United States v. Garcia
, 340 F.3d 1013, 1015 (9th Cir. 2003). horribly weak. This is one of the softest government replies I have read. It completely ignores factual questions regarding Federal Law re: mail and wire fraud. There is ample evidence raised in the defendants motion regarding both ineffective counsel and the lower courts misinterpretation of the law. There is no possible way that the buyers of these thumb drives were defrauded out of 400+k. In fact they all saved money! Ultracade and its new owner are not eligible under Federal Law to be the victims of Foleys crime so they have no damages.....
I'd be shocked if he did not get bail on appeal given the egregious errors committed not only by the previous representation, but also by the lower courts failure to interpret the law.
well how about a research into the Calif. tax system to see how much is coming in and out of 4k studios? something tells me that if you have tried for months it hasn't been a very sincere effort.
c'mon people, it's black and white...
I'm amazed some of you actually think ntek wants a higher share price right at this time. Why would they want that vs having a controlled lower price.... do the math folks..... now, "after audited fins" that concept will totally change....
27,500 added at 0.06 had order sitting @ 0.059 unfilled for hours...

you cannot be more incorrect
products there are assembled they are being packaged to ship.
that goes under 90% of all their articles...every one which they pick up from OTHER news sources which are not written by their paid staff.
really and exactly WHY would he want to dump 500k at these prices? Ever actually think about what is posted?
Just added another 20k @ 0.063
Friends, only one thing matters.... AUDITED FINS. NOTHING else has as much meaning as they do
prove it
added 24.5k more yesterday @.0705 now at 352k total.... would never consider selling sub .50 ever! I'd be in total shock if this company failed to broach the .75/$1 mark within 12 months....
You realize a set of positive audited fins will be the drive for pps in 2014. All it takes is (1) just one institution to get involved to make this bird fly from the nest and none will touch it w/o audited fins.

such a scam!!!! Where can I buy more scams like this?
lol ya sure when my android or iphone needs an os update I mail it to the factory..... please keep it real.....do you know ntek has a facility in freemont?
So please allow me to understand the following, We go to the NAB show and our equipment is used by 3 prominent publicly traded companies, we just sign a new deal to provide 100s of android games, we announce a May stockholders meeting and we take steps to upgrade and perfect our product before it hits big box stores and YET, we are a stinky pinky scam share selling enterprise created solely to profit the Foley Clan...... lol ummmm ya rightttttt!
buy buy buy
REALLY? Couldn't possibly have been this. NAB Show, NP-1 works with Ericsson and Akamai signs new deal offering over 200 android games and takes suggestions from some of the most brilliant minds in the industry to launch a better version of the product. No, no, could not possibly have been as simple as that. Ever hear of Occam's Razor?
nothing is being sent back to factory in china. the units in hand will be modified in California and shipped when google oks 4.4 use. all future models/shipments will be done in china.....
people here really are amusing. No longs are selling off here. Only people doing business here are the mm's wiggling around before the 4/14/2014 bell tolls..
why does every Walton?
I hope you fine people realize the fun is just beginning. Once NTEK has audited fins and starts being followed by the ini's, it's katy bar the door. As long as they stay true to plan, everyone who has stayed true to ntek is going to do quite nicely.
Please allow the MM's to have their fun for the next few days, scraping off their last remaining manipulations, but as April 14 looms, so does the pps rising like the tail end of the Titanic before the grand lady sank....
NTEK LONG>>>>>>N STRONG!!!!
streaming 4k is so easy...unbelievably easy...however streaming 4k at mbs that are available to the masses is the trick! at 10mbs you can get really great 4k streaming. when the online upgrade to the np-1 takes place bringing 4k high quality streaming to mbs under 5, well that's when the magic happens!
PS-
Sunday, April 6 from 5:10 to 5:50 p.m. @NAB2014 – Will Law, Akamai's chief architect for media engineering will participate as a panelist in "Next Gen Living Room: Finding and Viewing Your Content on the Big Screen" during 2nd Screen Sunday at NAB. Studio Profit Report: Who's Up and Who's Down
5:05 AM PST 2/21/2014 by Georg Szalai, Paul Bond
The six major film studios combined to generate more than $4.3 billion in operating profit in 2013, up 23 percent from $3.5 billion in 2012, as digital streaming offset declining DVD sales and franchise films remained strong. But the riches were not spread equally.
Is Hollywood's biggest money-maker:
a) Movies?
b) DVDs?
c) Television?
The best-kept secret in Hollywood, especially from Wall Street, is that the movie studios' biggest profit center is not theatrical movies, or even DVD sales; it is TV licensing.
The reason a majority of movie studios still turn a profit most years is that they have found ways to, as they say, monetize the ancillary stream by selling pay-TV and overseas rights, creating tie-in video games, amusement-park rides and so forth. And the big hits, rare as they may be, pay for a lot of flops. Still, the profits are not huge. Matthew Lieberman, a director at Pricewaterhouse Coopers, expects growth over the coming years to be somewhere around 0.6 percent.

