I noticed this also and at first thought it was pretty "in your face", but really, how else are you going to say it? The "confusion" is Vringo's opinion, but you can't argue with the facts about the timing of the laches decision.
Looks like 12% chance all claims canceled. But consider...
- All claims for both patents would have to be canceled.
- The trial and appeal will be over and done by the time this could happen.
- A jury trial has already said the patents infringe and are not obvious.
PPS will drop as wussy traders bail. Buying opp for longs understanding what the hell is going on. Shorts will have their fun for the next week. Expect GOOG's "over the bow" salvo to be met with a direct hit from VRNG right in the nut sack. Stop sweating the day-to-day PPS if you're just holding, otherwise, load up for later. Christmas may come a day or two early this year. May be perfect reason to get super drunk on New Years.
Funny. It wasn't long ago that longs were whining about the incompetence of Vringo lawyers for the willful and laches foul-ups.
There's still outstanding motions due from GOOG and VRNG. Remember 11/29 and 12/7?
Don't know if I'd say that (ie: Vringo could file their responses earlier on Dec 4 and Judge could hand down his final decision Dec 5 - never know). The final motions and responses aren't nearly as important as the Judge's final decision, which we really have no idea when that is going to be (but most likely now after Dec 7).
Week's not over.
This day-to-day crap on light volume means nothing. Until the judge makes a decision, it all means nothing. Sweating over every slight movement in the share price until then is a waste of your time.
Wait until EOD Friday. If I'm wrong then, feel free to give me grieve!
Price will stay below $3.50.
B/S ratio is 2.13 yet it still stays below 3.50. Unless there's news, that's the way it's gonna be.

Lying and twisting the truth is no big deal to them. They see other investors as puppets to manipulate. They want your money and will do anything (lie, steal, kill) in order to get it and with absolutely no remorse.

Nobody gets it right.
I've seen upteen million guesses at what the share price will be if VRNG wins. Longs are overly optimistic (call it being delusional or greedy bastards, whatever) and shorts fabricate. People get the royalty rate all wrong and seem to pull numbers out of their ass. Back door willfuls, crazy high multiples, wrong number of outstanding shares, etc.
If VRNG wins, they'll get damages, interest and royalties. At this late point, a settlement or buyout will probably be close to the same price as a trial win (my opinion). That amount plus the assets they already have (cash, patents and Facetones) divided by the number of shares will equal the share price. This will be the share price and not added on to the current share price (yes, there is about $300 million already "baked in").
Applying a multiple on the end of this is pure speculation. As VRNG proceeds against ZTE (and against other NOK infringers), and if they proceed against MSFT and YHOO, then this multiple should increase. Comparing VRNG to VHC is also a mistake.
Finally, I can not understand why longs pay any heed at all to the shorts (specifically and in general), which are trying to manipulate them like puppets. Why even respond to a basketball14 or a rainmaker when they're simply trying to pull the strings? I imagine longs were easy teased as children.
Wait until Friday AM. Verdict in the afternoon. My one post for the day and here I am speculating like a crazy muthah.

Everything points toward wanting to be bought; RingTones + Lang patents + Nokia patents = a buying opportunity for either FB, APPL, GOOG, MSFT or YHOO. Otherwise, Vringo as a business makes no sense. All of this, oh, Lang wants to develop new software while we expand RingTones while we litigate patents, etc. is just a lot of BS. They want to cash it in big, baby, plain and simple.

Look at their record in terms of privacy. I'm sure Google is reading every email in all Gmail accounts searching for VRNG and Vringo keywords.
I just sent an email using my Gmail account that says "Vringo is about to send Google to a holy hell of fire and damnation." Let's see if some storm troopers dressed in black show up at my door. Or at the very least one of their streetview trucks drives by and tries to steal data using my wifi.
