U.S. Wants to Extend Oversight of Microsoft's Business Practices Until at Least November 2009
WASHINGTON (AP) -- Citing Microsoft Corp. lapses under a landmark antitrust settlement, the Justice Department said Friday it wants to extend by two years its oversight of some of the company's business practices until at least November 2009.
Microsoft has already agreed to the lengthier scrutiny by the Justice Department and 17 states under a proposal that still must be approved by a U.S. judge. The company has struggled with a key provision in the 2002 antitrust settlement requiring it to disclose to its competitors sensitive details about some of its software.
Government lawyers said they were prepared to extend oversight of Microsoft's business activities through 2012 if necessary

SOURCES SAID Nvidia is set to introduce its stable reference design for business desktops (NBP - Nvidia Business Platform) on the 14th of April, while Intel will intro its SIPP 2006 ten days later.
That means an AMD business platform will be available for not only the larger OEMs but for tier two firms and below to introduce, provoking the possibility that Intel will find itself with channel players able to target the corporate market on a stable CSIP (commercial) Nvidia design.
We guess we can also say it begs the eternal question, the one that concerns the great Satan of Hardware, Dell Itself.
Could the introduction of a stable Nvidia CSIP business platform give Dell the excuse it needs to sell machines with AMD chips inside?

Army issues statement of work for ITES-2

The Army today released a draft statement of work for its $10 billion Information Technology Enterprise Solutions-2 Hardware program.
Other draft items for ITES-2H will be released over the next few days, with the final RFP package coming in about a week, according to an Army official. The indefinite-delivery, indefinite-quantity contracts have a ceiling of $10 billion and will run over 10 years.
The draft statement of work says a contractor will provide for the purchase and lease of commercial servers, desktops, notebooks, workstations, Thin Clients, storage systems, networking equipment, printers and peripherals, including cabling products, monitors, VTC products, scanners, software and warranty options.
The draft also calls for contractors to provide for technology refreshes, to keep pace with changes in technology, over the life of the contract.
Later this month, the Army also expects to award indefinite-delivery, indefinite-quantity contracts to multiple vendors for Information Technology Enterprise Solutions-2 Services, pegged at $20 billion over nine years.

Improving informed consent is a $4.3 billion challenge that could be met if more facilities used their digital systems to automate the process, a pair of presenters said Tuesday at the Healthcare Information and Management Systems Society meeting in San Diego.
Dr. Neil H. Baum, an associate professor of urology at Tulane Medical School, and Timothy Kelly, vice president at Dialog Medical Systems, highlighted flaws in the current paper-based informed consent process. They said digital medical record and document management systems can be adapted to provide more understandable and more easily managed informed consent documents.
Research has demonstrated that written informed consent information is better understood by patients than verbal communication. More knowledgeable patients are more compliant, less anxious, more satisfied, and thus less likely to sue, Baum said. Unfortunately, well-informed patients are too often the exception.
Physicians may do a good job of verbal communication in an informed consent situation, but the documentation is usually inadequate, Baum said. Informed consent is often seen as a burdensome administrative detail that involves getting a signature on a form for the legal protection of physicians and institutions.
According to the American Medical Association, informed consent involves five essential elements:
statements covering diagnosis
purpose of treatment or procedure
risks and benefits of the treatment or procedure
alternatives, including risks and benefits
risks and benefits of not receiving the treatment or procedure
Problems with traditional paper form-based informed consent include limited descriptions, illegible handwriting, and use of unacceptable abbreviations. One study of 540 written consent forms from 157 hospitals found the five elements suggested by the AMA were present in only 26% of the documents, Baum said (Bottrell MM et al. Arch Surg 2000;135:26-23).
Paper-based forms can also be costly. A study at two VA medical centers found that consent forms were missing from the patient chart 8% of the time. Using that figure and assuming a 10-minute delay in the operating room for each missing record at a cost of $20/minute -- although actual delays can be much longer -- Baum calculated that the cost of missing consent forms could easily reach $3.4 billion, nearly $590,000 for each U.S. hospital.
Today’s digital environment offers a better option. Electronic medical records or document management systems can be used to extract and print out the appropriate informed consent information for any medical procedure or treatment. Systems also allow technicians or nurses to quiz patients and confirm that they understand the written consent material and to collect signatures via an electronic signature pad.
The electronic consent form can be added to the patient’s record, and alerts issued when information or signatures are missing, Kelly said. Updates can be included via progress notes.
The VA shifted to an automated informed consent system in September 2005, Baum said. A survey of physicians found the system scored 4.7 (on a scale of 5) for overall satisfaction and 4.9 for ease of learning. A survey of patients gave the system a 4.7 rating.

