Actually there's a regulation that covers this question; if you still hold an open short position when a company ceases trading, yes, you do have to pony up to Uncle Sam.

In order for any stock to get on that list, the DTCC has to counterfiet stocks to an unsuspecting buyer. How else could the DTCC deliver a stock that they never obtained from the seller?

But just think how many people attended the races, many, no doubt, spending more money on their trips than their stock was worth. At the meets they were able to talk with Urbie--one even said, amazingly, "He was standing there like a God"--and develop friendships with other CMKX shareholders. The races also reeled in new marks: Melvin said recently that after ever meet he got an avalanche of new inquiries.
If it hadn't been for the Funny Car, I doubt the CMKX cult would be as cohesive as it is today.

We do know that. If you don't, it's because you haven't been following the claims records.
It doesn't matter if CMKX still holds claim to it or not as long as it's proven to have been valuable during the time of any possible naked short position in the CMKX stock. Any possible damages caused to the company and it's shareholders by any criminal short position will still be based on any future value that may be assessed from those claims.
Now that's just nonsense. Wherever did you get that idea? CMKX wasn't forced to give up any claims; it just let them lapse.

Frizzy initially said "about 60,000", but didn't realize that there's a difference between "accounts" and "shareholders". Even then, he wasn't considering accounts that had once held CMKX but whose owners had sold their stock.
The "70,000" was just typical message board exaggeration.

Yep. That's one of the worst mistakes some people make. While to a certain extent a rising tide in a hot sector may raise all boats, if a company has a history of poor performance, not much is gonna happen.
