Option 1: the earnings at least match or exceed 1st quarter earnings...that would be a positive sign
Option 2: the earnings are substantially less than 1st quarter earnings, which would indicate that the 1st quarter earnings were manipulated through offset 2018 earnings or various other accounting tricks... If it ends up being this option, than there is no joy in Mudville—mighty ANDR has struck out.

So who's paying all the legal fees?? Fortress?? That's got to cost a lot. It appears that Apple can/will drag it out forever, just on principle. Not sure what pissed them off so much..
Regarding the 10 Q... It nice to see improvement, however, I think the real picture will emerge the next quarter, when either we see matching or continued growth in revenues, or we see a drop from the first quarter, which indicates that the first quarter included carry over revenue from 2018. I just don't trust them for good reason.

The real question is : Will Andrea take in more revenue in a 3 month period than does a "Mister Softee" ice cream franchise in a 1 week period...

Basically the sand is running out in the hourglass..... They have no money to pay the legal fees for a long drawn out fight with Apple, and that is/was Apple's game plan all along. this is sport for them... they love to destroy companies...scorched earth policy. I'm sure that Pepper Hamilton knows this and see's that there is no more money to be made by them, and will probably back out.
The Civil lawsuit is a crap shoot, and good luck trying to convince a jury of non technical people about the complexity of the patents.... again... Apple will have the jury eating out of their hands. don't see the Civil trial happening, because they can't afford the legal fees and no lawyer would take this case on a contingency.

First will Pepper Hamilton respond to the Apple appeal??? where's the money going to come from to pay them.... They've all ready been paid, so are they doing this pro bono?... don't hold your breath on that one.. wouldn't be surprised to see them back out..
Civil Lawsuit:
Assume a new legal firm handling this one.... How are they going to be paid?? This will drag on for years, and rack up huge legal fees...and the money needs to come from somewhere.... doubt they are going to take this on contingency.
I assume Doug will lay this all out and make it perfectly clear during the Shareholders meeting with the large crowd that will be in attendance

Apple Inc., with a trillion-dollar market capitalization, is turning to a federal appeals court in its yearslong patent fight with Andrea Electronics Corp., one of Long Island's smallest public companies.
Bohemia-based Andrea has sought since 2016 to enforce infringement claims against Apple on patent No. 6,363,345. The patent covers a digital algorithm that makes communications in noisy environments more intelligible by canceling out extraneous sounds.
In July the U.S. Patent and Trademark Office, in a formal review of Andrea's patent, ruled that some — but not all — elements remain valid.
On Sept. 18 Apple filed a case with the U.S. Court of Appeals for the Federal Circuit in Washington, seeking to strike down the remainder of the patent.
Andrea, a technology company, reached a license agreement on the same patent in August 2017 with Samsung Electronics Co. and halted litigation against the South Korean electronics maker.
While Apple continues its effort to invalidate the patent, Andrea is seeking to schedule a civil trial before a jury in U.S. District Court in Central Islip to assess any damages it is due. Andrea initially filed a patent infringement case in that court in September 2016, but it was stayed while the patent's validity was reviewed.
"We're asking the court to move ahead," said Steven Pedersen, an intellectual property attorney representing Andrea. "Further delay is contrary to the whole judicial system."
Gerald Bodner, a Melville intellectual property attorney, said that some patent litigants try to use their financial resources to overpower their legal foes.
But, he said, Apple is "doing what any litigant would do" in trying to have Andrea's patent invalidated. Apple "could be susceptible to a lot of damages."
Calls and emails seeking comment from Apple went unanswered.
On Friday, Apple won an unrelated patent case in the U.S. Court of Appeals for the Federal Circuit, which threw out a $234 million damages award to the licensing arm of the University of Wisconsin. The Wisconsin Alumni Research Foundation sued Apple in 2014, arguing that computer chips in some iPhones infringed on its patent designed to improve performance.
Andrea, founded in 1934, was an early manufacturer of radios and televisions and made intercoms for Gemini space capsules in the 1960s. The company, with 2017 patent revenue of $6 million and total revenue of $6.9 million, produces microphones, software used in speech recognition and a voice-recorder app for Apple iPhones and iPads. The company's stock market value, as calculated by Bloomberg, was about $4 million on Tuesday.
In August Apple became the first U.S. company to reach a stock market capitalization of $1 trillion. In the quarter ended June 30, the tech giant posted sales of $53.3 billion.

If their going to civil court in front of a jury, they better be looking to settle for billions... not the chump change that Doug would settle for.

that the normal inclination would be to secure on going revenue and licence fees, and grow the patent portfolio so that your revenue increased year after year and you could pay out dividends, and maybe grow the company so you could pass it on to your children and grandchildren..... similar to the founder of the company's philosophy.
BUT.....NOOOOOOOO.... In typical ME ME ME ME Generation philosophy, its all about what I can carve out and take for myself . Why build anything for anyone else, especially the shareholder, who are basically treated like garbage... We still haven't seen the $175.00 for the 1 microphone sold for the space station hit the revenue books yet.... that will push the P/E ratio thru the roof.
The real winner on this project is the artist that created the face image used on the robot's monitor. He got $250 for that. Hopefully he has that face image patented, otherwise Apple will try and steal it.
Well, lets see what the puppet master Fortress does.... they pull all the strings on what companies they can do business with, what the settlement terms will be, what if any licencing agreements will be, etc..etc..etc..
My guess is that Apple will just tell Fortress to make this go away..... and they will pull a few of the puppet strings and it will disappear.
Lesson learned: be wary of making a deal with the Devil.
My prediction here.......
that the loyers will be paid in full first
Fortress will haul in the rest of the scratch
Doug will win the Noble Peace and Physics prize
the shareholders will be left with the crumbs
