The TOY vs SOLM lawsuit will more-likely-than-not prevent other companies form knowingly and willingly infringing upon their territory of patents. Even trying to re-invent their wheel could be costly.
This makes dealing with SOLM the best course of action to be taken if a manufacturer is interested in using such technology. It won't stop contracts from being entered into. Question: Where is TOY's patents in the arena? Who's the "safest company" of the two to do business with, regarding said technology??

I find it interesting that TOY has not filed for a re-examination, nor has it filed a counter-suit.
I hear your pitch on the choices an infringer has to take inorder to resolve such litigation favorably, but... Personally, I think you're basing your arguement on odds, numbers and percentages rather than a case by case basis.
TOY does not appear to be getting very aggressive with this litigation, "yet". Maybe it's because of the stage that the due process is currently in. Maybe it's NOT. Only time will tell.
But this looks like a pretty solid infringement to most people, and SOLM has a whole array of patents under the same umbrella of gear technology.
Every case does not follow the same course of events.

You have no idea how fast any clock is ticking for SOLM, or if there is even a clock/timeline on their behalf at all. You also have no clue as to whether or not SOLM is creating shares "everyday" inorder to pay accrued interest. Likewise, you don't know what SOLM is, or is not, paying for in cash.
You know as much as we do, and a majority of that is simply: Level-headed estimation. There are far too many variables going on behind the curtain for you to make those kind of inside statements.
Nice try at your objective of spooking shareholders though.

Ben, what's interesting is that SOLM's array of patents pretty much cover the entire drive train. They never cease to amaze me, but what else could they possibly invent for the electric vehicle?

Key point to note with regard to SOLM's technical analysis....
The recent move from 09 January 2009 is showing up on the one year chart. When it appears on the two year chart with any significance, that will be the first time SOLM has showed a decent bump up in price since April 2008.

Check out SOLM's the 6-month chart showing On Balance Volume (OBV). It is the pattern for a reversal from a bottom. There is no question about it, money is coming into this stock.
