Naked short selling, or naked shorting, is the practice of short-selling a tradable asset of any kind without first borrowing the security or ensuring that the security can be borrowed, as is conventionally done in a short sale. When the seller does not obtain the shares within the required time frame, the result is known as a "failure to deliver". The transaction generally remains open until the shares are acquired by the seller, or the seller's broker settles the trade.[1]
Short selling is used to anticipate a price fall, but exposes the seller to the risk of a price rise.
In 2008, the SEC banned what it called "abusive naked short selling"[2] in the United States, as well as some other jurisdictions, as a method of driving down share prices. Failing to deliver shares is legal under certain circumstances, and naked short selling is not per se illegal.[3][4][5] In the United States, naked short selling is covered by various SEC regulations which prohibit the practice.[6]
Critics, including Overstock.com's Patrick M. Byrne, have advocated for stricter regulations against naked short selling. In 2005, "Regulation SHO" was enacted, requiring that broker-dealers have grounds to believe that shares will be available for a given stock transaction, and requiring that delivery take place within a limited time period.[4][7]
As part of its response to the crisis in the North American markets in 2008, the SEC issued a temporary order restricting short-selling in the shares of 19 financial firms deemed systemically important, by reinforcing the penalties for failing to deliver the shares in time.[8] Effective September 18, 2008, amid claims that aggressive short selling had played a role in the failure of financial giant Lehman Brothers, the SEC extended and expanded the rules to remove exceptions and to cover all companies, including market makers.[2][9]
Some commentators have contended that despite regulations, naked shorting is widespread and that the SEC regulations are poorly enforced. Its critics have contended that the practice is susceptible to abuse, can be damaging to targeted companies struggling to raise capital, and has led to numerous bankruptcies.[6][10] However, other commentators have said that the naked shorting issue is a "devil theory",[11] not a bona fide market
issue and a waste of regulatory resources.[12]
The basic form of short selling is selling stock that you borrow from an owner and do not own yourself. In essence, you deliver the borrowed shares. Another form is to sell stock that you do not own and are not borrowing from someone. Here you owe the shorted shares to the buyer but "fail to deliver." This form is called naked short selling. These short sales are almost always done only by options market makers because they allegedly need to in order to maintain liquidity in the options markets. I have come to the conclusion that the market is (dare I say) generally being manipulated/influenced by firstly the large institutions, Secondly by full time professional traders and day traders.
The general public and the "Mom and Dad" investors are the last to know what is actually happening and invariably the ones that lose out in the long run.
The advantage the Institutions have is the "Millions" of dollars that they have available to use at any given time. This is usually obtained from the public in the first place, in the form of Insurance, Superannuation and Managed Funds etc. Which we (the general public) all contribute to on a daily basis.
The largest advantage they have is the enormous amount of shares they are able to purchase at any given time.
What occurs is that even a small movement in share price means big profits for them, because of the volume/turnover of shares which occurs whenever a share transaction takes place.
Now Volume is the "Fuel" driving the market.
An uptrend in share price to survive and to continue must be nourished by new buyers who are being fed by cautious, seemingly reluctant sellers.
Consistent volume is very important, if there is to be any change in the existing trend. There must be a surge of buyers or sellers capable of changing the current share price.
Remember for every "Seller" there has to be a "Buyer" and vice versa.
The seller thinks or knows the share price is going down and the buyer thinks the opposite.
Now too much selling will invariably force the price downwards as will too much buying forces the share price upwards.
This is the law of "supply and demand".
This "Law" is taken advantage of by the large Institutions who are well aware of what happens when they buy or sell in huge volumes of shares.
Remember they are in the market to make a profit not a loss.

Good post! This is a fact... VNDM will do this all day with himself to make 1 or 2 ticks. Why? because he can! and after so many of them (buys/trades) with all the money and resources he has he can make out well on a stock like this. Guess who was buying shares when it was in the 2's???? He will continue as long as there is no buying pressure or chill is off. Manipulation? yeah a little but I guess there are no rules at this level. This is not the only stock he does this too.

In my business currently we have Contract Manufacturers that charge a conversion price per unit and drop ships to either our Customers or Distribution location. It does not have to be Nick and Ray. The conversion costs are part of Cost of Goods sold and has already been accounted for in the Net Operating Profit.

OK, observation and would appreciate feedback:
I know Nick is probably fed up with the PPS lately so, what is everyone's thoughts that by end of next Qtr he produces audited Fins even past Fins so he can uplist off of this turd Pink? If he wants to stop some of the manipulation we are seeing. Another wishlist item: What if he started paying Dividends (small) to chase away the shorts and the MM's? One thing I can guarantee is the team assembled with their business minds and money are a lot smarter than all of us. We play the stocks but they create them! It's crazy we do not give these guys the credit that they have earned in just 4-5 weeks.This is all in my opinion but I will put my money on this any day of the week risk and all just to get a glimpse of a staggering portfolio in less than a year.
