It's my understanding that between the 2008 agreement, Daic's list of fraudulent claims, and now the 15 NOV 10 filing by Daic dropping his claim to the patents, the assignment remains with CLYW.

Folks, the stock price continues to be controlled by day traders. Look at the volumes. Sell 400 shares. Buy 2800 shares. Sell 4400 shares. Buy 990 shares. We're talking pennies. 97% of the stock has not changed hands. I don't see this changing until we learn about a TM agreement. Daic's career has been one of piracy; he has no intention of going to trial so I suspect that issue will remain unresolved for a long time. He is trying to bankrupt CLYW so he can steal the patents. It's up to the BOD and to real investors now. Nonetheless, I remain optimistic.

As has been posted here, the judge is suspected as being prejudiced in favor of Daic. As I remember, again on this board, in September Daic told the court he was looking for resolution before the end of the year. This latest event suggests he has no interest in settling, but rather, still intends to gut CLYW. As I stated weeks ago, he seems to be a bum interested only in himself. His career is one of apparently cheating dozens of corporations out of their assets. He operates internationally and has built a complex knot -- a spider web of interlocking and shell corporations.

To date, no one has ever been able to make him pay for his actions. It seems that to Daic, CLYW is just one small part of his career of destruction. It's up to the BOD and investors now to resolve the case with him. If the PPS drops significantly I will double or triple my holding and thus get a seat on the BOD. That will be a trip.
If CLYW has information suggesting that the original judge is corrupt or prejudiced against it, why is the BOD not fighting this denial of transfer harder?

It's Thanksgiving Vacation Week. Many are away.
IOW, he is alleging that CLYW is in default after he has spent the past four years interfering with the company's ability to do business or raise money? He expects the court to find for him? That's his defense? That's like asking the court to forgive his being tardy after he wrecked his car on the way to trial by running-over the plaintiff.
I continue to be surprised by how little stock actually trades. About two-three percent a week with pps remaining up 400% since September. This suggests that large holders remain optimistic about CLYW, as do I.
There was a post regarding CLYW and the alleged involvement of DE Wine Securities. Why was it was deleted?
Whatever the BOD's actions and good intentions in this, their lack of communication to the stockholders is disappointing. In other such companies trying to get going (Gridline Communications, Biofuels Corp.) the investors are kept constantly informed at least every quarter.

Fair point. In a civil trial, the jury does not have to be unanimous (11 out of 13 in Massachusetts) and it decides upon "the preponderance of evidence," not 'beyond a reasonable doubt.' Also, juries generally punish people like Daic -- those who are bald-faced crooks who have stolen money from the public. YMMV.
From what I've read, the BOD acted unlawfully in 2008 and 2009. Stock holders were never allowed to vote for the BOD or make any business decisions. The phantom Richard Pattin came along and then left after apparently giving Daic an inside deal of $100M plus. One of the reasons we are all tangled-up now is because the stock holders (i.e. owners) never made a fuss. This is very strange since there are almost 200 million shares outstanding. Who owns them? What do these big owners want? In the past 45 days all the stock action has involved perhaps 1/2 of one percent of the stock per day. Clearly, the big owners are holding tight and saying nothing in public. Again, very strange, although it suggests they know that $$ is coming and don't want to drive the price up before they buy more. Perhaps they are part of another secret deal to try and rape the company again. Who knows? CLYW since 2006 is best described as a college fraternity that got drunk, ran amuck, set fire to neighbors' trash cans, urinated on the bushes, and now wants everyone to forget about the damage they did. The new BOD is so opaque that any decisions they make are invisible to the stock holders. That is NOT the way to run a public company responsibly. Of course, until the stock holders start demanding to be included in the loop, this is unlikely to change. We on this message board have too small a stake to make the BOD tell us anything. If the price drops enough I will immediately double my amount of shares.

You have to stop over-analyzing every twitch. This week someone sold 428 sharees. That's about $44. Do you really want to be that sensitive to meaningless day trading?
Anyone who expects Daic to actually go to trial soon is due to be disappointed. Daic gives every appearance of being a career opportunist unemcumbered by a sense of fairness. He has a network of interests that is tough to follow. He will twist and turn and do everything to avoid actually going to trial. His record with CLYW is, in the opinion of many, a clear case of criminal activity aimed at getting rich quick and the stock holders be damned. If you are investing in CLYW because you think Daic will be disposed of soon you are likely to be disappointed. However, I believe the TM deal will pan out and go around Daic. I expect some deal to be announced by the beginning of 2011. YMMV.

DD et al did not win. We will win. But winning will be like giving him a root canal by having to go up through his rectum.
Based upon the events of the last several years, it is clear to me that Daic will never allow himself to be brought to trial. The bums who started Boston D-Tox, then took investors' money and started another company, defrauding the investors, have yet to be brought to justice. Criminals like Daic make a career of destroying companies from which they intend to profit. Resolution of his aborted theft of CLYW will most likely come from a summary judgment against him as he flees the U.S. However, this need not hamper a TM-CLYW agreement if TM is clear-sighted enough to see that they will have to pay for their infringement sooner or later, and that doing something now beats perhaps a potentially ruinous judgment against them at some point down the road. TM has never claimed that they own the patents they have been using. I expect some news on TM by the end of the year. As for Daic, take a deep breath and wish him ill.
