We had those 2 T trades the other day for 900,000 a piece. Wonder if the big buy EOD yesterday and that big sell today was just the mm's trying to shake things up? Both moves were about the same size. jmho
stringofpearls....... I was wondering if you had looked at exhibit 5 lines 7.1,7.2,7.3,7.4 and if there was any concern there? If you could... a yes or no would be good enough.
Document 14-3 Filed 04/19/10 Page 16 of 22
It's the 4th attachment inside.
Thanks in advance.
I saw that as well, that our lawyer had signed the request for the extension. This seemed very odd to me.
"I,m confused, who wanted the 10 day extension, PL, SL, or both. If PL then why give the other side more time unless they are talking."
Almost seems like there is some maneuvering going on.
1. SL and PL's attorney's sign 10 day extension on April 23rd.
2. We hired attorney's in Korea. PR'd on the April 23rd.
I don't know sounds like "negotiations" going on? Paul putting added pressure on with latest PR. imo
Always so much more going on than what we have a clue about. However this coincidence does seem suspect... in a good way.
Never Know... Paul may say hey "give me a 100 million of your restricted shares and I'll pay your 250,000 dollar debt and we'll forget this ever happened".
Snap shot of the actual lawyer representing our case. Pretty impressive education.

MM's covering?
.0075/.008 Good Morning
dragon52 I've enjoyed many of your post in the past, however I'm not sure where you're going with this. Neither you nor I know whether he did or didn't pay this fee. Even if he didn't your putting an awful lot of weight on this 25 dollar fee. If this case or any case at this law firm were hinged on its ability to pay a 25 dollar fee my guess is yes they paid it or their "Nadine" would be out the door. I'm with you on covering all possibilities. This just seems like a stretch to me. Let the law firm do what they do best .
I can't or won't speak for him, however it's been 42 years since he got his Jurist Doctorate degree, there is probably a good reason.

Despite this rapid growth, Yulchon has maintained an unwavering commitment to provide our clients with the highest quality of corporate legal service as promptly and as accurately as possible.
Yulchon strives continually to provide exceptional legal services with a level of creativity and commitment that exceeds your expectations. As a result, Yulchon has become one of the most highly-regarded law firms in Korea, ranking first among similarly-sized law firms as the outside counsel of choice for Korea’s 30 largest business groups, according to a recent survey by the influential Chosun Daily. Yulchon also enjoys a growing international reputation, and was recognized by Chambers Global as “one of the most respected and reliable practices in Korea.”

So true MLR... no one has come close to guessing what's to come next. Looking this latest PR over I'm glad we have this weekend to digest it. I like the fact that Paul is pulling out all the stops on this situation. Kinda like a hungry lion cornering a rat. Sorta blocking all exits... no escape attitude. My first thoughts about the PR besides being informative is the level Paul is taking it to by hiring another top notch law firm.
This award stands out in particularly.

"Maybe we should call NADINE to see if we are haulted"... lol
Well... I'm looking at it as perhaps "Payday". However, in the past few months a lot "Paydays" haven't transpired. We'll just have to wait and see what tomorrow brings. Lawyers are applying a lot of pressure imo... at some point somethings gotta give.
I didn't ask when... that gets controversial if a possible date is given and it doesn't happen. However, from her tone it sounded like things were moving. Trying to keep from getting to excited as it could be tomorrow or maybe Monday etc.
Gut feeling says... tomorrow, but who knows.
(all imo and not Nadine's lol)
Just got through to Nadine... she said "Paul had a PR ready the lawyers looked at it...they wanted him to revise it and are now working on the revision".
Soooooooooooooooooooooooon imo.
and
do they even say xtend medical on them yet?
No it doesn't say xtend medical yet, but I think that day is coming... really looking forward to that:)
Just tried making my weekly call and it went to the answering machine. Will try later. Must be out to lunch lol.

Last trade showing 4000@.0062 $24.80 less commission. Whacked for 20 bucks. We're ready Paul bring on the news and make it good.
It's your TDA lol.
Looks like all trading on the stock markets stopped around 9:55 am. Something happen on Wall street?
or is it my TDA?
Some lucky soul got some .0062 and .0063's. Funny in terms of money we're talking about the equivalent of a second mortgage to acquire the harp assets potentially worth billions (shaking my head)... go figure.
That's how I see it "EGO and POSTURING".
Spoke to soon. Sorry Stub not going.
Sent it so far so good hasn't returned.
For those who have not read the transcript from last filing, here is what was being discussed yesterday.
28. As it turned out, the next meeting with Mr. Lee was ultimately
scheduled for December 27, 2009, during which the BioHarp Assets were to be delivered to XTend. Mr. Lee, Ms. Esther Lee, Mr. Shin, Mr. Friedman, Mr. Duncan, and I all attended that meeting. When the meeting started, I asked Mr. Lee if he had brought all of the assets with him as he had promised on December 8, 2009. Mr. Lee stated that he did not have them, and he was defiant when I asked him for an explanation. I then asked Mr. Lee if he or U&I Korea owed any money to Genohco, Inc., the Korean manufacturer of the BioHarp device. After several denials that U&I Korea owed Genohco any money, Mr. Lee finally admitted that it was possible that a $250,000 bill was still outstanding to Genohco. I stated that when we signed the Asset Purchase Agreement, Mr. Koh had represented that there were no encumbrances on the BioHarp Assets, but now Mr. Lee was admitting that Mr. Koh’s representation was potentially false. I asked Mr. Lee again why he did not have all of the BioHarp Assets that XTend had paid for with over $27.5 million worth of stock, and Mr. Lee stood up and left the meeting, saying nothing more.
Encumbrance is a legal term of art for anything that affects or limits the title of a property, such as mortgages, leases, easements, liens, or restrictions
http://en.wikipedia.org/wiki/Encumbrance
I don't think he can handed it over till this is paid:)
JC it could be the reason then again it might not. We don't know what SL was thinking... he may have felt it was the companies obligation from his skewed perspective.
The problem is distance. Sam Lee is in Korea, his lawyer is in California any paper work that needs to be signed is gonna be 3-5 days round trip at best. Then his lawyer and our lawyer have to get together. Then Paul and Ben have to get with our lawyer and round it goes. This stuff never moves at the speed of thought.
Wow thanks sterae that's a lot of reading. Did get the first document read. Couple of interesting things.
1. We know for certain who the manufacture was. Genocho
2. Lee owes them (Genocho) $250,000 per the Dec 27, 2009 meeting in which he was supposed to hand over the harp.
Could it be that simple? Lee is holding our Bioharp hostage while he attempts to extort some cash from Paul to pay off and old debt.
It almost appears as though Lee is afraid to hand it over out of fear of being left with nothing (except some debt) and shares that won't be viable till Nov.
I haven't gone to sleep yet so I know I'm reading stuff into what I've read. But still they have a meeting and Lee doesn't bring the harp and all Paul gets out of it is the knowledge of some of Lees debt.
I'm thinking this negotiation stuff we keep hearing about is over the $250,000 owed to Genocho. Good news could come very soon imho:)
PS (this almost seems stupid if in fact this is the case)
Bet we get a PR explaining the situation... Xtend covering Lees debt, which intern frees up the harp and we have official kick off... thank God nuff said I'm tired imo.