(WASHINGTON) -- Patients could use their cell phones to send physicians their medical and insurance information under a new initiative the Mobile Healthcare Alliance kicked off this week.
The Mobile Healthcare Alliance, or MoHCA, wants to enable mobile devices with a “consumer health manager” chip or specification that would help patients easily access and send healthcare information.
MoHCA officials say making these applications available over mobile devices could help in areas such as preventative care, geriatric care, disease management and sports medicine.
“I think it will be the major breakthrough in the whole health IT field,” C. Peter Waegemann, vice-chair of MoHCA and chief executive of the Medical Records Institute, told an audience of healthcare providers, mobile phone companies and IT vendors at the group’s meeting in Washington, D.C.
The use of personal health records among consumers is growing slowly, with less than one million people using such records to store their personal information, Waegemann said. MoHCA officials hope that access to such information on mobile devices could increase communication between providers and consumers, cut down on medical errors and save time.
Under the plan, such a service would allow a user to send basic medical and insurance information to their doctor before a visit. Patients also could receive medication reminders, confirm appointments, get test results or even use their cell phones to send a Continuity of Care Record, a standard under development that would provide a snapshot of a patient’s current and past treatments.
The application would hold duplicate data and patient information would still be stored with the provider. If a patient lost their cell phone, they could still retrieve the data from their provider.
Waegemann said the consumer health manager project is not meant to replace electronic health records. But he does see the application becoming available in the next two to three years, faster than most Americans would have an EHR.
Steven Waldren, MD, assistant director of the American Academy of Family Physicians’ Center for Health Information Technology, said there is a potential value in such communication if it allowed doctors to innovate without increasing their overhead costs.
In the meantime, MoHCA will begin to look at the privacy and security issues about sending data over cell phones and the ease of use. The group is hoping to get consensus from those in the healthcare industry about the data set for such an application. MoHCA is also seeking representatives from telecommunications carriers to participate in the effort. The group will meet in June to discuss a model for the project.

NEW DELHI - Computer maker Dell Inc. said Monday it planned to add 5,000 jobs in India over the next two years, bringing its work force in the country to 15,000.
Dell is also looking to set up a manufacturing center in India, a move that could help boost the sale of Dell computers here, President and CEO Kevin Rollins told reporters after a meeting with Indian Prime Minister Manmohan Singh.
The Round Rock, Texas-based company will hire 700 to 1,000 workers for a new call center in Gurgaon, a satellite town of the capital, New Delhi, Rollins said. The new call center, the company's fourth in India, will open in April, he said.
The other new hires will staff call centers in the cities of Bangalore and Hyderabad in southern India and Mohali in the northern state of Punjab. Also this year, the company plans to double the staff at its product testing center in Bangalore, which currently employs 300 engineers, Rollins said.
During his previous visit to India in April last year, Rollins had said Dell would make India a hub for its software development and back-office work.
Currently, the company has three call centers in India, a product testing center for corporate customers and a global software development center. Some 10,000 people are employed at these facilities.
Scores of Western companies have been cutting costs by shifting software development, engineering design and routine office functions to countries such as India, where English-speaking workers are plentiful and wages are low.
But Rollins said his company's expansion plans were not limited to tapping the talent, but also benefit from the growing demand for desktop computers and notebooks.
Dell accounts for less than 4 percent of the 4 million computers sold in India, whereas the company's share in the global market is about 18 percent, he said.
Taxes levied by the Indian government on computers and computer parts are a major factor affecting pricing of Dell products and their sluggish sales here.
A manufacturing facility could help the company boost its presence in India, where computer sales are expected to increase to 10 million annually over the next three to five years.
"We have come to the conclusion that time is ripe to consider a manufacturing facility in India," Rollins said. "We want to do it fast," he said, but gave no time frame or investment details.
He said the company was talking to local authorities in several Indian states to identify a site and a decision will be made soon.
Dell currently operates nine plants, six of them outside the United States.

Adventures in Microsoft Windows XP Media Center Edition 2005
Here's a few items that I wanted to share (or follow up later) regarding various cool things you can do with Microsoft Windows XP Media Center Edition 2005 (MCE).
Case
I haven't decided what I want to do regarding a case, but this one looks nice. Need to do some evaluating...
Caller ID
Although MCE (2005 version) supports on screen Caller ID if you have a compatible modem installed, the issue I've run into is my main MCE box doesn't have the hardware. What to do? Well, use YAC and MCE-YAC. Not only does this bring Caller ID to Media Center, but to every machine in the house.
Channel 9
I really have enjoyed watching Channel 9 whenever I can remember to take the time to go look. Even having an RSS feed doesn't seem to keep me as up to date with it as you'd think. Well, there's a MCE solution. TVTonic offers the ability to subscribe to Channel 9 videos, they get downloaded in the background and upon availability you can watch them as if they were an individual channel. Now when nothing is on, I have something to watch while being a couch potato.

