Knowlesmsn: If you'd read the Sequiam web site you will see the company posted that information for all to read in a press release. I believe the news release also said Sequiam would pursue collections and that takes time to draft and file.
Now if the product has some defect or misrepresented its capabilities, then CK can file a countersuit. Presently, nobody has made an official company pronouncement that the keepsafe is defective, or its capabilities misrepresented to CK. CK has never responded to the public release issued by Sequiam. Why?
Additionally, if the product is defective and CK alleges this then why is CK still selling it? Huge liability to the company to sell something as a gunsafe that is defective, yes?
The same would hold true for Sequiam in terms of liability.
I can't say if or when CK would be bankrupt, but if you have specific financial information from the company then please share it with all of us. Otherwise you are like the rest of us and don't know how long the company can operate. You guessing or have information from Mr Plant?

Divine: My opinion on it is Sequiam would not have issued the notice of default without cause, and my assumption is, it was processed through its legal department. Secondly, if it did not have merit, then the logical and immediate step by CK would have been to issue a public statement refuting the default notice.
Huge business red mark, along with the SEC suspension, the SEC and FBI charges.

jking1999: the only fact publicly stated is a notice of default issued by Sequiam to Cyberkey Solutions over alleged non-payment for product. There has been no official response from Cyberkey Solutions.
Robtff and Knowlesmsn as investors allege however, that Cyberkey Solutions failed to pay because the Sequiam product aka Keepsafe 2.0 is defective.
Knowlesmsn: take up the issue with the visionary JP as he ordered them, he promoted them, he advertisied them, he exuded praise for Sequiam in the investor update video. I'd say you are emphasizing the apparent incompetence of the CEO in product selection for Cyberkey Solutions.

Robtff: I am not privy to the NIST or SCE testing lab criteria, but the ONLY thing that constitues compliance is a certificate number issued for each device for 1 to 4 level of security. No certificate from testing, then no compliance UNLESS the NSA has tested and certified it.
Since you are speaking with Mr Plant then ask him to provide the certification number so I can run it by the NIST for verification along with what government agency is issuing "individually banded government issued numbers" for his usb devices.
In terms of keeping a firearm in it, I've had NO problem with my keepsafe for personal home use. Now if you have a problem with it then address it to Mr Plant because he is still selling them and I see no disclaimer issued about its alleged security breaches or inoperability. If the defects prove true, then I can safely assume the company would be held liable for knowingly selling a defective product. True? Since you believe Mr Plant is trying to do the right things, then he ought to remove the product for sale until the issue is resolved. IMHO.
Robtff: I've read the brochure, warranty info and specifications on the biovault and there is no indication or claim that it is destruction-proof, entry-proof, just impact "resistant". It makes no other claims, and in fact, read the warranty card which states basically that there could be unauthorized access to it, and the biometrics are basically not foolproof.
I see no claims of withstanding hammer blows, crowbars etc. Please direct me to statements by Sequiam that claim such. Meanwhile, I emailed the company for its response.
Robtff: well instead of talking about it, I will email Sequiam and ask that question. However, CK should not be selling something they know is defective and neither should Sequiam if that allegation proves true. But your thinking is since Sequiam is then Cyberkey can too? Bad logic.

Robtff: the statement says sometimes didn't work, but said nothing about "was easy to break." Also, the reporter should have clarified "didn't work" as that could mean many things such as not opening or closing properly, as an example. Please ask Jim Plant to issue an exact and specific statement as to those allegations concerning the keepsafe. I also find it extremely unusual that he would continue to heavily promote the keepsafe if it was in fact a defective product. I guess he can claim he didnt know that either. I see Mr Plant is STILL selling them on the web site. Seems quite contradictory, now doesn't it? Therefore, if as you allege the CK default on payment was due to defective product, then explain why Mr Plant still sells them?
Keepfaith: I remember posting the questionable nature of having a CFO in the company who also had judgments against it. Not only was the post deleted, I was blasted as a basher. So as others, I went to the FnF board and posted. It is tragic that so much got deleted here, but also tragic that so many ignored us on the FnF board or they would have seen this info a long time ago. Please recall that many of the pumpers (no longer here) were the ones who made others feel like traders to CKYS, if they read the FnF board, or associated with any of us in any fashion. I beleieve everyone realizes why they did so....now, after the fact.

