Patrick Byrne (Dominion): Dominion sued former Overstock CEO Byrne in August 2021, alleging the businessman “manufactured and promoted fake evidence to convince the world that the 2020 election had been stolen” using Dominion voting machines, and U.S. District Judge Carl Nichols denied Byrne’s motion to dismiss the case in April 2022, ruling “a reasonable jury could find Byrne acted with actual malice” in spreading provably false assertions about Dominion.
WHAT TO WATCH FOR
It’s likely to be a while before the other pending cases go to trial. Dominion’s cases against Powell, Giuliani and Lindell won’t go to trial until at least mid-2024, as a scheduling order set a February 2024 hearing to discuss potential trial dates, and other cases against Byrne and OANN similarly appear to stretch into next year based on their current schedules.

“Dominion’s litigation exposed some of the misconduct and damage caused by Fox’s disinformation campaign,” Smartmatic attorney Erik Connolly said in a statement Tuesday following the Fox and Dominion’s settlement. “Smartmatic will expose the rest.”

$1.6 billion. That’s approximately how much Dominion is asking for in damages against OANN, Byrne and Newsmax—the same amount it asked for against Fox News, which ultimately ended up being far lower when the case was settled. Its lawsuits against Powell, Giuliani and Lindell are each seeking $1.3 billion in damages. Smartmatic’s Fox News lawsuit is seeking $2.7 billion in damages, but its OANN, Newsmax and Lindell complaints do not specify exact figures.
CHIEF CRITICS
Fox News said in a statement following its Dominion settlement that it “acknowledge[s] the Court’s rulings finding certain claims about Dominion to be false,” and said the settlement reflects “Fox’s continued commitment to the highest journalistic standards.” The network had previously denied the defamation claims against it, arguing statements made on-air about Dominion were reporting on newsworthy events protected under the First Amendment. The other parties who have been sued have largely remained defiant, and Lindell has continued to push false claims of election fraud despite the multiple defamation suits against him. Giuliani has called the lawsuit against him “another act of intimidation by the hate-filled left-wing,” and Newsmax called Dominion’s lawsuit “a clear attempt to squelch such reporting and undermine a free press.”
KEY BACKGROUND
The companies’ voting machines are at the heart of a right-wing conspiracy theory alleging they were used to fraudulently flip votes from Trump to Joe Biden, which is not substantiated by evidence. Dominion says that the claims have substantially hurt its business and put its employees in danger. The voting company controls about 30% of the U.S. market, according to data cited by ProPublica in 2019—making it the second-largest business of its kind in the country—and said in its Fox News lawsuit that it has contracts with 28 states. Business analytics firm Dun & Bradstreet estimated the company’s 2021 annual revenue will be $40.15 million, though the company alleges it has lost out on state contracts over the fraud claims, including a $10 million contract in Stark County, Ohio, and a $100 million contract in Louisiana. London-based Smartmatic’s machines were only used in Los Angeles County in the 2020 election, though CEO told Antonio Mugica told Forbes the company has ambitions to expand further in the U.S. The company alleged in its complaints the fraud claims have caused Smartmatic to lose more than $2 billion in valuation since the 2020 election, going from more than $3 billion to less than $1 billion, though Forbes has independently valued Smartmatic at an estimated $730 million.

