The wording appears vague. Instead of saying avip has been included in ows it says avip has been selected for inclusion. Would that translate to avip has been selected for consideration? The pages in the paper are all dated 5 Oct. You would think inclusion would have generated a press release. Also, the Swiss market, although up a few cents, doesn't indicate a reaction to news as volume remains average to low. Just my two cents.

Based on the Swiss market it appears we can expect rlftf to open lower and drop about 10%. Shares have recovered somewhat on the Swiss market so hopefully we don't see the 10% drop but it's definitely going to be a long day here.

When you look at the market cap associated with your share prices, yes you're being not only bullish but unrealistic. Cut everything in half and you'll be close to the mark.

If the CAFC reverses the decision we're right back where we were before. Chances of the SC overruling, or even hearing, an appeal are extremely remote.
The appeals court decision will be overturned within the year by the appeals court. Teva will get their en banc hearing and prevail based simply on the makeup of the court and the fact that this ruling upsets precedent.

The GSK Teva result doesn't mean anything until all appeals are exhausted. Teva has a much better shot at an en banc hearing than we do and a very good chance of succeeding. The 3 judge panel they drew was almost as bad for them as our panel was for us. Recall the mix of Democrat appointees vs. Republican and I'd say their chances of reversing the decision are excellent.
Has that case reached an end? The ruling was from a 3 judge panel I think and Teva might decide to appeal it. Can a case be cited that could potentially be overruled?

En banc approval is less than one percent. But if Amarin's hail Mary works and they do get an en banc hearing the odds go up astronomically because the court would have to find something in the ruling so egregious they wouldn't dare deny it because they fear a SC rebuke.
