I need to go back and do a little research. Dates of transactions are critical here. My experience in these areas is VERY LIMITED but I'm going to do my best to wade through things in order to form my own opinion. TA, I think the implication that cabos is a basher comes from when you say "other bashers". If you had said "I would not engage in conversation with "bashers" it would have been clearer:) SH
That's not correct,Print. There have been numerous posts here that have discussed the possibility that the law suit may go through. (See Bill Branum's posts for an example). IMO, the issue here is your calculations of what the damages will be. SH

Cabos, I refer you to my post #10636. The information I got was from someone trained in "the law" and who is now a practicing investment banker,basically affirmed what FG has been saying re the "Safe Harbor" laws that cover all "Forward Looking Statements" in PR's put out by Publicly Trading Companies. The PR's are protected via a Congressional Act. The onle issue at hand is the errors in accounting for two quarters during the year 2000. That is how I understand it to be. AGAIN I am not an attorney, nor do I know that my source is an attorney. The above is only what I could surmise after one telephone conversation with an annonymous source. Good luck in your quest, SH

I just got off the phone with someone I trust and this is what he told me:
The PR's are protected under "the forward looking statement" clause. This was enacted by congress two-three years ago. (Sorry, I don't know the #)
Intent is not relevant with respect to the revenue reports. The company is liable for mistakes.
Whether or not this will go to court is usually determined on if the suit is lawyer driven or shareholder driven. He said that almost always, the lawyer driven cases are settled resulting in a nice profit for the attorneys but very little for the shareholders.
He also told me that you didn't have to sell your shares to be a party to the suit. He went on to add that he didn't understand why shareholders would do this because the shareholders would basically be sueing themselves. (something I said a while back)
So there it is.
DISCLAIMER........ I know my friend went to law school but I don't know if he was ever licensed to practise. I don't even know if he ever took or passed the Bar Exam. I do know that he is very knowledgable in these matters and is currently employed by a major brokerage firm. I haven't personally researched any of the above information so take it all for what you may think it's worth.

Cabos, the restaurant business really eats up your time. Was involved in that area for many years. I've been offered a job that I am considering but the hours are later in the day. I'd be working 'till 6:30ish. The first thing I thought was that the job would interfere with my fishing. When I ran it past my husband, guess what the first thing he said was? <GGG>

Shamus, I do pay attention to you. Your last post is over the line, IMO, in that the last paragragh contains a personal attack. I have been very ill for the last two weeks and have put restrictions on myself in my capacity as a director of this board. I have only been removing spam and obscenities. It is funny that the post I made to Bill B was exalting the fact that people could disagree on this board in a civil manner and the very next post was one that IMO, violated the TOS rules. I'll leave it for the others to determine whether or not your post should remain on the public thread. I don't trust my judgement 100% yet. Personally, it's only the last paragragh that I find objectionable. SH

Just so we're clear, I didn't say I didn't think there was a chance for a lawsuit. I don't know all of the particulars with respect to the claims filed against SEVU. I was just pointing out the differences between the case litigated against Waste Management and what I believe to be correct in the case filed against SEVU. IMO, there are several factors which may or may not have an impact on the outcome of SEVU's case. I don't know much about the law so I really don't want to go out too far on this limb but I think the PR's are a potential problem. On the other hand, I think that "intent" may be difficult to prove. For the lawsuit to be successful, they're gonna have to prove that SEVU intentionally and knowingingly put out false PRs. If, on the other hand, SEVU believed that what they were saying was within the realm of possibilities and they have the documentation to back these statements up then they're in the clear. There is also the possibility that the claimed damages may be small enough that the company may decide that it's easier (and cheaper) to settle it through arbitration than to duke it out in the courts. My gut feeling? I'd put the odds at 50/50. All just my opinion only. SH
Cabos, the differences here, IMO, are that waste mananagement's problems stemmed from "audit reports" and went on for a period of three years (1993-1996) with discrepancies in over ONE BILLION dollars. It is my understanding that SEVU's discrepancies in revenue were from the unaudited reports and were corrected in the year end audited report. Someone, no doubt, will correct me if I am wrong about this but I think there is a major difference between the two situations. SH
I always like to tell people that you can't change the past but you can change the future. It's SOOOOO much easier to live with a positive attitude.

