In a worst-case scenario for the funds and other creditors, the judge could determine that Washington Mutual's bankruptcy plan was not negotiated in good faith and reject the plan.
Shareholders also want to be allowed to pursue litigation against the funds to disallow their $2 billion in claims, which if successful would make it much more likely the shareholders will recover money in the bankruptcy.
However, more likely would be a finding that the funds engaged in "inequitable conduct" and the judge could cut the amount of interest they could collect on their Washington Mutual securities. Such a finding could cost the funds hundreds of millions of dollars, but it might not be enough to produce any recovery for common stockholders.
The case is In re Washington Mutual, U.S. Bankruptcy Court, District of Delaware, No. 08-12229.

Why is everyone so worried? Just keep in mind that in most bankruptcies, common gets 0 anyway. We all took a gamble to stay in this stock. It is what it is. If commons get 0, everyone gets to write off some taxes.

Yeah I remember that, Shelia was in it too. They all seemed so worried in the movie. When I was watching it I kept thinking to myself, "wow, are you kidding me." That movie opened my eyes.
Anyway we should all pool our monies together and open a bank. Borrow money at 0% and make 10% on it a year.
You are absolutely correct. After reading about what happened to WAMU, it's quite sad actually. I remember watching this movie not too long ago about the financial crisis in 2008 where the Fed and all the bank CEOs were forced to take bailouts or whatever. Makes you think how shady all these policy makers and corporate America really are. I just hope the investors can recover whatever they can since WAMU was forced into bankruptcy. The truth is BAC and C should've gone down instead. And with the Feds keep rates at near 0%, the banks are just borrowing free $ and making money on the average American. Where is our bailout???
