Foolish Advice on Business Liability Insurance

Welcome to week three of our look at the varying types of insurance you may want to purchase. This week, we leave behind the vast and murky pond of disability insurance and wade into the deeper and even murkier waters that characterize business liability coverage.
What it is
Business owners make mistakes. So, too, do their employees. Business liability insurance provides coverage when those mistakes lead to a lawsuit. An electrical contractor, for example, would file a claim if it were found that his faulty wiring led to a fire that brought about a lawsuit by the homeowner who lost his house in the blaze.
But that's just one type of liability insurance. There are four general categories of business protection you can purchase, according to the Web-based resource AllBusiness.com:
General liability coverage: A general policy typically protects a business against claims resulting from bodily injuries that occur on its premises or that result from negligence. Property damage incurred during the course of doing business is usually also covered, as in the example above.
Professional liability coverage: Service workers also may need protection in the event of a lawsuit over errors in their work. Medical malpractice insurance is a common form of professional liability coverage.
Product liability insurance: TASER (Nasdaq: TASR) employs this sort of insurance to defend against suits that claim its stun guns are defective.
Employment practices liability insurance: A relatively new form of protection, "EPLI" policies protect employers in the event of a claim of wrongful termination or sexual harassment.
Should you buy?
But your business won't be sued, will it? Don't be so sure. A quick Google search using the terms "businesses sued" generated 532 results. Consider these two cases:
A Sacramento, Calif., attorney has filed more than 100 claims against local businesses he believed violated the Americans with Disabilities Act.
Monsanto (NYSE: MON) has sued more than 100 farmers across the country for what it claims are violations of patents related to its genetically engineered seeds.
What's more, legal challenges had become so prevalent in California that ballot Proposition 64, which sought to keep attorneys from frivolously filing claims against ambiguous "unfair business practices," passed with roughly 59% of the vote during the 2004 election. Perhaps lawsuits are par for the course when it comes to owning a business?
Three Foolish questions to ask before you buy
Maybe. Whatever the root cause, lawsuits seem to be rising. That's hardly news to the participants at our Self-Employed Fools discussion board. The overwhelming majority of respondents to a poll I posted last week -- 82% -- say that they either already have liability insurance or plan to get a policy. If that's you, too, allow me to suggest three Foolish questions to ask before you buy:
1. What could a suit cost you? Sole proprietorships and other non-corporate structures mix personal and business assets under a single roof. So, if your business gets sued, it's your assets that will be on the line. Structuring your firm as a corporation or limited liability company (LLC) offers slightly more protection by distinguishing between business and personal assets. But that won't absolve you from all liability, especially if you -- the owner -- are the one that does the harm. Consider hiring a liability insurance specialist before buying a policy; that person should have a good understanding of common settlements in your industry, which About.com expert Darrell Zahorsky says is critical for determining the amount of coverage you'll need.
2. What do your clients require? At least one respondent to my online polling says that liability insurance was a requirement for doing business. I've heard this many times as well. For example, a writer friend here in Colorado had to purchase professional liability coverage before earning a lucrative contract with a California-based software firm. If you face the same, and if asking for help won't lose you the business, find out which agents and/or insurers your prospective client prefers. That relationship may earn you a needed discount.
3. Are you a member of an association? I'm typically loath to refer to associations when it comes to insurance, because most offer lousy health and dental policies. Not so with liability insurance. Dozens of organizations offer cheap liability policies thanks to the size of their memberships. I was witness to this in my former profession as a PR consultant, in which I had access to Errors and Omissions insurance -- a form of professional liability coverage -- through the Public Relations Society of America (PRSA).
Follow the money
Frankly, as a writer, I may do better with a good lawyer and a well-stocked emergency fund than I would with liability coverage. You may feel similarly. But the harsh truth is that neither you nor I can know what's best for us until we count up our assets, consult a specialist, and plan for the worst. It's at least worth considering.