Well that's a relief. I was gonna suggest you have a talk with the overnight cleaning crew. Glad to know they're honest. The only thing Barry did in this area (I'm in St Petersburg) was give us a much needed drenching and ruin the fishing for a couple of days :( SH

The problem with a half hour infomercial is that the product is so simple to install that how would they fill an entire half hour?<g>
I still think the parking lot sales will be the exciting news for this company. This system is relatively inexpensive to purchase and install so the mall developers and managers are going to love it. Especially when the retail season kicks in!!!! The news media will also be an ally here. They are always telling folks about the strong arms etc that happen to shoppers. They siscuss safety tips like parking in well lit areas, being alert and having your keys out and ready (keys can be a very good weapon for self defense BTW, if you hold one between your first and second finger pointed end out with the round/square end in the palm of your hand).
It's gonna take a while longer for the product to test marketed by the big retailers/developers but I LOVE THE CONCEPT so I'm willing to wait for the anticipated outcome, SH

One more thing before I sign off, I regularly go back and review "removed" posts. I have been doing this for quite some time. I take my position here very seriously. I did not ask for the job but was "appointed to it". I really didn't want "the job" because I knew it required me to be objective and hence would require me to delete posts that although I agreed with, would violate the TOS. However, once I agreed to accept the position, I did the job as objectively as humanly possible. As I have previously posted, I love the written word and it ALWAYS (well almost always, exception being when the written word debases the language} pains me to remove ANYONE'S word, be they pro or con.
Well, I've digressed. The point I was really intending to make here was, that upon reviewing removed posts, I had come to the realization that NOT ONE COMPLAINT EVER came from a SEVU long when I had removed one of their posts for a TOS violation. NOT A ONE. And there have been many posts by longs that I and Gotin and FG have deleted.
That, my friends, speaks volumes.
Any additional questions as to the "fairness of this board" should be addressed to Bob Z. He was a former administrator with IHUB who has since moved on. He had some "issues" with FG but throughout it all he openly and unsolicitedly proclaimed that we, on the SEVU thread were "exemplary" in maintaining an "unbiased" thread.
I have been really ill for the past two weeks and have not been paying as much attention to this board as I should. I have even thought about resigning my position because I didn't have the energy to deal with all of the nonsence spewed out here day after day after day. After today's problems, I've decided to stay around awhile longer. SH

Oh yeah, I was supposed to post this evening in response to allegations made against the directors, chair and admin with respect to the SEVU thread. Well I don't want to.
For one thing, I'll have to admit to FG, even after all of his admonishments to the contrary, that I did not practice copying and pasting.
Secondly, I'm out of paper so I can't even print out a copy of the deleted post to which I am supposed to be responding to.
Thirdly, I'm tired and I just don't feel like working that hard. Being a volunteer does have it's priveliges. I have been a volunteer in one way or another for fifteen plus years and have learned that it's very difficult to get fired. As a matter of fact they usually give you more jobs, no matter how badly you perform.
As Miss Scarlett would say, "I'll deal with this tomarrow (or something like that) for tomarrow is another day" SH