O.T. Dell has to take AMD Opteron route, report

THE STORY that defies the rule that all stories eventually come true has still not delivered its promise.
But analyst Les Santiago reckons that Dell will adopt AMD Opterons in the second half of this year, according to Associated Press. Les’ speculations are based on talks with Dell’s salesmen who want to flog Opteron based systems.
AMD's share price rose $1.24 to $34.49, building on the financial analyst's notion and musings.
The same Les reckons that Michael Dell has recently said there was a distinct possibility that it could adopt AMD systems.
Michael Dell recently took the stage with Intel CEO Paul Otellini to proclaim the launch of Yonah based microprocessors. This time last year we reported that Intel felt Dell was exercising too powerful a hold in the PC market.
Intel has a number of counters on its side, including the Intel Inside campaign. Dell can always wheel in AMD executives and make sure the next time Intel visits they’ll see Hector Ruiz’ name in the visitor’s book.
But when Hector Ruiz opened the Dresden Fab 36 late last year, he was optimistic about IBM using Opterons more in 2006, but was distinctly pessimistic about Dell. All stories eventually come true. But will Apple’s use of Intel chips concentrate Mikey Dell’s mind? If Sun has anything to do with it, it surely must want Hector to stick to the HPC market and not go down the Dell route? AMD would also badly cheese off its carefully built system integrator and channel market, if that matters, that is.

