I think the outstanding shares should be and will be caped at 200 MM per the corporation bi laws. That should be fairly easy to fight in court.

5 years of infringing
Year one - 500,000 users = $12 mill
Year two - 1 mill users = $24 mill
Year three - 1.5 mill users = $36 mill
Year four - 3 mill users = $72 mill
Year five - 5 mill users = $120 mill
$264 million
This is how much t-mobile is charging, not what we would get paid, $5 per phone was a high estimate.

I'm being realistic! Would I like to get a half billion dollar settlement, yes. Do I think that is going to happen, NO. Do I think or patent covers cellular to wifi seamless transfer, yes. Do I think tmobile infringed on our patent, yes.
So how much do they owe us, all of their customers were not infringing, only the customers that signed up for talk at home service. OK how many, 10,000, 20,000, 50,000. Does any one know? How much per phone, per month, $5, $10?
So let's say 100,000 customers at $5 per month for 3 years
100,000 * 5 * 12 * 3 = $18,000,000 plus any treble damages
I don't see how we will ever get any thing close to $200,000 much less $500,000

If you add in the lawyer fees, DD 28%, outstanding bills, and pay off the note holders, that's a 110 million settlement.

Thanks for pointing out that CLYW lawyers are stupid, lazy and incompetent. I now feel more confident than ever that I will soon be a millionaire. I would sure hate to know that my entire investment rest in the hands of a corrupt judge.
The context of that sentence is that t-mobile didn't reduce our revenue by infringing like Samsung did to apple!
My prediction, if we get a favorable outcome in the markmen herring, t-mobile offers us 20 to 50 million to go away. If the receiver accepts the offer everyone will be disappointed. If this case goes to trial and if we win, t-mobile will appeal the verdict and keep this tied up in the courts for the next several years.
I have come to the realization that this investment is not going to pay off. Only the lawyers are going to make any money.
I'm not disputing anything you said, but apple or some other co. infringing on our patent has nothing to do with the t-mobile case.
I want there to be a fairy tale ending just like everyone else, it's how I got caught up in this in the first place. I still own over a million shares and I have three notes secured by the patent.
T-mobile did not make billions using our technology. How much did they make using it, that's for the judge to decide. What percent of that number should CLYW receive from them infringing on our patent, that's for the jury to decide.
The apple settlement was largely based on lost revenue because of Samsung infringing on their phone design, a billion dollars is a small percent of apples annual revenue. T-mobile infringing on CLYW's patent didn't cost us any money.