Q: Who Needs Radiation Detection Instruments?
A: The reasons for acquiring a radiation detecting survey meter, Geiger counter and/or dosimeter are as varied as are peoples concerns for the future and the safety of their families in this ever changing world. Radiation threats are unique in that you can't see, smell, taste, hear or feel them, until it's already done its damage and you are suffering the effects. Without a radiation detector you would have to depend solely on the limited resources of the authorities to monitor your location, then determine your risk level, decide the best protective action and then to 'get the word out'.
Exclusively depending on others to monitor, evaluate, warn and advise you, in a rapidly developing nuclear emergency crisis, would surely not be anywhere near as quick or accurate in revealing your current risk as when you are capable of taking your own independent radiation readings. Also, where authorities are warning of radiation fallout not yet arrived, but anticipated to be heading your way, with a radiation meter you'll be able to confirm that the suggested protective action is in fact reducing your exposure and not inadvertently increasing it. (Safe avenues of evacuation and/or designated safe areas can potentially shift as quickly as the wind!)
The specific causes of potential life-threatening nuclear radiation emergencies include...
Nuclear power plant accidents here or abroad (Three Mile Island, Chernobyl)
Nuclear materials processing plant accidents (Tokaimura, Japan)
Nuclear waste (radioactive waste from hospitals, spent fuel and radioactive waste from nuclear power plants, radioactive contaminated materials, etc.) storage or processing facilities mishaps
Nuclear waste transport truck or train accidents
Accidents involving non-waste, but normal daily nuclear materials transport (trucks, planes, trains, couriers) One out every 50 HazMat shipments contain radioactive materials. Approximately three million packages of radioactive material are shipped in the United States each year.
Improper storage of radioactive materials (non-waste) at any point during their normal material life cycle. (Power plants, Medical, Industrial, Academic, etc.)

Or, food or water supplies could be contaminated with radioactive materials.
Or, a strong radioactive source could be placed in a location adjacent to where large numbers of the public would file past. They would be unknowingly and dangerously exposed to it, such as at a subway que, sports arena or stadium, etc.
Regarding radioactive fallout and minimizing the effects on your family with the use of a radiation meter, Cresson H. Kearny, the author of Nuclear War Survival Skills, Original Edition Published September, 1979, by Oak Ridge National Laboratory, a Facility of the U.S. Department of Energy (Updated and Expanded 1987 Edition) states in Chapter 10 - Fallout Radiation Meters:
A survivor in a shelter that does not have a dependable meter to measure fallout radiation or that has one but lacks someone who knows how to use it will face a prolonged nightmare of uncertainties. Human beings cannot feel, smell, taste, hear, or see fallout radiation.
Which parts of the shelter give the best protection? How large is the radiation dose being received by each person? When is it safe to leave the shelter for a few minutes? When can one leave for an hour's walk to get desperately needed water? As the fallout continues to decay, how long can one safely work each day outside the shelter? When can the shelter be left for good? Only an accurate, dependable fallout meter will enable survivors to answer these life-or-death questions.
With a reliable dose rate meter you can quite quickly determine how great the radiation dangers are in different places, and then promptly act to reduce your exposure to these unseen, unfelt dangers. For example, if you go outside an excellent fallout shelter and learn by reading your dose rate meter that you are being exposed to 30 R/hr, you know that if you stay there for one hour you will receive a dose of 30 R. But if you go back inside your excellent shelter after 2 minutes, then while outside you will have received a dose of only 1 R.
Bottom Line: Having on-hand an inexpensive radiation detecting meter in this day and age is cheap family insurance and, like major medical insurance, we can also hope & pray never to have to use it! Also, like any real insurance, it'll be near impossible to get it after the fact!

