Case continued to 01/21/2022!
Case updated yesterday, 12/3
"Summary Judgment / Summary Adjudication (Civil) continued pursuant to party's motion to 01/21/2022 at 09:00AM before Judge James A Mangione."
This is the OTC and I always assume any promising news a company puts out could be nothing but lies. I won't at all be surprised if GM tells us in a few weeks that the supposed company in question decided not to pursue a R/M with CUBV. I'll be pleasantly surprised if they do, but I won't count on it.
Lol Right?!
One thing I've been questioning is why a company that wants to do a R/M would choose a shell that has pending litigation. It just seems potentially messy and problematic.
It's not every time. It's just lately. In late summer to early fall the stock spiked several times after tweets made it look like a R/M was imminent. After that people got tired of hearing "soon". People are just waiting for real news now.
Well, that's good to know.
I'll stop being so negative so I don't get accused of being a troll. lol
Now there's only a possibility things will happen soon! Lol
Possibility and may be possible are the key parts of this tweet regarding the merger, IMO. I'll let everyone draw their own conclusions. Lol
Here's the tweet:
"We are discussing the possibility of completing our merger despite pending litigation as it appears the matter may end up on appeal, or a cross complaint. Through certain indemnities it may be possible. Stay tuned..Thank you"

Does anyone know if it's possible to complete a merger with pending litigation?
I'm hoping for the best but won't be surprised if we end up being told that this particular merger won't be happening.
Nothing's signed yet. It looks like it could be good but let's not get ahead of ourselves.
Court case update entered today, 11/29.
"Memorandum of Points and Authorities filed by Cuba Beverage Co Inc."
From https://www.law.cornell.edu/wex/memorandum_of_points_and_authorities#
"Memorandum of points and authorities is a document that is filed with a court by a party to support the party’s motion. The submission of a memorandum of points and authorities is usually mandatory whenever a party files a motion. The memorandum generally must include a statement of facts, an introduction of evidence and arguments, a discussion of the relevant case law, statutes, or other secondary materials, a conclusion and signature block."
I'm not a lawyer but it looks to me like CUBV is supporting George Sharp's motion for a judgment or adjudication.
The timing is interesting. That's for sure.
Court case update. Entered on 11/23.
Notice - Other (OF NON-OPPOSITION IN SUPPORT OF PLAINTIFF GEORGE SHARPâ??S MOTION FOR SUMMARY JUDGMENT, OR IN THEALTERNATIVE SUMMARY ADJUDICATION) filed by Sharp, George.
I'm not a lawyer but this looks promising.
Luna Tic and Bradenhead, what are your thoughts on this?
Would saying that there haven't been any updates on the court docket since 10/31 be a more accurate way of stating it then?
Looking at your post again it looks like you meant to reply to someone else because I didn't write what you quoted in your post.
According to George's tweet pending litigation must be settled first to complete the merger. I'm giving people a factual update, or lack of an update, about the court case.
No new updates for the court case.
The 12/3 court date for summary judgment/ adjudication was actually scheduled all the way back on 7/29. A civil jury trial was also scheduled for March 2022 on the same day.

I'm not a lawyer, so I'm not going to speculate, but my BS detector is starting to go off again.
Seriously. It seems like as recently as a few weeks ago things were good here.
Good to know. Thanks.
Unicourt doesn't show anything was recently submitted to the court for this case.
People should bookmark the Unicourt page for the case. If we're not being misled there will be updates there. The last one was in May.

I expect we'll be getting a tweet or two in the next month saying things are delayed because of the holidays.
How did I know the next tweet would be about some kind of delay?
Also, 79% of those hospitalized with COVID have been overweight or obese. Red states have the highest obesity rate. So, sure, f$#k Biden.
I think people migrated to cryptos.
We're almost there! I've had my doubts the past couple of months but I'm glad I'm still here.
GLTA
If it's CTR I think I'm going to pass out.
Are there any companies besides CTR and ESM that aren't already public?
I agree. This is the typical never-ending tease. At least the shell is clean.
I think the shell will eventually get taken over, just not by a lithium company.
Are these main offices or satellite offices? Energy Source is in San Diego and the CRT address is just a mailbox location.
I go back and forth between believing this guy and not. If you're going to negotiate a major deal like this why wouldn't you go to the company's headquarters to do so? From what I remember none of the speculated lithium companies were headquarted in the Salton Sea. They have extraction sites in the area but the main offices are elsewhere.
It was a good tweet, a few days too late, but good.
On the bright side, if the company comes through with some great news, there are cheap shares available.
If they know they're going to miss their own deadlines, they need to communicate that and give some updates.
What do you guys think the next bit of news will be once we get it?
I think it will be that a RM with a lithium isn't happening but they're working on other possibilities.
Oh, come on. If he didn't write that tweet he would have said so, via tweet, already.
Even a tweet with a new deadline would be better than silence. Then again, maybe there isn't any news to deliver.
Today's the day. Or not.
The fact that Lilac never denied the rumors gives me a sliver of hope. As I said before, I'm prepared for anything.