Predictions for the New Year

Each year at this time, all of us at Pundits are asked for our predictions for the New Year. This marks my 25th year at Creative Strategies and my predictions below also mark my 25th year at sharing my views about the coming New Year.
Here are my predictions for 2006
1- There will be a Stronger Focus on the “Connected Consumer.”
In last year’s predictions column, I suggested that there would be a strong emphasis on the digital living room, and as you know, this has been a big issue over the last 12 months. All of the big PC and CE players have taken aim at the home and especially the digital living room and the cable and telecom companies have also made this a major battlefront in their quest to deliver new products and services for the networked home of the future. However, I now see a bit of a shift in thinking from all of the major players in these key industries from the digital home to instead, the connected digital consumer. Don’t get me wrong here. The battle for control of the digital living room is far from over, but it has dawned on a lot of the players that perhaps the biggest prize is not the ownership of the digital living room but instead, ownership of the “connected consumer.”
Apple already has a major position here and ironically, will use this “connected consumer” via the iPod to give them a solid place in the living room at some point.
But 2006 will see a real move towards exploring what it means when a consumer can be connected at all times to information, services and personal content and we will begin seeing a lot of discussion around this issue heat up in 2006.
Side Note- At CES, I am doing a super session entitled “The Battle For Control of the Connected Consumer, on January 5th at 1:30 in room N 257 of the Las Vegas Convention Center.
2- HD Storage Wars vs. On Demand
While there will be a real battle between the HD DVD and Blue Ray camps over trying to get their new HD storage formats accepted by the mainstream public, it will become clearer to them and the industry that the real competition in HD will come from more and more mainstream and HD content becoming available on demand. In years past, DVD’s took off because people wanted to have fast access in real time to movies and other DVD content and could not get that content for immediate use other then buying them or renting the DVD of that particular movie or content. But as broadband becomes more widely available and DRM’s get flushed out in ways that are acceptable to Hollywood and the TV broadcasters, we will see more movies, TV shows, etc become available in on demand formats. This alone should get the two sides to try and work around a single high def recording format for use in HD recorders and work to get the prices down on these systems as fast as possible in order to meet this on-demand threat head on. Although large amounts of content on demand are still a bit into the future, don’t underestimate its competitive impact on the success or failure of these new high density recording devices.
3- Viiv and Vista hype will dominate industry commentary and tech air waves
It will be very clear after CES that for Intel and Microsoft, Viiv (and Dual Core processors) and Vista will be at the center of their 2006 focus. Intel’s Viiv platform is aimed at consumers and at its heart is a new dual core architecture that makes Microsoft’s Media Center PC’s work better. At the same time, this is the year that Microsoft finally releases a new OS that will have major ramifications on future Media Center PC adoption rates as well as giving business and consumers a more stable and easier to use mainstream operating system. Interestingly, Vista alone will have a big impact on PC sales in the coming year. I am already hearing from IT directors that they are factoring in Dual Core and Vista into new purchases in 2006 and although 2007 will be the year when PC sales of advanced systems to support Vista will really be in full swing, there should be a sizable number of PC’s bought next year in anticipation of Vista.
4-Smart Phones gain larger percent of market
One trend in 2006 is that even low cost cell phones will get smarter. However, I also believe that what we define as true smart phones will become a larger part of the market for cell phones in the next few years. In fact, my recent forecast is that by 2010, 15-17% of all cell phones sold WW will be what is defined as smart phones. I realize that a smart phone definition today is all over the map, but in my description, these are phones that have at least a 2 inch screen and can handle email, full web browsing and have an OS included that supports third party software and applications. Although plain cell phones that strictly do voice, pictures and perhaps even simple instant messaging will have the lion’s share of this market, I believe demand for products like Palm’s Treo, Rim’s Blackberry and Microsoft Windows Mobile platform, as well as smart phones that will be Linux and Symbian based will become a larger mix of phones sold over the next five years.
5- Podcasts and Audio Blogs add Video
I have become a real fan of audio blogs or podcasts and next year video blogs will gain some strength. Of course, it took Apple’s addition of Podcasts to iTunes to really kick start audio blogs and this has enticed many to create not only audio but video blogs as well.
Of the few video blogs available today, Rocketboom and HIT stand out as being well done, but I have seen some semi-professional VLOGS that are in the works and they should debut in Q 1 of 2006.
I also expect to see some of these audio and video blogs move to a subscription model to help defray costs and some may even get advertisers to back them as well.
But expect 2006 to see a plethora of VLOGS coming to iTunes and other music stores and gain some serious followers in the coming year.
6- Mobile and Wireless
This is an area that will see continued growth in 2006. New innovative mobile phones are headed for the market and more and more people around the world will buy cell phones. Current estimates are that 800 million cell phones will be sold next year and well over 1 billion will be sold by 2010. And laptop sales will continue to be strong. By late 2004, laptops surpassed desktops in total YTY sales and we see this trend continuing. The addition of new dual core laptops will help fuel even stronger growth in portable computers in 2006 and although ultralights represent the smallest category of laptops sold, new wide screen ultraportables with DVD drives in them could push demand for these smaller and lighter mobile computers in the coming year.
7-TFT LCD big Screen TV Go Mainstream
While plasma TV’s are not dead by any means, 2006 will start seeing a real shift towards LCD TFT televisions as the Big Kahuna’s of flat panel TV’s. Prices are rapidly coming down for larger LCD TV displays and Sony will start pushing their Bravia line of LCD TFT sets big time during the coming year. We should see the 40 inch LCD TFT screens well under $2800 by next Christmas. For larger screens, rear projection still represents the best bang for the buck and plasma TV’s are still getting better but competition from LCD’s will have the biggest impact on plasma’s future.
8-The Tech Economy Stays Hot
2006 should be a very good year for the Tech Economy. With Vista pushing demand for more powerful systems and laptops gaining more popularity, PC sales should see at least 7-9% growth in the New Year. At the same time, we see strong demand for digital cameras, HD televisions, VOIP related products and mobile audio/video players.
Altogether, they should keep the tech economy humming in 2006.
9- The Rise of Pre-Paid Rechargeable Gift Cards to Prevent Stolen Financial Identity
I don’t know if Visa or Mastercard understands how important this is but these rechargeable gift cards are a god send for anyone wanting to purchase products online and are afraid of their financial data being stolen. I picked up a Visa gift card recently and put $200 on it. I then used it exclusively to buy Christmas gifts online and since it is tied to a prepaid credit card, it has no personal financial information connected to it at all.
I realize that by using my bank credit card I would have no more then a $50 liability if the card was stolen and used by others and if I lost this gift card I would be out anything left on the card itself. But I believe many people will begin to see these pre-paid cards that are not tied to your personal banking data as a valuable tool and we will see them being used more and more for online transactions.
10- Apple Starts Official Trek towards Becoming a Powerful Consumer Electronic Company
Although Apple is still a computer company, their success of the iPod has shown that they can be potentially stronger as a CE vendor. But they have an interesting dynamic that will make them the only PC Company who I think can transition into a powerful CE company as well.
Apple’s edge is that they not only have PC and CE devices, but they also have the content tied directly to these products and in essence are creating a total ecosystem where all are linked together easily and seamlessly into a single solution. I fully expect Apple to extend their reach into the living room at some time in 2006 and by the end of the New Year we should have a real strong understanding of how Apple plans to “own” the digital home of the future. My best guess is that Apple will lay out a more detailed plan for their approach to the digital home at their next developer’s conference mid year.