There are three types of late reports
Those with a time stamp within a minute and a half after closing are just normal 90 second delays
Rule 6620.1 OTC Market Makers shall, within 90 seconds after execution, transmit through ACT last sale reports of transactions in OTC Equity Securities executed during normal market hours.
In this case the market makers may have conducted a trade within seconds of closing, but is delayed in reporting until after closing it is showing up a minute after closing. This delay, which is permitted, is often misconstrued as manipulation.
And then we have those later than 90 seconds after closing. These trades fall into two categories and typically involve larger size lots
This is sometimes used by financial institutions that are non market makers to report larger transactions that actually occurred during market hours, but since they do not have access to the ACT (Automated Confirmation Transaction Service) use Form T to report. In essence, bypassing the MMs.
MMs are basically prohibited from these "Off Market transaction" as spelled out in
A pattern or practice of late reporting without exceptional circumstances may be considered conduct inconsistent with high standards of commercial honor and just and equitable principles of trade, in violation of Rule 2110.
These ”Off Market” trades are typically used by larger investors to buy larger lots at prearranged prices without risking to drive the price upward or downward.
The second category involves so called “ex-clearing” lots. Certain transactions may clear and settle outside of the regular clearing system ("ex-clearing" transactions), where two dealers make an arrangement to settle trades between them outside the clearing system.
The process used to balance street side transactions depends on the type of comparison generated, and the settlement method for the particular trade.
Trades Comparison is accomplished in one of two ways:
1. Electronically through the use of an automated clearing house such as the NSCC. This the normal way
2. Manually via Ex-Clearing. Ex-Clearing is a manual comparison process that is performed by the brokerage firm’s Purchase and Sales Department. Unusual short coverings can end up settle this way

What do bananas, smoke alarms, toilets and large granite buildings have in common? They're all sufficiently radioactive to set off detectors. Efforts since 9/11 to prevent the detonation of a dirty bomb—an explosive device designed to spread lethal radiation as well as panic—are plagued by the risk of false alarms. When 350,000 or so radiation-therapy patients in the United States and Europe can cause detectors to light up if they get close enough, you know a solution isn't going to be easy to find.
And it hasn't been. The current state of the art, "spectroscopic" detectors, can distinguish between the harmless beta rays given off by the potassium-40 in bananas and the very dangerous gamma rays from uranium and plutonium, which are used to produce nuclear fuel and nuclear weapons. But they're expensive. In the run-up to the Olympics, China bought many detectors, at $27,000 each, from the Beijing firm RAE-KLH Technologies to check people and vehicles entering the Olympic Village, airports and other venues. The detectors, too, are limited because they can work only at choke points, such as entrances to buildings or compounds, resembling the walk-through metal-detector gates used at airports. By contrast, to search for dirty-bomb radiation at large calls for cheaper electronics technologies, which are just now starting to become available.
One new technology uses surveillance cameras with sensors tuned to radiation. In June, Splinternet Holdings, a security firm in Norwalk, Conn., began "wrapping" buildings with radiation-detecting cameras that cost less than half as much as the Chinese model. The detectors differentiate between benign and dangerous radiation, a big help for organizations such as hospitals that are trying to prevent the theft of radioactive material.
Some researchers are incorporating everything needed to detect radiation onto computer chips, which are smaller and more reliable than sophisticated spectroscopic radiation detectors. The security firm eV Products in Saxonburg, Pa., is already marketing a chip that's only a cubic centimeter in size. In large volumes, the company says, the device would cost less than $50; eV Products has provided several hundred to classified U.S. government programs. Rick Smith, head of sales, says his government clients are handicapped by the desire to develop overly complex systems able to identify biological and chemical threats as well. Such requirements would add years of research, and result in larger, more-expensive sensors.
Technologists at Purdue University in Indiana are determined to avoid that pitfall. "We have to fight this American knee-jerk toward the highest tech," says Andrew Longman, a project leader. The Purdue team is designing a detection system that's so small it could fit into cell phones. The project, known as Distributed Nuclear Detection by Ubiquitous Cell Phone, would help locate dirty bombs or nuclear weapons by "triangulating" the source of radiation when people carrying mobile phones pass by. (The greater the number of equipped cell phones, the greater the precision: phones closest to radioactive material would register stronger signals.) The Purdue project and others like it represent a "major shift" in combating radiation terrorism, says Rita Colwell, a former director of the National Science Foundation and now a professor at the University of Maryland.
The most effective system, says Longman, will be as inexpensive as possible, so hundreds of thousands or millions will carry sensors inside their cell phones. The Purdue team is lobbying Congress to require cell-phone users and telecoms, which will have to collect the data, to participate. Yet legislation mandating participation may not be necessary. Government agencies could simply pay mobile owners and telecoms that agree to opt in. Deploying detectors in mobile phones is promising, experts say, because the greatest concentration will be in cities, precisely where dirty bombers are most likely to strike.

The RAD-30P is now in testing with a major US airport and being at the IACP will allow Paradigm to leverage the momentum of the RAD-30P and develop new sales channels.
