It definitely feels like Amarin is losing the perception war with BP. I guess IE isn't viewed the same as some of the other new drugs BP is buying. Wish I was wrong.

Clerks write opinion and Judge signs off. If Du has a strong opinion in favor of one party I believe we can have a decision late this week or sometime next. Will be interesting to see what happens.
If Judge Du has a strong opinion one way or the other we are likely to get a decision sooner than later. She may already have her decision written. Hopefully we get an early suprise.

How often does AMGN issue at the shelf? Do they usually do so when getting ready to make an acquisition? I suppose we'll find out soon enough after they publicize the offering details and then follow up.

I'm just cautioning that patent law is complex, cases can drag on during appeal, and there are sometimes surprises.
If BP is serious they can read the patents now and decide today on long term merits. Nothing changes as a result of District Court decision in my opinion. Circuit Court has the final say, and many areas of patent law can be quite subjective.

Also, anybody who thinks patent law is determined at the District Court level is misguided. If there is a dispute, Circuit Court always has the final say since most cases don't go to Supreme Court.
This is a subjective matter of law, without settlement it is certain to go on to appeal.

Markman legal blog states that obviousness claims will likely come down to expert witnesses. If that is the case I don't see how this dosen't go to appeal regardless of Du decison.

Either the case is material or not. If material then Judge Du decision irrelevant. It goes to appeal. If frivolous than immaterial at District Court or appeal.

My opinion on case is that if the IP is strong it is immaterial. If truly at risk, at risk on appeal.

Everyone assumes the price action is linked to case. It's only a District Court case. If Amarin is sure to win than BP and industry knows it. Either Amarin is sure to win as so many have suggested and case is immaterial or the IP is at risk. If former is true, the price action is fear, not the case. Tide can change quickly if former is true.

JT told shareholders immediately about Adcom against FDA advise. He would tell us right away about 14B.
I don't see how 14B is not fair. We won't be at multiple billions until 2022 or 2023 based on projections today. 14B would be something shareholders should know about if on the table. And I do think JT is amazing CEO and serious 14B would be put to a vote. We haven't heard about it because no formal offer has been made yet. To think 14B would not be presented over potential two to three years down road is not reasonable.

I don't think FDA should have required outcome studies for Amarin. They did and it put us in a holding pattern for years. I would not assume every Company with CV indication will be required to do outcome studies just because MAmarin did years ago.

It isn't up to JT. I'm just saying any offer at 35-45 would be approved handily by shareholders in my humble opinion. Also, technology is evolving much faster than 10, 20, 30 years ago. To assume V is best game in town in say 5 years isn't realistic. We shall see what happen, I would be happy with 35-45 having been on the train since 1 and change.
EXAS has a market cap of 13 plus billion on revenue similar to AMRN. If we are to take EXAS as the example, AMRN should be at 30 ish now.
I disagree. We are sitting at 18.50. That is reality. Also, so far projections from JT are conservative. BP wants upside as well. At 15B that would be 4 x 3.75 implied peak. Very fair considering actual projections today.
I think a deal between 35-40 would handily have wide shareholder approval. I hope it happens.
I remain in the camp that believes a deal could happen at anytime, with the more time that passes the less likely.
Without a BO what we need is to see those scripts rocket.