Appears Mr Heaton released the judgments against Jim Plant and Cyberkey this March 1, 2007. Mr Plant put up inventory for the collateral on original judgments from 2003 in the amount of $67K+.
Jking: yes, it was posted here (got deleted by former Mods) then posted at the FnF board. Heaton had judgments against CK and Plant for about $67K, and the collateral was CK inventory assets. March 1, 2007 filing by Heaton cleared those judgements which indicates they were settled aka paid. An officer loan was also cleared off the 12/06 UAFS of about $200K (possibly Heaton IMHO) and a loan from Omega Tel (Heaton Company) was cleared off the books too.

Divine: myself and jking spent a great deal of time comparing the ST drives, verbage, models to those of CK. Too identical to be coincidence, as also evidence by Divine's device match up.
Tell me Knowlesmsn, why does the model number for the Enduro match that of SuperTalent, and the ST utility being identical to the one I got for the Enduro? Driver Download for STF_UT_USB20 from the ST web site is the same one as CK. I used both, both are identical.
Knowlesmsn: have you ever taken a Dell PC completely apart and checked components? Doubt it cuz you have no clue what you are speaking of. I've repaired plenty and the motherboard is specially designed for Dell, the cooling fans, power supply, the case etc. All proprietary designs. Can't run down and buy these parts at a PC store for replacement...gotta go direct to Dell.
Divine: Exactly that was the draw as Plant alleged HE had a "proprietary chip" burnt with a serial number for each drive tied to the authentication and encryption. Basically SuperTalent will sell its drives to anyone and put a logo on it for them too. The alleged "valued-added" software that is still advertised for the Enduro is NOT even available, nor did it come with any software.
Fhanen350: It needs to say manufactured by Sequiam and distributed by Cyberkey Solutions...because is is not a CK product.
Divine: Model numbers match up on download pages too for drivers...in fact I used the one of the SuperTalent site for my Enduro...one and the same model and driver. The ST driver I used is for their drives which basically means the CK drive with CK's name on it. No difference, just a logo, no added value.
Plane4Keeps: exactly, there is NO MYFanKey, NO ChildIDKey, NO web portals just more pie-in-the-sky hype.

It is no assumption but FACT that Sequiam provided the biolocks and keepsafe. Please show me what company makes the "same" product, not similiar but same. The entire advertising campaign was around those Sequiam products. Besides what other manufacturer will sell to CK without cash upfront in the situation CK is in? If they had cash, I imagine they would send it to Sequiam and Sequiam would be happy to send the product in the warehouse to save relabeling/repackaging efforts alone.
Plane: Not debating or questioning if they ever had products,or have some right now, but I do wonder what the exact inventories are now, and prospects of acquiring additional inventory to make a viable business. Huge difference between selling one-zie and two-zie online with limited invesntory versus being able to fulfill large orders. Simply selling a few items to members here may create the illusion of viability only.
The inherent problem continues to be not providing verifiable specifics, and the silence on those specifics indicates to me a dire situation IMHO from cash for operations, sales, inventory, to share structure and everything in between.
Question: what product are we speaking of? Last I heard, Sequiam declared CK in default so no biolock or keepsafe. Secondly, the assumption is they still have flash drives to sell, but that has not been verified. There is the possibiluty of no inventory to sell or acquire without funds. There is talk about the lights on and doors open today, but what about next week, next month. Can anyone inform us of validated/audited financial status to enlighten us where the company stands even of today? Until those issues are resolved, the info in the IBOX is valid as it is. IMHO
Tax Gains: one's tax bracket is relevant on the LT and ST GAINS. The maximum loss is $3K for a tax year with remaining loss excess to be carried over to subsequent years.
Knowles: Yes, I am still a bagholder of ALL buys with NO sells on this one. The decision on LT tax loss depends on other taxable factors for 2007.
