In the hands of a more formidable (who has the means to actively litigate more successfully) company IDCC's patents may be licensed at a much higher $$$ rate. Not sure it is necessarily AAPL (who would use it for a more defensive purpose) but maybe a private firm or chip maker (INTC)?

HTC Posts Big Earnings Miss, Sees Signs of Slowing Growth
For what it's worth HTC has been extremely slow to innovate - all their models since the HTC HD2/EVO released 2.5 years ago are almost the same. Samsung, Apple and others are eating their lunch and constantly innovating the product line. HTC is like the RIM of Android phone makers.
huibs, "NPE" is the more "politically correct" term you meant. NPE stands for non-producing entity. Troll is a subset of NPE who merely strategically buys patents and ligates profusely without producing any products based on the patents (no other business besides buying and suing). Also I believe with Slim chip, IDCC is/was designing/making some hardware based on their IP (someone clarify this please).
The patent buyers of IDCC wouldn't be "trolls" just because they buy patents - they also manufacturer and have a core business which negates them from "troll" status (I'm thinking of the big companies rumored to purchase IDCC - AAPL, INTC, etc.).
If the company is a joke, isn't the bigger joke those who stay invested?

The ban only pertains to devices that use older version's of Android: 1.6 to 2.2 which are only found on older phones. Those still pull some volume but the newer stuff which sells the most in the U.S. uses 2.3 (Gingerbread).

E*TRADE Announces Conclusion of Review of Strategic Alternatives
E*TRADE Financial Corporation (NASDAQ: ETFC) today announced that its Board of Directors has concluded the previously announced review of strategic alternatives.
The strategic review began in early August and was designed to objectively review all strategic alternatives for the company, including a possible sale. With a primary focus on maximizing stockholder value, and consistent with the recommendation of Goldman Sachs & Co., the company's financial advisor, the Board unanimously determined that the continued execution of the company's business plan is currently the best alternative for increasing stockholder value.

This is the most likely scenario. I mean think about it, if it didn't you would have the "mother of all abridge" opportunities. I would be buying tons of shares knowing that one could get 20% return in a few months.
The tax implications on a partial sale would be rather bad (35% corporate taxes).
Most likely a late transaction that occurred during the day.

American style options can be exercised by the holder any time before the expiry date (in this case January 19th, 2013) if they are in the money. Usually this would not be done because of the time value one would lose by doing so (one could just sell the option itself if they wanted to cash out).

Yea I figured that you meant he also held common stock. My post was regarding just the selling Puts part in itself.
Same thing (write == sell == short call).
Naked calls versus covered calls is a whole different ball game (in terms of risk).
He's selling naked Puts which means his upside is only the premium. If IDCC goes to zero before expiration he is on the hook for $40.30/share. If IDCC gets bought out for $150 before expiration, the Puts he sold are worth zero and he keeps the premium but not any of the upside.
I'm not saying it's a bad trade (I think it is a good one), just wanted to point out the extreme outcomes.
Not quite like buying a stock at $40.30. You don't participate in the upside reward for taking the risk. You do keep the full premium like you said above $45.
How does one interpret the "and could actually be additive" line?
A source close to the transaction tells Forbes that the company indeed has received bids in the $1 billion to $2 billion range, but that the offers were not for the whole company, and could actually be additive.

I was tied up in meetings so I missed all the fun and games today with IDCC. It appears like the typical games played by those that see an opportunity to take advantage of retail investors with stop loss orders. First, they start a avalanche by selling short when they see a weakness on the bid. They follow that up with a well timed rumor that hurts the stock. We've seen it dozens of times with Rambus.
IDCC is the perfect stock to do this with...because the company has placed their own virtual gag order on themselves so they can't even respond and say they were pleased with early bids. To top it off....the Federal Circuit has taken 8.5 months (thus far) and still hasn't issued a ruling. That makes IDCC prime for manipulation...and we probably haven't seen the last of it.
If you own shares and you have faith in the company's LTE/4G IP.... then today's little escapade will just be a blip on the radar screen in a few months when the company is worth > $150.

Not quite the "same thing". For your downside protection you are taking 2x risk on the long calls. If you would have bought 1x long Dec 70 by itself it gives you the same upside as your spread without the downside protection.