Fishing was horrid but the sunset was breathtaking. Definitely the best of the season so far. The western sky was a brilliant orange and purple, absolutely gorgeous... BUT... the eastern sky was amazing!!!!! I remember thinking that if I were in the far north, this is probably what the aurora borealis would look like. The clouds weren't moving quite as fast as the borealis looked to move in the videos I've seen (what causes that anyway, I can't remember but I vaguely recall something about sun flares or electronically charged particles or something like that?) but never the less, they were very similar in appearance and were moving relatively swiftly. At first, the color was all blue and white but,as the sun set, they changed to very intense pastel pink and purple. It was very difficult to focus on my fishing.
I almost talked my husband out of going because the radar looked bad. We finally agreed to go on the condition that if he got me killed he'd better take himself out as well for I warned him that I would haunt him every waking and sleeping minute of his natural life. (UH-OH, was that an internet threat? The threat wasn't made on the net but the crime was reported on the net. Hum. Perhaps someone should call the FBI?) We had six dozen, very active, jumbo shrimp so there really wasn't a choice. Anyway, we got to our first destination and I got a good hook on a really big Ladyfish. For those of you that aren't familiar with Florida fishing, they call them "the poor man's Tarpon". A big one will give you a nice tug if you're using light tackle and they jump out of the water like a Tarpon. Many of them will jump right off your line. I recall thinking that my luck just mught be about to change. Right after that, my husband hooked onto a respectable size Snook. It was of legal size but they're off season so it was released. That spot cooled off and we pressed on.
And on
And on.
The rest of the night was spent chasing fish.
But I still got to see that magnificent sunset :) SH
BTW, I have chosen not to delete anything for any reason at least for today. I am PMing Matt to ask for his aid in overseeing this board as there seems to be some SERIOUS allegations floating around. As to the issue of whether posters on the other board have lost their "respect" for me, I really couldn't care less. I have plenty of self respect so I don't have the need for validation from people I don't even know. Cheers, SH

Carolyn, I'm semi-well. I posted all about me and came back and saw you here. I went fishing tonight. Didn't catch nuthin'. There's a tropical storm out in the Gulf and it's got everything all kicked up. We had BEAUTIFUL jumbo shrimp for bait but to no avail. It doesn't bother me too much though because it's so nice to be out on the bay that you get over the fact that you're not catching anything just by being there. SH
I guess it was rude of me to disappear for a week and show up at this hour and butt in on the conversation.
Just to fill you in, right after I got busted for smoking in my son's room, I came down with a terrible chest cold. I guess you can call that Kharma. I'm still not totally recovered but I think I'm on the road to wellness. The irony is that my son is on the road back to school in Ohio, via New Orleans, Texas and Kentucky, and I've got the room back and my cold is keeping me from smoking. Ain't that a kick in the pants? The struggling college student is having a ball. Kharma can be a terrible thing. Guess I'd better start volunteering for a noble cause again.
We closed on another rental property last week and it only took four days to get it occupied. We got burned pretty badly last year on the market so we thought that real estate was the way to go for now. Hope we did the right thing.
Well, I'm assuming this joint is closing up for the night so "I'll just have one more for my baby and me". Hey, can someone put that tune on the juke box? SH

Prem, I'm wicha on the blackberries. They are, without a doubt, the best. We used to pick them on my Grandfather's farm in Kentucky. I was just laughing about it with my sister tonight on the phone. We'd go out with out little metal buckets for what seemed like days (in reality it was probably more like an hour) and we'd come back with about 1/4 of the bucket filled. Most of the berries we picked were safely stashed in our bellies. My Grandmother made THE BEST Blackberry jams and cobblers you'd ever eat. I saw a good way to freeze berries on Martha Stuart. You place them on a cookie tray and freeze them. Then, once they're frozen, you can take them off the tray and put them in freezer bags. That method keeps them from mushing together. Pretty cool, huh? SH

The spike in the market last year caused alot of folks to lose a lot of money. I had another stock that I bought for $12.00 go up to $65.00 and like an idiot, I sat on it and it is now trading @$18.00. Spank me for my greed!
I'm in a bad mood today. We've got five dozen beautiful, jumbo shrimp and the wind is whipping @ 15 MPH. I place the blame firmly on Barry that I can't go fishing. Maybe I'll go find a bridge somewhere. (Not gonna jump, thought the fishing might be better under the bridge than out on the open water) Or maybe we'll just have some nice Scampi for dinner :) SH
