Under these circumstances, I believe, we would have had a better outcome. Sometimes things happen after the fact and have to be revisited.
Hey, the unconstitutional director position stood for years before it was challenged and stopped. But before that it was believed to be okay. Same with CFPB/ FHFA funding. Cfpb got it handed to them. Court found their funding was unconstitutional. So things can occur and exist. But their existence isn't proof of legality, constitutionality, or Ms. Congeniality (Sandra bullock).

An expert, I forget who, maybe dharan, did analysis into it. And found most paid less. There was something I read here that was posted, that a company ( AIG?) had near 10% but gov lowered it to 5% to help the company pay back the loan. The gov also exchanged a high interest Preferred shares to lower interest Preferreds to help the company in repaying.
I am a little fuzzy on the company name.
And, sadly, we (FnF) never got the same treatment. Easily could have negotiated a lower interest rate to aid us in paying.
Also, I don't believe this ( FnF paying higher interest than tbtf) was brought up yet, but I haven't caught up in all the reading.

If Billions of $$$$ went to buying sneakers or happy meals or gender studies, that is NOT the public it (FHFA) serves.
The FHFA is housing and nothing else. It is Healthcare or student loan forgiveness, etc.
NWS did not save housing financially as that has been proven to be a lie. So how else? They didn't shrink FnF. FnF grew and they were, at a time, left undercapitalized with next to no money. So nothing, not one thing, was gained from NWS.

Sps canceled for free? No. Not even close to what would be happening. I respect your thoughts, but hearing that when/ if sp gets written down that it would be for free as if it was a gift of $100's of Billions for nothing by the govt. It wouldn't be.
Yes, we would still be short at end of year, but if possible lowered cap plus factor in how long this gov takes to accomplish things coupled with litigation taking time to wrap up then we would be well into 2024 by the time it is fully complete.
So by then the retained would be $125+B or more. We could be released at that #. And even pay partial dividends if the cap rule is $180B. We would be good for a release under those circumstances and numbers. And if they did still, even though it wouldn't be needed, raise $50-$60B, I did mention a potential for a little dilution. ( little to no dilution was mentioned in my post earlier).
Anyway those are my thoughts and hypothetical that I posed to the poster I responded too.

I'm speaking on a rise in share price rather than a damages award.
IF sp/lp is written down to zero, and $27+B returned to FnF toward recap and/or some arrangement where govt keeps $27+B in exchange for warrants, and possibly lowered cap requirement, then it result in a quicker release, quicker dividends payouts on a major exchange with a SIGNIFICANT rise in share price from lack of serious dilution we keep getting threatened with.
So: 0 Lp
No warrants.
At end of year '22 we'd be at $100B(est) in the green
Lower cap rule to 175 to 200 at most.
No need to speak of conversion of jp because interest rates are high now.
We'd face little to no dilution. It's all possible and without Govt looking like crooks that they are, which needs to be factored in. They rule based on optics. So it's a way to win without govt being held responsible.
What would stock price be then?
Jp would definitely be hitting par with dividends soon to follow.
Commons would be, depending on market and valuation, $100 - $150 or more. Since we are in a more bearish market. Otherwise would/ could be higher.
Yeah, punitive damages would be great. But so would the c-ship being unwound and $120+B, tbtf settlement $$ returned as well. Zero lp and toss warrants. With all these idiots being held accountable, but I'm trying to be realistically optimistic.
So in this circumstance that I have suggested above, would you be content with $100-$150 pps with dividends to follow even though you received next to nothing in damages and govt gets away with it? I hate the situation, but my speculation doesn't seem so bad. And when you factor in some think I'm foolish and uniformed and they'd be happy with $5.
It could be what results from a snowball effect and the first Domino falling.
But what do you think?

I have more hope in this case because it's a jury versus govt paid judges deciding our fate. Although nothing is ever 100%, hope is what is left. That's what it's for.

Well, I don't remember any evidence like we will be seeing in Lamberth trial, pertaining to the sweep and it's true origin and motive. I believe that would have been seen as an overreach and exceeding of their power.
If "death spiral" (future draws) and treasury funding commitment disappearing was presented and not properly refuted by plaintiffs then the SCOTUS went with it.
A justice, I forget which one, asked D's lawyer if FHFA could do ANYTHING and not be subject to judicial review. D 's lawyer said, "well, no not just anything".
So the truth was the FHFA exceeded power and that action should be subject to judicial questioning. That is why we have Lamberth right, isn't it? That is why Ugly Betti lying is a big deal, right?
Care to fill in any blanks for me, but it appears that's why we still have hope at all because it was all lies.

Scotus ruled based on a lie. So it's not all good. I don't remember the evidence in this current Lamberth trial being presented and entered for the scotus trial back in December 2020. If it was, then my mistake.
But if I let a friend borrow a car and didn't know he used it to rob a bank then I didn't say "it was all good". I said it was okay if used correctly and NOT just for anything, especially illegal.

Yes this board, but all the same, hype was higher two months back. Rop bogus ruling. Then Lamberth seems to be stripping away from our case. Limitations that may leave us with the thought they he has been compromised. A victory that isn't necessarily a win at all. Unless you care to enlighten me. What am I missing? We know the downside. We're living that now. What is the potential upside after lamberth orders that he recently filed?
