oh and to answer some of your questions.....yes kostro falls under the sec.....he is the chairman.....he could be from mars....the sec don't care as long as u follow the rules......caterham is NOT required to file Q reports on their holdings as they are NOT an american company.....however they are required to file if they hold 5% or more of any public traded company.....and yes the sec knows from the registrar.....they know how many shares u have....when u bought them and when/if u sold them......so caterham and for that matter.....NO ONE HOLDS 5% of this company.......unless i missed it....inst Q holdings are 13F.....5% onwership is 13D and 13G.

ironically....that is what the company said.....u just didn't believe it then....the only thing they never told us was that D wouldn't move forward cuz of K......i really don't expect a PR on that......thats in fighting....work it out and then let me know whats up.....thats what GTEM did.....all mide did was put all the stuff together in one place.....really go back and read the PRs about this stuff......its why mides post makes so much sense....the only part i did NOT know was all the 8k stuff.....but u are already supposed know that.....its your job as an investor to know the rules.....its not the companies job to explain them to u every time they put out an 8k....now that i know the rules that i should have already known.....i totally understand why this is taking so long.....mide is right there was alot happening in 04.....that will take time to go thro.....and then that has to match up......and whatever doesn't......then has to be redone and see who is making the mistake.....so given this knew info......the reports could take awhile.....mostly will depend on how good a job decarlo did......iow i'll give it till mid nov....about 60 days since D started......anything after that would hint that D is not matching up with decarlo.

which brings me to my next point......yes companies have your name and addy if u are a SH.....how do u think they mail u stuff?....yes some of it is done thro your broker......but the company still has access to the info.....i would assume it can get share count to....really how u think GTEM knows there are 30k holders?......now if u hold it in a fund.....which in this case means u own DF cuz its the only one.....then NO they do not have your info......the fund does and the fund votes your shares.

how people can make statements or argue points without reading the info is beyond me......anyway the wells notice is for mainly not filing(remember this goes back to 04....its now end of 07 and GTEM has no legit reports during this time)......part of it has to do with padding the #'s.....GTEM can claim it was all joe and they had no idea.....well the sec ain't buying that.....kinda like the anderson thing.....there are supposed to be checks in place.......u can't just let someone build a house of cards.....and then pretend u don't see it......GTEM sold shares during this time....this is why they are in trouble.....tho even if they didn't the SEC would have charge them under a dif sec.....tho i think that one part does anyway......iow we know others got wells.....my bet huff CEO for signing off on them...lynch the CFO who also signed off....and was jimenez the CFO in 04(or who ever it was)......the sec so far has NOT charge GTEM with fraud.....everything right now is civil....and i suspect it will stay that way.....the SEC will try and hang one or more of the individuals.....iow their wells have actual crimes in them....not just civil......GTEM will just pay a fine.....which i don't know if this is covered by ins.....however GTEM does need to file....or it will get yanked.....tho that will take some time before that happens.....the SH revolt will happen long before the SEC yanks the shares.....i would also like to point out that this means the end of the investigation......hence the wells.....thats what the investigation lead to.....now all GTEM has to do is file.....and make sure they are 100% correct.....that kills more than half of the wells.....and then reach a settlement(civil only) on the part where they let this crap happen in the first place.......so unless something new comes up in the individual cases.....this is over....well assuming GTEM does its part....which given its past is a pretty big assumption.

to put this another way......the sec is saying that one or more individuals may have committed fraud at GTEM.....but it wasn't so bad that the company is fraud......the companies crime is NOT catching the fraud and letting it go on for so long.....plus not filing legit reports for almost 4 yrs now......everyone got that now.....this has nothing to do with overly promotional PR's or any PR's for that matter.....if the sec thought the PR's were lies.....then that is fraud and the SEC would have charged GTEM with that.