A man has been arrested after two Texas cheerleaders were shot, one critically, after one of them mistakenly got into the wrong car, according to police and the owner of the gym where they trained.
Officers in Elgin, about 25 miles northeast of Austin, responded to reports of shots fired outside an H-E-B supermarket around 12:15 a.m. local time (1:15 a.m. ET) Tuesday, the Elgin Police Department said in a news release.
"Information suggests that an altercation occurred in the parking lot of H-E-B, and multiple shots were fired into a vehicle," police said. Two of the car's occupants were struck by gunfire, with one victim sustaining serious injuries and transported by helicopter to a hospital, where they were listed in critical condition, police said.
The suspect, Pedro Tello Rodriguez Jr., 25, has been charged with deadly conduct, a third-degree felony, police said.
Lynn Shearer, owner of Woodlands Elite Cheer Co., told NBC affiliate KXAN of Austin that the two people shot were cheerleaders who were on their way home from practice.
Shearer said the cheerleaders typically carpooled from the Austin area to her gym. On Monday night, she said at least four cheerleaders were on their way back to the Austin area and had to stop at an H-E-B, where some of the members had parked their cars.
One of the girls accidentally tried to get into the wrong car, Shearer said. That's when, she said, a "guy got out and they saw that he had a gun. And so they tried to speed off and he shot his gun, like five times or so into the car." Woodlands Elite did not immediately respond to an overnight request for comment. The Elgin Police Department also did not immediately respond to an overnight request from NBC News seeking to confirm these details.
According to ABC News, Heather Roth, a cheerleader with the Woodlands Elite, said in an Instagram Live post that she was the one who got out of her friend's car and opened the door of another vehicle she thought was her own, only to notice a man was in the passenger seat. She said she got out of the car and back into her friend's vehicle, the report said.
Roth reportedly said the man approached their vehicle and she rolled down a window to apologize. That's when the man started shooting, she said, according to ABC News. The Instagram Live post was no longer available early Wednesday, but Roth shared a number of posts that appeared to be related to the incident. She did not immediately respond to overnight request for comment.
Victim critically injured known as a 'role model'
Shearer identified the cheerleader who was critically injured in the shooting as Payton Washington, of the Round Rock Independent School District.
“She’s won every title there is to win in all-star cheerleading. She’s literally a role model for the kids in this industry throughout the country,” Shearer said. “Everybody knows her. She’s literally one of the very best that’s ever done this sport.”
Messages of support for Washington have poured in on social media in the wake of the shooting, with a prayer organized by Woodlands Elite held Tuesday. Meanwhile, a GoFundMe page organized by the Woodlands Elite Generals to help raise money to cover her hospital costs had raised more than $60,800 as of early Wednesday.
The GoFundMe page said Washington was "stable in the ICU and will have a long road to recovery."
Shearer said the cheerleaders had "grown up" in her gym. "We’ve known them for years, some of them literally, since they were, you know, 8, 10 years old,” she said. “So they’re like our family.”
The shooting, she said "was unfortunate. These girls were just trying to get home."
As Washington faces a long road to recovery, Shearer said, she and the Woodlands Elite team would be there to support her and others affected by the shooting every step of the way.
“Our goal right now is to take it one day at a time and be there for them,” Shearer said.

RICHMOND, Va. — Nearly six years after a large gathering of white nationalists in Charlottesville erupted in violent clashes with counter-protesters, a grand jury in Virginia has indicted multiple people on felony charges for carrying flaming torches with the intent to intimidate.
The Albemarle County Commonwealth's Attorney's Office said in a news release that the indictments relate to an event on Aug. 11, 2017. That's when a group of white nationalists carrying torches marched through the campus of the University of Virginia, some chanting, "Jews will not replace us."
Commonwealth's Attorney James Hingeley did not say in the release how many people have been indicted and did not immediately return a call and email seeking comment on Tuesday. According to electronic court records, the indictments against three people have been unsealed, including William Zachary Smith, of Nacona, Texas; Tyler Bradley Dykes, of Bluffton, South Carolina; and Dallas Medina, of Ravenna, Ohio.
Each is charged with a single count of burning an object with the intent of intimidating a person or group of people. The charge carries a maximum penalty of up to five years in prison.
Smith's attorney, Cody Villalon, declined to comment when reached by phone Tuesday. Dykes and Medina do not have the name of any attorneys listed in electronic court records.
The indictments, which were issued in February but only recently unsealed, come almost six years after violence broke out during two days of demonstrations by the largest gathering of white nationalists in a decade.
Clashes began on the night of Aug. 11, 2017, during the torch march, and continued the following day, when a "Unite the Right" rally was planned. James Alex Fields Jr., a white supremacist from Maumee, Ohio, rammed his car into a crowd of counter-protesters, killing one woman and injuring dozens. Fields is serving a life sentence for murder and hate crimes.

Prosecutors said the indictments were issued "as part of a criminal investigation that is active and ongoing," adding they work with law enforcement to investigate, analyze applicable laws, and bring charges "when appropriate."

Former President Donald Trump set off a firestorm of criticism when he said there were "very fine people on both sides" of the clashes between white nationalists and anti-racist demonstrators in Charlottesville.

