed?, inquiring minds certainly wish to know!

What a lark! I'm probably still waiting 'cause I bad-mouthed an A-D agent, probably... That'll learn me... I've got LOTS of respect for RBC (dealt with them since I was a 9 year-old, stuffing away (a very small part of) my 25C allowance into my savings account each week...LOL) but I believe they could do better with an affiliate other than A-D... JIMVHO.
Not too worried though. I got 80% in certs back in April and have already faxed them in to the task force. It will be interesting to see which offers what first...

Good-Till, I suppose the theory is that anyone (including UC) could buy nss CMKX shares (much easier than legit shares, depending upon who you talk to).
If true (and a very big IF), when reported along with the faxed cert results, that might settle the nss issue, without a follow-up fax-in account statements showing outstanding electronic shares, might it not?
Can't wait for the curtain to open and everything be revealed -for better or worse!
