amrwonderful, it is my position that the judge should have ruled that she lacked jurisdiction, but she did not. The real problem is that most of the time a federal judge can da-n near do any thing that he or she wishes and get away with it. Now the judge is in a position where she can be reversed. Of course, she does not like this , but it should be her "Reward" for not following the law in the 1st Place. My Opinion-of course! tucker
Ghors, I too, since day one ,felt that the court lacked jurisdiction in the matter. I still believe that is the strongest point of law and that an appellate court will so hold. Look at the mess that Judge Lynn has created. She should have followed the law in the 1st place instead of trying to please everyone!!!tucker
Jim, ot, the Houston Cabal will make a showing at RTD's funeral. He was our Speaker and main man. I am sorry that I never made it to the dog races with him as we had talked about it many times;however, I like the ponies and the horse track was nearer to my home and the dog track was to the south and half way or more to Galveston.

to the board, my concern is that the judge must have felt she was misled when she signed the vacate orders since she was told that it would not affect third parties! Remember that Nokia has raised that point and that could lead to real problems as to the trigger. One will have to know more before a definite legal opinion can really be made. All of this is just my opinion. I do think that the final outcome will be less dollars for Idcc as we have the base station issue now in play!tucker

sjaym, In my mind, in the Motorola lawsuit, Idcc had inept counsel and the Judge was less than one likes to see overseeing the case. Then to add to the stupidity , the Court of Appeals ruled the validity of a patent was a law question and that infringement was a jury question and did not send the case back to the trial court for a trial on the infringement question. Since the original jury had found the patents to be invalid , then how could you have expected it to find infringement and then award damages. The very least that the appellate court should have done was to remand the case for a hearing consistent with the appellate court's rulings. The case , in my mind , was a legal travesty of justice and , again in my mind, our attorneys along with Burns,Idcc's represntative in court, were not only "outgunned, but outlawyered"!!tucker
My Dime , Ghors gave an honest assessment of the Texas Judicial situation and it certainly could effect Idcc's lawsuit. I spent a considerable amount of time on the defense side of the docket before my firm divided and I chose to go solely plaintiff. All a good lawyer wants is a fair trial and a judge who calls the shots as the law dictates. When one side or the other propagandizes the system to the point that the public is misled and the juries become tainted with built in prejudices , then nobody gets a fair trial.Hopefully, this will not happen to Idcc in Marshall and both sides will get a fair trial! Greg, the senior Jones is dead. I have used Scotty Baldwin in the area and he is excellent to use in the area. In fact, I would rather have Scotty to be the lead attorney in that neck of the woods than the Fullbright crowd;however , I would doubt if he is doing much trial work now. I was waiting to see who answered for the defendants to see if I knew any of the Lawyers who are representing the defendants. I have a problem in this regard as most of the lawyers in and around that area that I once knew have crossed that big divide in the sky and now are practicing before a Higher Court!tucker
Franklin Jones' father was a really heavy hitter before his son started to practice with him and the son is carrying on the family tradition. I am sure that the firm knows everyting to be known about any prospective juror. If the case has to go to trial the Franklin firm would be one great asset. Now we must wait to see who comes in as local counsel for the defense to see if the Jones's firm is counter-balanced by the other heavy hitting firm in Marshall.tucker

bulldzr, you made a good entry point when you sell the stock at a price at more than you paid for it. Think of buying a mule : Buy low, work the mule for the planting season and if the crop fails and you sell the mule for more than you paid for it after deducting your feed bill then you still made a good deal.If the mule dies before you can sell it and the crop fails , then just forget the whole dam n deal and start looking for another mule after you have talked to your banker!!
I want you to not worry about Idcc and sell out because then you will not show up at Bonnie's. Just remember that even the dart pickers of stock have been known to beat the "professionals". Tucker

I agree that one would think that now is the time to negotiate and not wait for an arbitration ruling. It has been my experience that , for some reason, arbitrators like to compromise and give one side a win and at the same time throw a few crumbs to the loser. tucker

dws, when I was in Europe in November 2002 98cents would buy one Euro. I noticed that last week it took one dollar and 27 cents to buy one Euro. So if Nokia is on the right side of the exchange picture, it is doing quite well just sitting back and waiting.I really do not think that , overall, Nokia considers the Idcc situation as a hugh problem. At least that is my opinion!tucker
