What i find most interesting is that the (company we are NOT talking about) and its management appear to following Doc De Costa's theory and guidelines to the letter.....We have discussed this very same thing on this board for years...how large is our NS with MDMN...and just how high would our PPS climb if they were caught in the perfect situation...the perfect storm.... as in the case of FF and if a div were paid out to all shareholders what kind of impact would it have on our pps....
I would think that Jim is monitoring the current situation with great expectations with a knot in the pit of his stomach...anticipation and fear...anticipation that his strategic plan will work and play out according to his theories...and fear..... that if this play really does hit...it will be a home run with far reaching consequences...which could quite possibly make Wall Street history...and if it does go off like some hope...I would not want to be a naked short on the MDMN front...

None of the online brokers are filling any orders. E Trade is bidding for stock at 15. This is criminal and there is nothing anyone can do about it.

If its not ready to go to a theater or film festival then its not ready. I know a little bit about the movie business. After the edit, a theatrical film has about 2 months of music and sound work (if not more) unless you want it to go straight to video. I saw the trailer and think its worthy of a theatrical release. It all depends on how they want to market it.

I think you may be missing the big picture. What are they going to use to fund the film if not new investors--thin air? The way I read it is that the IPEI shareholder gets a position in the company, which spreads our risk over all the films. My guess is the shares that Deli sold have the same status as the rest. If they are register with the TA there should be no problem, imo.
The people who purchased shares from Deli did so in good faith, even though Deli was not a register broker and in violation of the regulations. The SEC may view them as victims of Deli, again imo.
SEC must be right and it would prove Deli was brokering cmkx
No doubt. Deli left a huge trail of selling unregister shares, and the possibility of the DOJ following through after the SEC is done is certainly there.

In his Opposition Brief, Glisson attempts to justify decision of him and his wife to cavalierly ignore their discovery obligations for over a month, by referencing Tungwongsathong’s purported medical condition. Additionally, he makes the wholly erroneous assertion that the Commission agreed to their 30 day sojourn from discovery. However, as the Commission has exhaustively detailed, the medical excuses offered by Glisson and Tungwongsathong are entirely devoid of candor. (See Docket Entry Nos. 41-1, 41-2-41-13,) Indeed, within a week of Tungwongsathong’s December 8, 2010 medical procedure, she by her own January 10, 2011 deposition admission was back at work. And yet, an additional three weeks pasts before she (or even more inexplicably, before Glisson) appeared for deposition testimony or made any attempt to produce entire categories of documents, such as emails. Finally, in attempting to mitigate its damages by agreeing to the January 10 and 11, 2011 depositions in addition to moving to compel deposition testimony the Commission in no endorsed Glisson’s delays, as his disingenuously suggests in his Opposition Brief.

PLAINTIFF’S REPLY BRIEF IN SUPPORT OF ITS EMERGENCY MOTION TO EXTEND OR CLARIFY THE DISCOVERY CUT-OFF DATE
INTRODUCTION
In opposing the Commission’s January 24, 2011 Motion to Extend or Clarify the Discovery Cut-Off (“Discovery Cut-Off Motion”), which seeks a limited extension (or clarification) of the discovery cut-off to allow the Commission to receive bank records it subpoenaed on January 24, 2011, Defendant Marco Glisson (“Glisson”) makes of number of factually, procedurally and legally deficient arguments, which collectively fail to refute the Commission’s prior showing that good cause ? namely, the delay caused by the refusal of Glisson, as well as his wife Thidarat Tungwongsathong (“Tungwongsathong”), to satisfactorily discharge their discovery obligations ? exists for a limited extension or clarification of the discovery cut-off.
In his Opposition Brief, Glisson brazenly attempts to capitalize upon his and Tungwongsathong’s well documented failures to discharge their discovery obligations in a timely manner. First, Glisson erroneously contends that the Commission agreed to their thirty day delay in providing deposition testimony and responsive documents. It did not. Ignoring the poor track record that he and Tungwongsathong accrued with respect to responding to the Commission’s discovery requests, Glisson then makes the self-serving argument that, had only the Commission served him with interrogatories, he would have provided the pertinent bank information in a timely fashion.
Next, seemingly oblivious to the relevance standard set forth in Rule 26(b)(1), Glisson makes the patently deficient argument that the bank records sought by the Commission are irrelevant to the underlying litigation. In doing so, Glisson ignores the reality that such records, which will show the frequency of Glisson’s transactions, as well as the amounts of money he received in connection with such transactions, is plainly relevant to the Commission’s claims under the securities laws, as well as its requests for disgorgement and injunctive relief.
Finally, Glisson attempts to invalidate the subpoenas by arguing that technical deficiencies regarding the manner in which he received notice constitutes a basis upon which to quash the subpoenas. However, Glisson has not moved to quash any of the subpoenas, and his own declarations of invalidity are ineffectual. Most importantly, the facts show that Glisson received ample and adequate notice of the subpoenas, and suffered no prejudice whatsoever from any defects in service. This fact is fatal to Glisson’s notice argument, as courts routinely deny efforts to quash a subpoena on the basis of notice deficiencies that result in no prejudice.

