I've merely said that in the interpleader there'll probably be parties other than the shareholders making claims on CMKX's assets. BUT since the judge will have some flexibility in his ruling, it's at least possible that the shareholders will get a better deal than they would have in a BK proceeding.
One thing is certain: it'll take a long time.
As a side note, I have had several email conversations with Frizzel and have shared my opinions with him. Has he ever taken anything you have said to heart? I doubt it.
I doubt it too. His mistake. That's one of the reasons he was a poor choice as the shareholders' attorney. He came to this mess with preconceived notions, and was uninterested in examining all sides of the question.
If any subpoenae are issued, they'll be issued by the attorneys for the respective parties to the interpleader and signed by the judge. Or more likely, by the clerk of the court in the judge's name.
The judge won't be deciding who gets a subpoena and who doesn't, anymore than he'll be deciding what witnesses to call.
Then why don't you make a list of those "facts" and submit them to the Federal Court or the SEC?

The interpleader action won't address the issue of whether or not the company was a scam. I will only deal with the equitable distribution of the company's assets.

Filing BK would be worse for the shareholders. They'd be the last in line for any kind of distribution: the company's creditors would come before them.

Yes, and the judge will order subpoenaes for the records of all shareholders from all brokerages. He will order them to produce the Certificates for each and every one. When they can't do it, Federal Prosecutors will get involved.
You don't know much about the law, do you? Technically, the interpleader proposed by the Task Force won't be an adversary proceeding. It'll be more like an arbitration. The various parties--we don't yet know how many there'll be--will present their claims, and eventually the judge will decide who gets what.

Just after the 15 May "deadline", Frizzy said the Task Force would be meeting with the TA to go over the shareholder lists, and then they'd distribute the Entourage stock. We never heard any more about that. Did the meetings with the TA take place?
It would seem that at that time the Task Force intended to proceed with the distribution. Why didn't that happen?

That scarcely means that the SEC confirms the Energomash connection. On the contrary, it sounds as if they're suspicious.
I've had many contacts with SEC people, and believe me, they don't tell you anything. The only way you'll have any idea what they're thinking is if they ask you questions. Which is why it's so regrettable that JP didn't write down the names he was asked about.
