As shareholders we certainly can't guarantee the trading of BCIT, but by acting as a concerted group, our efforts are at least getting heard.
Sitting on our butts waiting wasn't getting the BCIT story in front of senators, and the SEC chairman/now-chariwoman.
In the past Montal and his cronies at the DTCC were dealing with Megas in secret and relative anonymity. I'd like to think we've raised his profile a bit in the eyes of the SEC, Senate Finance Committee, and various State AG's. Perhaps he'll be held to account this time.
We will see.
I can guarantee you won't be sued by us. The DTCC isn't trying to extort hundreds of millions of shares out of us, like they were with Megas and BCIT.

I think it would be a powerful statement if many individual shareholders created their own short vids, stating their situation with BCIT, direct some comments at Isaac Montal at the DTCC about his "Global Lock", etc..

There's something goofy with that link in his post body, mouse over it and you can see the URL is corrupted. either copy and paste the actual link he has there into your browser, or click on the link in his sig, that one works. there's nothing wrong with the website, its just that corrupted link.

Peter DianaFormer Penguins defenseman Rob Scuderi is heading to Los Angeles.The Penguins lost free-agent defenseman Rob Scuderi to Los Angeles today.
Scuderi accepted a contract with the Kings that is believed to cover four years and carry an annual salary-cap hit of $3.4 million.
"I'm happy about the deal," Scuderi said. "But kind of sad about (leaving) the team."
He identified the Penguins -- who do not have the salary-cap space to extend an offer akin to the one Los Angeles gave him -- and Kings as his finalists, but the New York Islanders, New York Rangers, Minnesota and Montreal, among others, also expressed interest in him.
"I was almost sick to my stomach about turning down some of the offers that were there in the beginning," said Scuderi, who made $725,000 in 2008-09.
It was not immediately known whether the Penguins will target a free-agent defenseman to replace Scuderi, try to acquire one via a trade or give one from their farm team in Wilkes-Barre an opportunity to earn his old spot in the lineup.
The Penguins continue to try to re-sign winger Ruslan Fedotenko, and to have discussions about bringing back winger Petr Sykora.
They also are in the market for a backup goaltender, although restricted free agent John Curry is a candidate to fill that role.

I'll believe that when I see it. imho, before you start believing any web rumors about this trading again, I think I'd be looking for the company to file up to date reports, and see it on the dailylist.
There's certainly efforts going on to bring some accountability to Isaac Montal and the DTCC to justify their "global lock", but as far as trading, I think there'll be some indications before it just "starts trading"
So if it was your job to advise Megas on a course of action to have the global lock removed, you would:
Have Empire stock transfer declare x amount of fails from each broker.
File a suit against these brokers to produce valid certificates.
File a suit against Isaac Montal personally to restate his requirements on BCIT, etc...
Would also appreciate your comments on the fact that the DTCC put out it's notice on 8/16/2005, and brokers traded it without question for 10 more days before the SEC suspension.
Also it was curious that Ameritrade and or Scottrade (don't recall at the moment, but have seen copies of emails) was telling people several days before the SEC suspension that it was going to be suspended. - Why did they know this, and why were they telling clients this?
Also, Would appreciate you comments on why you think there has never been a criminal complaint ever filed against Pino and Thompson, even after the SEC won their case, regarding Pino counterfeiting stock certs. He's back promoting some HYIP crapola via freepressreleases.com or whatever. How hard would it really be for any motivated law enforcement to catch this guy? Really?
and yes, btw, we all know the DTCC is under the oversight of the SEC and New York Banking Law and the Fed. IT just seems some SEC attorneys don't want to admit that for whatever reason.

Now THAT is something I'd like to see in a public record, and I'd love to see their answer.
I have no problems with that, I'd love to see BCIT sue Montal for what he's demanded of BCIT, and I'd love to blast that all over the internet as well. I wonder just how much the DTCC would back up montal and his "demands" of BCIT, particularly with a grassroots PR effort, along with Grassley's office sniffing up his butt.
Well perhaps Megas was getting bad legal advice from Clem and crew back in 2005 in regard to Cap Growth, but even so, covering those shares took care of the actual fails that the counterfeits created, so in theory, BCIT should have been tradable and clearable.
But, since all the retail brokerages sold (read naked shorted) perhaps 2 Billion more shares to the public, there are no certs available to back them up.
The DTCC knew what was going on by 8/11/2005, and put out their notice on 8/16/2005 if I recall, but the stock still traded for two more weeks after this. They only exascerbated an already growing fail problem by not shutting it down completely.
The problem BCIT has now is not with the fails created by the counterfeit certs, but with the much larger naked short positions created by retail brokers taking orders even after the 8/16/2005 DTC notice.
OK, so given that the current roadblock, as outlined in this letter http://www.let-bcit-trade.com/Files/Letter%20to%20DTCC.pdf seems to be Isaac Montal at the DTCC, how does one force the DTCC to come to the table, and lay out what they want to remove the global lock? Every time Megas does what they ask of him, they say it's not enough. Kind of reminds me of Lucy and Charlie Brown of Peanuts... Lucy keeps telling Charlie Brown she'll hold the football, and WHAM!

hmmm, that sounds like what the ill fated "shareholder lawsuit" of april 2007 was all about.

The real transfer agent at the time was Pacific Stock Transfer.
Well, in this case, Pamela Thompson was fruadulently acting as "the transfer agent" as she and Pino were the ones who created the counterfeit certificates in the first place.
Thompson is not, nor ever has been registered with the SEC as a transfer agent. Never filed one of these..

Let's not forget Darbie and Capital Growth, who originally the certs were deposited with, if I recall.
Someone whose job it was to verify the authenticity of the certs obviously wasn't doing their job.
If someone printed up counterfeit certs for google and tried to deposit them with their brokers, where would the certs authenticity be vetted?

I would encourage any and all BCIT shareholders to call, email or send snailmail to Mr. Montal and ask him why he's broken off communication with BCIT and their attorneys.
Please Mr. Montal... please tell us what BCIT needs to do to have the "global lock" removed. It can't be that hard now, can it?