HEBRON — A 65-year-old man has been charged with second-degree murder after he allegedly shot and killed a 20-year-old Saratoga County woman Saturday evening after the car she was in mistakenly drove up the man’s driveway.
Washington County Sheriff Jeffrey Murphy said Monday that Kaylin A. Gillis was in a car with three other people Saturday night looking for a friend’s house. The rural section of Washington County where the shooting took place is dark at night and many of the properties are only accessible by unpaved driveways.
Murphy said the group mistakenly drove up to a house on Patterson Hill Road, 19 miles northeast of Gillis' residence in Schuylerville. As they attempted to turn the car around, the sheriff said, Kevin D. Monahan came out on his porch and fired two shots, one of which hit Gillis while she was seated in the car. No one from the group had left the car or tried to enter Monahan's house before he came out and opened fire, Murphy said.
With Gillis wounded, the group drove to Cemetery Road in the neighboring town of Salem, six miles south of Monahan’s residence, at which time the shooting was reported to 911. Murphy did not say if the group was trying to get to a specific location, but said that the area has little cellular service. Emergency crews arrived and started CPR on Gillis.

Someone else had called police to report there had been shots fired at the Patterson Hill Road residence. Murphy said when officers arrived, Monahan would not emerge. Authorities spoke with him through a 911 dispatcher and in person for about an hour before he was taken into custody.
“Monahan was uncooperative with the investigation and refused to exit his residence to speak with police,” the sheriff’s office in a news release. “He was later taken into custody with the assistance of the New York State Police Special Operation Response Team after several hours.”
A law enforcement source said investigators do not believe alcohol or mental illness played a role in the shooting.
A woman who lives with Monahan was home at the time of the shooting. She did not immediately return a call on Monday.
The sheriff declined to identify the type of weapon that police believe was used in the fatal shooting. Monahan is in the Warren County jail. He will have a hearing in Washington County Court at a later date.
The sheriff said it was an administrative decision to send Monahan to the Warren County jail. Public records indicate Gillis' father is a correction officer at the Washington County jail.
One of the other people in the car was evaluated for a possible wound, but was not injured.
“She was an innocent young girl who was out with friends looking for another friend’s house,” Murphy said at the Monday news conference. “There was no reason for Mr. Monahan to feel threatened,” he said later.
A GoFundMe was created to help Gillis’ family.
“As many of you know, Kaylin Gillis was taken from us far too soon tragically and devastatingly at the age of 20,” the GoFundMe’s description says. “We have set this up to raise money for Angel and Andy’s family, to help with funeral and other expenses. Please consider donating any amount you can to assist at this time.”
The shooting comes days after a 16-year-old Kansas City boy was shot and injured after he rang the bell at the wrong house to pick up his siblings.

A new bill in the North Carolina legislature would prohibit local youth sports leagues from awarding participation trophies.
Republicans Sens. Tim Moffitt, Bobby Hanig and Eddie Settle are the primary sponsors of Senate Bill 430, which was filed Thursday.
It would ban awards for kids "based solely on their participation in the sport or other activity." Instead, awards could be provided "based on identified performance achievements."
The bill would be applicable to any youth sports or youth recreation activities that are "operated under the authority of a local government."
So local town or city leagues would be barred from awarding trophies to 6-year-olds unless they are based on "performance achievements."
Senate leader Phil Berger, a Rockingham County Republican, declined comment on the bill when asked about it by reporters Thursday. A message left at Moffitt's legislative office was not immediately returned.
Moffitt, a Republican who represents Henderson, Polk and Rutherford counties, also proposed legislation this session to allow Polk County to prohibit or restrict the use of skateboards on public streets in the county.

