I will find the case but what I believe they are going after is the same case law that allowed the Indians to conduct gambling.
Because they have sovereign land, the state has to allow it to happen, specifically (as in California) if it's legal state wide.
Now different agreements can be made to make all people happy as did in Florida with the Seminole Indians and Gambling. The reservation was very close to Disney and the locals hated it as they were afraid it would affect "family friendly" tourism. The end deal a casino in South Florida and s Casino in Tampa. A FORCED win for all.

Heads have been turning and phones have been ringing all weekend, as casual passers-by, cannabis farmers and concerned citizens attempted to discern what they were seeing on a two-acre parcel visible from US 101, just north of Ukiah.
Those in the know identified the pallets of soil, the circular fabric "pots" and the irrigation lines as a burgeoning cannabis growing operation. But what was to be a 200-plant project situated on tribal lands has now been curtailed to two contiguous "grows" situated on adjacent parcels- one consisting of 25 plants and one strategically containing 26 plants.
Why 26 plants? "Because the Sheriff told me this afternoon that if we grow one plant over the 25-plant-per-parcel limit, he would eradicate that plant," says Canales. And that, he continues, would initiate a chain of events that Canales states would violate rights of tribal sovereignty, something that Canales is ready to test in federal court.

Also one other important observation from the LA times article- which is very interesting. The exact quotes from the sherif, local government, and local DA office are all January quotes.
Who knows maybe they just reiterated the same talking points but it is the EXACT same quote. Just an observation.......

The tribe would devote 2.5 acres of its 99-acre rancheria to the venture, which would include 90,000 square feet of greenhouse for thousands of plants, far in excess of Mendocino County's legal limit of 25 plants per lot.
"The tribe," said FoxBarry Chief Executive Barry Brautman, "is exercising its sovereign right."
Brautman, who is working on cannabis plans with six tribes both in and out of California, told me the $10-million venture will conform to the state's medical marijuana laws and regulations. Hmmm let's see the facts:
1. Plants are in the ground on two acres on Pomo lands
2. Another 96 acres are still allocated for cultivation
3. There are two other locations in California still in works (under same Foxbery, Pomo Indian, and CNAB agreement)
4. Pomo Indians are on sovereign land, in a state where it is legal. Local government does not have jurisdiction
5. The attempts at character assassination and HUGE assumptions about Blackmon, Ruby, Veruza, Bratnin, Foxbery, and CNAB are simply not reality.
6. Some will still try to continue these assumptions and everyone should do DD other then simply what people post.
7. As this agreement continues to grow- the CNAB management will be considered UNDER PAID.

CNAB (united cannabis) deal with Pomo Indians moving forward. Planting has begun LA Times reporting on it. Should be interesting week.

Pomo Indian deal has moved forward with plants on the ground off the 101 in Northern California.
Reality obviously is that they have started growing. The sherif is not stopping it. 99 acres are still in play.

As far as "fluff PR" on Indian deal, and Indian deal itself. Let's recap:
1. Deal announced between filbert, Pomo Indians, and CNAB.
2. Deal is legal as far as state of CA is concerned.
3. No "FLUFF" PR was done this became a huge national story as huffington Post, CNBC, and many others picked up on it. Not to mention every California network channel.
4. Appears that the local city/county government were not for it. The sherif spoke out against it
5. We await to see what happens. Maybe dead, maybe not.
