"Treaty was and still is also a scam run by scammers."
What are the names of the so-called scammers that currently run Treaty?
Yes Kanola, good news is just around the corner! Of course those that don't want Treaty to succeed won't find the news good at all!
"Kramer made a deal with SEC ? Total BS"
No it's 100% true. Hallin and Hyatt are not happy about it, but it's a fact. And Treaty was able to settle without admitting guilt.
That's pure speculation. That is not the reason Treaty settled with the SEC.
I guess it will be really hard for some to understand it when it DOES happen.
That would satisfy the SEC. in fact Jennifer Brandt encouraged it.
Treaty will file audited up-to-date financials.
Hmm. Seems like another year keeps getting added to the hopeful prediction.
Treaty will file audited financials.
Nope, not true. That's just hopeful speculation by some.
"which we predict will not happen in 2018"
Who is "we?"
Treaty won't be revoked.
Treaty won't be delisted.
"Just proves how bad the defense was"
It wasn't Treaty's defense.
"That's in reference to the Ashe, 992 case, not the Treaty and gang of cons case."
Not true at all. Read it again closely and carefully. When the judge stated: the SEC “truly walked the razor's edge with their response, he was talking about the SEC's response to the Rule 56 Motion for Summary Judgment in the SEC case against Treaty and the Fab 5. The 1993 case of Ashe V. Corley wasn't a case the SEC was involved in.
NSS abettors will twist the truth to fit their agenda that Treaty Energy has no naked shorts. They have 450,000 reasons! LOL!
"Judge ruled 3 times that TECO's attorney rubbish arguments was unreceivable"
No, not true. Henry Klein is NOT TECO's attorney. Treaty settled with the SEC without admitting guilt!
The NSS abettors try every trick in the book to lie and stretch the truth about the existence of NSS with Treaty stock. Not working! LOL!
He never mentioned NSS!
"The Judge said that Treaty and the gang of cons provided no evidence of NSS."
The judge said? Really? Provide one quote from the judge where he even mentions NSS with Treaty.
The judge did NOT state there is no NSS with Treaty stock. In fact he made no mention of it whatsoever.
Please provide a link where the judge states specifically that there is no NSS in Treaty.
That rig will never come back to the US. I doubt it will ever be used again. It would probably cost more than the Treaty audits to get it functional. It's too bad, but that whole ordeal probably contributed to Mack's heart attack.
Quote: "And the reference to the SEC walking a razors edge was a reference from a different case."
No same case, just a different motion.
Quote: "The SEC will simply amend the complaint and then the Schlesinger motion will be denied." That of course is speculation unless you have direct knowledge from the SEC. Why wasn't the complaint done correctly in the first place? The judge wasn't satisfied with the evidence. The SEC had many months of investigation leading up to filing the complaint. If they couldn't come up with proper evidence then, how can they do it in 21 days? Their complaint is in real trouble.
Obviously the SEC was rattled by the judge's decision in the Schlessinger motion. Thus bringing in Chris Davis. And the SEC "walking the razor's edge" in Henry Klein's motion. It's obvious the SEC is in real trouble with their complaint.
You firmly said: "Jennifer Brandt is NOT being replaced." So what is Chris Davis' role? And how would you know?
How is it known Jessica Brandt is still on the case even though Chris Davis has been brought on?
Quote: "Jennifer Brandt is NOT being replaced."
The judge's decision on Schlessinger's motion must have the SEC rattled.
How do you know Jennifer Brandt is not being replaced?
The link you provided is signed by Jennifer Brandt. How do you know Chris Davis is on the team?
How is this known that Chris Davis will be on the team that handles the civil trial against Treaty and the other defendants?
Quote: "If all these corporate actions are approved, it's in no way in the best interest of current shareholders..."
Wait a minute. I thought current shareholders already lost everything. How could it possibly get any worse? And of course, if these corporate actions are approved, things will be remarkably better.
You're not understanding. The SEC doesn't have the option to prove one or the other. That's not the way it works.
Actually that makes no sense that one rule or another can be used.
However, allegations of fraud must meet a higher standard
than the basic notice pleading required by Rule 8. “In alleging
fraud or mistake, a party must state with particularity the
circumstances constituting fraud or mistake.” Fed. R. Civ. P.
9(b). Importantly, though, the second sentence of Rule 9(b)
relaxes the particularity requirement for conditions of the
mind, such as scienter. Tuchman v. DSC Commc'ns Corp., 14 F.3d
1061, 1068 (5th Cir. 1994). “Malice, intent, knowledge, and
other conditions of a person's mind may be alleged generally.”
Fed. R. Civ. P. 9(b). The particularity requirement of Rule 9(b)
does not render the principles of simplicity established by Rule
8 inapplicable; the two rules must be read in harmony.
IT IS HEREBY ORDERED that Defendant’s Partial Motion to
Dismiss (Rec. Doc. 18) is GRANTED IN PART, inasmuch as the Court
concludes that Plaintiff’s Complaint fails to meet the pleading
requirements, and DENIED IN PART, as to Defendant’s request for
a dismissal with prejudice of Plaintiff’s claims. Plaintiff
shall file an amended complaint within twenty-one (21) days from
entry of this order; otherwise the aforementioned claims against
Defendant will be dismissed.
What matters is what Judge Barbier rules.
Technically the SEC has 21 days to amend their complaint with evidence that will satisfy the judge. They've had nine months since they originally filed the complaint, and many months investigation before that, so how likely is that?
"I read it a couple days past."
Actually the judge just ruled yesterday. Wonder why it wasn't posted by someone with a Pacer account. I guess because they felt it was bad news.
"What would make anyone think they have sufficient evidence against anyone else ?"
Exactly! That's what happens when evidence is gathered by a person with a grudge against Ron Blackburn.