I'd say NTEK is positioned perfectly!!!!!!
you clearly do not understand studios and their finances, nor the unions that RUN THEM!!!!! outsourcing a feature film to be remastered from 35mm to 4k for 29-40k as NTEK is DOING IS an absolute bargain AND it's tax deductible!!!! studios, most, lose money or walk very narrow margins.
that is really not accurate. people operate under the assumption that movie studios have billions of dollars and can do anything they desire....ummmm NO! In fact with declining dvd sales worldwide most studios are walking a financial tightrope or are in fact in a constant state of red ink. Why is this important? because an affordable way to garner more customers is 4k conversion/licensing agreements and streaming. Studios rarely if ever handled these types of matters in house.
So witnit, let me get this straight. the people who start the company, the inventors, the blood sweat and tears of the r and d, the tireless workers, the dreamers....they shouldn't be able to profit from the fruits of their labor? What exact world does that work in?
NTEK SOLID AS A ROCK!
speaking of 4k, how about the 7d show in dubai.
really, and exactly Who will be buying his 40,000,000 shares with no product in hand, available in stores etc.? Who will flock for those shares. PREPOSTEROUS!

I have on strong authority that NTEK is NOT for sale.
NTEK was very clear that no card would be charged until the order is 'READY" to be shipped. 7-10 business days puts 1st shipments due to leave either next monday or tuesday. relax!
Last post of the day.... if the highly decorated lead architect of Akamai says " The Nuvola player’s ability to stream 4K content complements the Akamai Intelligent Network’s ability to deliver content at this ultra-high quality level,” said Will Law, principal architect, media engineering, Akamai. "In providing an end-point for streaming delivery, it offers a more flexible alternative to store-and-forward download solutions while the Android operating system simplifies player development and the small form factor facilitates deployment. We expect the Nuvola to accelerate residential 4K adoption.”
plenty good enough for me.
I am an NTEK supporter and shareholder of 345k shares average cps mid 8s.
I am however extremely disappointed in one area here.
Not a single photo, press release or any mention of the expo in Korea with Skymedia who had the 4th largest booth next to sony, lg and samsung.
this really irritates me.
7-10 business days, which means next monday until next thursday..
There really are only two compelling questions left to answer.
1) will the streaming work at reasonable bit rates and
2) who will be first in line to buy a major stake in ntek.
fwiw, I have on good authority there is a NOT FOR SALE sign on the door.
the np-1 can be fully upgraded via the internet, however there is already an np-2 prototype that is a direct plugin.
very easy, saves the company 100s of thousands of $s in yearly costs. Was very smart move at the time.
Legally speaking nothing in this post regarding former ntek'er david foley is accurate. I would suggest that before trying to make legal assumptions that you actually understood the law. Do you have a JD? Are you a member of the Bar?