A teenager was shot and wounded by a homeowner after mistakenly going to the wrong home to pick up his siblings in Kansas City, Missouri, police said Sunday.
Officers responded to reports of a shooting on the evening of April 13 and arrived to find a teenager who had been shot by a homeowner outside of a residence, according to Kansas City Police.
The teen was taken to a local hospital, where he was in stable condition Sunday, police said.
Police learned that the teenager’s parents had asked him to pick up his siblings at an address on 115th Terrace, but he accidentally went to a home on 115th Street, where he was shot, according to police.
The teen was identified as 16-year-old high school junior Ralph Yarl, according to a joint statement from civil rights attorneys S. Lee Merritt and Benjamin Crump, who have been retained by the victim and his family.
“Despite the severity of his injuries and the seriousness of his condition, Ralph is alive and recovering,” the attorneys said in the statement.
The homeowner – who has not been identified – was taken into custody and placed on a 24-hour hold, then released pending further investigation due to the need to obtain a formal statement from the victim and to gather additional forensic evidence, Kansas City Police Chief Stacey Graves said in a news conference Sunday.
Under Missouri state law, a person can be held for up to 24 hours for investigation of a felony, at which time they are required to be charged or released, Graves said at the press conference.
The shooting fueled a protest in Kansas City on Sunday, with hundreds gathering outside the home where Yarl was shot, according to CNN affiliate KSHB.
Protesters marched as they chanted, “justice for Ralph” and “Black lives matter,” and carried signs reading, “Ringing a doorbell is not a crime” and “The shooter should do the time,” footage from CNN affiliate KMBC shows.
“We demand swift action from Clay County prosecutors and law enforcement to identify, arrest and prosecute to the full extent of the law the man responsible for this horrendous and unjustifiable shooting,” the statement from the victim’s attorneys read.
Asked whether the shooting may have been racially motivated, the police chief said, “the information that we have now, it does not say that that is racially motivated. That’s still an active investigation. But as a chief of police, I do recognize the racial components of this case.”

Graves sought to assure the Kansas City community Sunday that the police department is committed to bringing justice to this case.
“We recognize the frustration this can cause in the entire criminal justice process. The women and men of the Kansas City Police Department are working as expeditiously and as thoroughly as we can, to ensure the criminal justice process continues to advance as quickly as all involved and our community deserve,” Graves said.
Kansas City Mayor Quinton Lucas said there will be a thorough investigation and review by the prosecutor’s office.
“As a parent, I certainly feel for the mother of the victim and others in the family. My heart goes out to them,” the mayor added.
A GoFundMe started by Faith Spoonmore, who identified herself as Yarl’s aunt, to help the family raise money for medical expenses had garnered more than $529,000 in donations as of Sunday night.
Yarl had been looking forward to graduating high school and visiting West Africa before starting college, where he hopes to major in chemical engineering, his aunt wrote in the fundraiser.
The teen is a section leader in a marching band and could often be found with a musical instrument in hand, Spoonmore wrote. Most recently, Yarl earned Missouri All-State Band honorable mention for playing the Bass Clarinet, according to a North Kansas City Schools’ newsletter in February.
“Life looks a lot different right now. Even though he is doing well physically, he has a long road ahead mentally and emotionally. The trauma that he has to endure and survive is unimaginable,” the GoFundMe post reads.

