The Rosen case had nothing to do with "paid bashers". Rosen was an MM working for J Alexander. He'd had regulatory problems before, and he's had them since.
He decided to "bash" the stock in question on his own. He wasn't being paid to do that; he was being paid to be a market maker.

Some get cash, or a combination of cash and stock.
They probably only get paid if the stock value goes up and they sell into it.
Occasionally they even sign contracts specifying that they'll get X amount of stock if the price reaches X...

Judgments have been awarded in several of the cases. None of the cases has anything to do with CMKX; one old one involves Petro Plus, in the others Urbie and Carolyn (and sometimes others) are individual defendants.

guess is for disseminating unauthorized information to unconfirmed
shareholders in a way that was misleading! If that is the case then
they are liable!
They're liable for nothing. It's routine for TAs to tell people what the o/s is. "Normal" companies don't try to conceal it. And what's "misleading"? The o/s is the o/s. This should not be a complicated issue.
TAs aren't directly involved with buying and selling, so there'll be no immediate effect. BUT you need a TA (or need to be self-transfer) if you want to issue any stock.
IF we no longer have a TA how are buys and sells still going through?
Here's the deal on self-transfer: you can issue up to 500 certificates, but after that you have to apply to the SEC to become formally self-transfer. I no longer remember what that entails; maybe I'll look it up later.