All day yesterday the alias cmkm_2011 posted dozens of messages claiming to have 100% confirmation there is no arrest warrant for Urban. cmkm_2011 did not give a source where this information came from, no names or numbers to call etc., to confirm this info. Not only is this individual lying about the arrest warrant, it also spent the day with dozens of posts trying to promote the false impression the DOJ's case is in jeopardy because of the delay.
The continuance of the trial was granted for the benefit of the defendants, not the DOJ.

Perjury is illegal! Even in a civil case. Nobody, not even the President of the U.S. is exempt from committing perjury. Clinton was impeached for perjury.

Hughes never paid Maheu a dime as a result of the lawsuit. The wikipedia site you posted also omitted that Summa was awarded a counterclaim judgement from Maheu for a "much larger amount".
Maheu thought he could pull one over on Hughes because Hughes was a recluse, but Hughes fought back with an appeal and the judgement Maheu won was overturned. Also notice the appeal makes a note of Maheu claiming statements by Hughes that only Hughes and Maheu would be privy to, suggesting that Maheu's evidence is only hearsay. Leaving open the possibility that Maheu could have made the whole conversation up.

Quashes 'extremely troubling' subpoenas

A judge in Georgia has scolded a controversial security figure for improperly subpoenaing Yahoo! and Twitter in an attempt to get user names and passwords belonging to some 25 researchers.
Gregory D. Evans, CEO of Ligatt Security and the self-proclaimed "World's No. 1 Hacker", sought the the highly personal information in a lawsuit he brought last year accusing the researchers of bashing his company's penny stock. Over the past year, shares have fallen from about $2.80 to $0.0004, public information shows. Most of that precipitous drop happened prior to claims that surfaced in June that huge chunks of an e-book purportedly written by Evans were lifted from other hacking manuals without the original authors' permission.
The suit named Chris John Riley, Ben Rothke, and other security professionals who publicly claimed their works were plagiarized. Shortly after it was filed, attorneys for Evans subpoenaed Yahoo! and Twitter for information that included the defendants' usernames, passwords, emails sent and received, and blog postings. Last week, the judge hearing the case squashed the subpoenas and said they violated several provisions of Georgia law.
“The court finds it extremely troubling that plaintiffs issued and served subpoenas to which plaintiffs' counsel had no access for such a long period of time,” Karen E. Beyers, superior court judge for Georgia's Gwinnett County wrote. Under the Official Code of Georgia Annotated, she said, Randolph Morris and the 24 other people named in the suit were entitled to copies.
She also uncovered other legal deficiencies, including their inclusion of the wrong case number and failure to notify plaintiffs that two subpoenas had been filed rather than just one. What's more, Beyers said the subpoenas were “overbroad” because they sought passwords and emails.
“This is exceedingly overbroad, and is also wholly inconsistent with the representations of plaintiffs' counsel regarding the scope of the subpoenas,” she wrote.
Beyers went on to dismiss Morris from the lawsuit because she found the California resident had no ties to Georgia. She scheduled a hearing for March 1 to decide how much Evans should pay in sanctions for the improper subpoenas.
Shortly after filing his lawsuit in July, Evans cast himself as the aggrieved party.
“We are sure that once this total investigation is over we will find that not only were these people bashers, but they were also day traders and market makers,” Evans was quoted in a press release. “We are prepared to go after them due to the fact that they took part in manipulating the stock,” says Evans.
Evans has regularly appeared as a security expert on Fox News, Bloomberg TV, and CNN.