Connecticut Man Sentenced for Felony and Misdemeanor Charges Related to Capitol Breach
Defendant Was Among Those Who Joined in Assaults on Officers at Lower West Terrace
WASHINGTON – A Connecticut man was sentenced today in the District of Columbia on felony and misdemeanor offenses for his actions during the Jan. 6, 2021, Capitol breach. His actions and the actions of others disrupted a joint session of the U.S. Congress convened to ascertain and count the electoral votes related to the presidential election.
Patrick E. McCaughey III, 25, of Ridgefield, Connecticut, was sentenced to 90 months in prison for nine offenses. He was found guilty following a bench trial, on September 13, 2022, along with co-defendants Tristan Chandler Stevens, 26, of Pensacola, Florida, and David Mehaffie, 63, of Kettering, Ohio, who are awaiting sentencing. McCaughey was convicted of seven felony charges: three counts of aiding or abetting or assaulting, resisting, or impeding law enforcement officers, including one involving a dangerous weapon; one count of obstruction of an official proceeding; one count of interfering with a law enforcement officer during a civil disorder; one count of disorderly and disruptive conduct in a restricted building or grounds with a deadly or dangerous weapon, and one count of engaging in physical violence in a restricted building or grounds with a deadly or dangerous weapon. The two misdemeanor charges include: disorderly conduct in a Capitol Building and committing an act of violence in the Capitol Building or grounds.
In addition to the prison term, U.S. District Judge Trevor N. McFadden ordered 36 months of supervised release and restitution of $2,000.
According to the government’s evidence, on Jan. 6, 2021, McCaughey, Stevens, and Mehaffie all traveled to Washington, D.C. from their respective homes. Each illegally made his way on to the restricted grounds of the U.S. Capitol. McCaughey and Stevens taunted officers at the West Front, and Mehaffie yelled at nearby rioters who were hesitating to illegally cross the outer perimeter, “if we can’t fight over this wall, we can’t win this battle!”
The three defendants ultimately broke through the police line after approximately 2:30 p.m., when the line on the West Front failed under the siege of the advancing mob. Each of the defendants scaled the Southwest scaffolding and staircase, to converge together at the tunnel created by the inaugural platform structure on the Lower West Terrace of the Capitol Building.
At the Lower West Terrace, officers of the U.S. Capitol Police and Metropolitan Police Department guarded the entrance door to the Capitol from the mob -- including McCaughey, Stevens and Mehaffie -- for several hours. Between 2:41 p.m. and 3:19 p.m., the three defendants attempted to break into the building by directing other rioters, participating in heave-hos against the police line, using riot shields stolen from the Capitol Police, and assaulting three specific officers. Mehaffie hung from an archway and shouted direction from above, and McCaughey and Stevens were key players in the melee below. McCaughey grabbed a riot shield and used it as a weapon. Even after officers finally cleared the tunnel area, the three defendants illegally remained on Capitol grounds.
McCaughey was arrested on Jan. 19, 2021, in South Salem, New York.
The case is being prosecuted by the U.S. Attorney’s Office for the District of Columbia. Valuable assistance was provided by the Department of Justice National Security Division’s Counterterrorism Section and the U.S. Attorney’s Offices for the District of Connecticut.
The case is being investigated by the FBI’s New Haven, Albany, and Washington Field Offices. Valuable assistance was provided by the U.S. Capitol Police and the Metropolitan Police Department. The FBI’s Washington Field Office identified McCaughey as #62, Stevens as #64, and Mehaffie as #86 on its seeking information photos.
In the 27 months since Jan. 6, 2021, more than 1,000 individuals have been arrested in nearly all 50 states for crimes related to the breach of the U.S. Capitol, including more than 320 individuals charged with assaulting or impeding law enforcement. The investigation remains ongoing.

One of the two fathers involved in a Florida road rage incident that left each with a wounded daughter has been charged. The father who fired the first shot was ruled to have used justifiable force and faces no charges, according to the state attorney's statement.
William Hale, 36, was deemed the primary aggressor for the Oct. 8, 2022, shootout with Frank Allison, 44, and charged with seven counts of attempted murder, aggravated assault and shooting or throwing deadly missiles, per NBC's Jacksonville affiliate First Coast News.
Hale, per the report, attempted to use his Ram truck to run Allison's Nissan Murano off the road on U.S. 1 near Callahan, Fla. and threw a water bottle at Allison’s vehicle. Unaware at the time of what had been thrown, Allison fired a single shot, hitting Hale's 5-year-old daughter in the upper calf.
Hale fired back, striking Allison's 14-year-old daughter in the back as he emptied his semi-automatic handgun into the vehicle, according to First Coast News.
Both children are expected to make a full recovery, according to the statement.
Exact details vary among the witnesses, with the Hale family saying Allison began tailgating Hale's 18-year-old son, who was driving nearby in a GMC Sierra, and attempted to run him off the road after he had changed lanes to let them pass.
The Allisons said they were one car length behind one of the Hales, who were driving side-by-side, and were repeatedly brake checked. As Allison passed, his wife "flipped off" the Hales. Hale sped up and motioned for the Allisons to pull over and continued following them, attempting to run them off the road at high speeds. Hale then threw the water bottle, which later qualified as a deadly missile and led to Allison firing his gun out of fear for his family's safety.

