JL - I hear you on EU. We're good there. But, I don't see how to stop the generics in the US. The whole system is rigged in their favor. (PS. I'm terrified for America, she may be done if certain events unfold).
JL - Great to hear from you as always. Yes, we have RIt but, how do we stop generics from stealing it. That is the question.
Good points Slim. To me, the biggest risk in staying with this investment (AMRN) is Thero himself. Is he a man of honor, truth, integrity and intelligence? I don’t know.
His EU GIA plans are absolute lunacy to me and don’t correlate with his talk of shareholder value.
Selling the company is the only solution IMHO. The more time Thero wastes with his idiotic GIA plan, the lower any BO might be.
Interesting thought
When the inevitable generic infringement on RIt happens, what can we do? Who is liable for it?
Marjac - not nitpicking, just want to make sure I’m not confused (if possible). It was Kura that was cropped?
Kiwi - not sure if this solves the generic problem? I mean it’s still icosapent ethyl.
Kiwi - no reasons, just curious. Like many others I’m just looking for ways to recoup lossed
Kiwi - you still in RLFTF?
Irish - received. Thank you so much
Irish - Don't see anything in my email
Irish - just PM’d you
Singer did hit on the fact that AMRN experts were aware of Mori yet still skeptical of Marine. Course, the generic slime lawyer slung some BS to refute it. Judges bought the BS
Sts - you’ve got company here. I’m sure others as well
No, that was Marzan Monday
Irish - Thanks!
CBB - Thank you. I sure hope your source is the more credible. I would be ecstatic with double digits!
CBB - you really think we could fetch that much? Seriously, I'd settle for 7 now. In any case, Thero doesn't have it in him to get it done. He's gotta go.
Thanks!!
Mo - is there an email address for Thero specifically? Or you just sending to IR?
TIA
Tuchman - Thx for posting and don’t blame you one bit. I would do the same. I’m trying to emotionally divorce myself from the AMRN shitshow. Very difficult after so many years. But to witness Thero complete the destruction of the company is more painful
John - Excellent synopses! I only differ in that CAFC judges aren’t clean in this. They did not read the briefs IMHO and they are biased politically if you get my drift. Also, Du doesn’t get a pass. Biased as well and not smart to understand the science (though that’s where good lawyering comes in).
What next appeal? To who?
ILT - I see two major problems; 1) there would be no market for branded V as generic will be used always, 2) AMRN can’t compete with generics. Not talking price here, rather stocking shelves in pharmacies. AMRN is a pretty small fish (no pun intended)
Freit - tend to agree. I don’t give any credence to Thero’s talk of supply
Hopefully 7. Thero is probably not going anywhere. I doubt the BOD gives a krap. With Thero, 7 may be a stretch.
So, now that the US is toast what could EU/ROW be worth. Do you folks think it could at least get us to 6 or 7 pps? Or, is that a pipe dream?
If Thero is serious about GIA in EU I would not be surprised to see this venture back to a buck a share in the near future. It will take time to generate EU revenue (IMHO).
Our best scenario is Thero gets canned tomorrow and someone new comes in to get a deal done (again IMHO)
Not me!!
So I'm not a conspiracy type. But has anyone else thought that the fix must have been in since the get go?
First, the NV decision which was flawed on every front. Factually, scientifically, and legally. Not really an ounce of truth in Du's ruling.
Then, the appeal. Singer laid out all the flaws in the NV decision. Appeal judges obviously did not even read the briefs. They asked essentially no questions at the OA's. Then ruled immediately.
Call me nuts, but seems not a stretch to think the fix was in long ago. If not, how could the system be so inept?
Ok Miller - take your victory lap. But, know this also. The entire decision starting in NV was based on lies and falsehoods. If you read up on the case and "prior art" you would know that. You call it confirmation bias. As for me, the truth works best.
Yep, patent litigation is now the Wild West
From PR:
"Amarin anticipates that generics companies, when they launch in the United States, are likely to have limited supply capacity for VASCEPA. Based on this assumption and given the need for greater awareness of VASCEPA by healthcare professionals and at-risk patients, Amarin intends to continue current promotion levels of VASCEPA in the United States. After assessing the scope, timing and pricing of potential generic competition, Amarin will decide whether to further expand, contract or maintain such levels of VASCEPA promotion."
Big mistake. Shit can the DTC and shit can the sales force. JT is gonna bleed this company dry. Watch and see. Also, gear up for another dilution (big one at these prices)
Dead on. People are always raving about JT getting us through R-It. All he did was kept us afloat financially. Not exactly rocket science.
Do not hold your breath. JT is not done until the company is worthless.
You can drop the almost
My God, lay off the drugs! It is over.
They'll be lucky to get 10.
BaaBaa - well said. My feeling is the panel had not even studied the case. Certainly Dyk had not read a thing.
If I’ve learned anything from this nightmare it’s that these decisions are such squishy, subjective bullshit that Du will easily find a way to rule against AMRN. Her agenda demands it.
CBB - I totally agree. Thero, however, has already said they will GIA.
Can I buy a vowel?