NASHVILLE, Tenn. (WKRN) — A self-defense claim is under investigation in Nashville after a pregnant woman was shot in a Walgreens parking lot on the city’s east side, forcing doctors to perform an emergency cesarean section and deliver her premature baby.
The shooting took place around 8 p.m. Wednesday on the city’s east side.
Police said an employee at the Walgreens location was notified by another employee that two women were stealing items from the store. The employee told police he saw the women putting items into a store cart and a large over-the-shoulder bag. He said he then began recording the women with his cellphone and followed them as they left the store without paying for the items.
He followed the women to their car, where they were putting the items in the trunk investigators said. That’s when he said one of the women pulled a can of mace and began spraying him.
The employee then pulled his semi-automatic pistol and began shooting, saying he was afraid and did not know if either of the women were armed. The women fled in their car while the employee went back into the store and called 911, according to police.
Investigators said one of the suspected shoplifters, a 34-year-old woman, was seven months pregnant and had been shot multiple times by the employee. The other woman drove her to Nashville General Hospital and drove away. An ambulance transported the woman to Vanderbilt University Medical Center.
The injured woman’s child, who was not injured by the gunfire, was delivered via an emergency C-section at Vanderbilt. Both the woman and her baby are in critical but stable condition.
The investigation remains ongoing.

NOAA issues El Niño watch: Here’s where and when we will feel the impact

(NEXSTAR) – Move aside La Niña – it’s almost time for El Niño to take over.
National Oceanic and Atmospheric Administration’s Climate Prediction Center issued an “El Niño watch” Thursday morning, saying the climate pattern is expected to form sooner than previously anticipated.
After La Niña ended last month, we entered “ENSO-neutral” conditions, which means neither La Niña nor El Niño is present. Those neutral conditions were expected to end at some point in the summer or early fall.
But as of Thursday, it looks as though the timeline has moved up. Forecasters said there is a 62% chance El Niño will take over between May and July. The probability that El Niño will form by fall is even higher, between 80% and 90%.

What would that mean for our weather? We usually feel the strongest effects of El Niño as we get closer to winter.
An El Niño fall and winter would be the inverse of what we’ve seen the last three years. It would likely mean a cold, wet winter for the Southern U.S. A strong El Niño in particular is associated with lots of rain for the Southwest and California – though California already saw a cold, wet winter this year even without El Niño in control.
El Niño usually means a warm, dry winter for the Pacific Northwest, Ohio Valley, northern Rockies and parts of the Midwest. Hawaii also often sees below-average rain during an El Niño fall, winter and spring season.
While El Niño can strengthen hurricane season in the central and eastern Pacific, it tends to contribute to weaker hurricanes forming in the Atlantic basin.
Even a strong El Niño isn’t a guarantee those exact scenarios will play out, NOAA warns.
“‘Associated with’ doesn’t mean that all of these impacts happen during every El Niño episode. However, they happen more often during El Niño than you’d expect by chance, and many of them have occurred during many El Niño events,” the agency writes.
Why neverending La Niña could be bad news
NOAA issues an “El Niño watch” when El Niño is possible within the next six months, explained Michelle L’Heureux, a meteorologist with the Climate Prediction Center.
Whether we’re in a La Niña year, El Niño year, or neither is determined by sea surface temperatures near the equator over the Pacific Ocean. The temperature of the water and air above it can shift the position of the jet stream, which impacts the types of weather we see on land.
Thanks folks for the inputs. Don't own any airlines and hadn't really looked into them for awhile, but was just looking at it for maybe a trade. Didn't make any bet, probably should of shorted early this morning and maybe made some there, but didn't. I think there is some conflicting economic forces for the airlines and the outlook isn't that rosy for the short term anyway. I get that DALs hedge for slowing economy is with the "more effluent" money and the company stated they would be the only one to profit short term, but how much.
Recession been real for the middle mid and below for some time now, their discretionary spending has been obliterated. Now recently the white collar group is getting hit with it's spending power, while the upper level is still spending like no tomorrow. But recession might dip into that group too. Also a "mild recession" might be as mild as inflation was "transitory".
Cost of fuel will be going up, it has to. As long as there is a push for greenish things, EVs, etc, it has to be more economical for any really big adaptations. Meaning less than oil, so oil will go up making green more affordable choice.
Also the brown ostrich is going to put more expense on the airlines more as time moves on. Extreme weather events cut right into profits if there are any and we are going to have a lot more of those.
