AMS, you will undoubtedly get blasted for that post...but I for one agree, IDCC has fulfilled very few of the 2002 goals. This like every business should be performance based. The delay in 3G is what it is and they can't do anything about it. I do think however that when times get tough you find out who the real producers are. How many 3G licenses did the "Q" sign this past year? It just irritates me that these guys can't seem to close the deal on so many issues. A tiny disposable phone player to me is like a token "look we did something". Just frustrated we can't get off the snide and everytime there is a setback we try to justify with unlikely reasoning and excuses. Most anyone who is a part of the business world understands that budgets and goals are worked on in Sept-Nov, so why hasn't a clue been revealed as to what they plan to not get done this year...Maybe I just answered my own complaint, maybe they have figured out if they publish their goals someone might call them on the carpet....
Hello all just signed on after being away for a few days...This is the one ting that I really hoped I would be WRONG about. I posted three weeks ago that I was afraid the trial would be delayed. Every possible hickup that could happen to IDCC does, I am beginning to think it's not coincidence! Frustrated but still long. I am quite certain there will be a sell off with not much bounce back over the next couple of months. many will take their bets off the table knowing they can put it back in 3 months at $9-11. If IDCC holds true to form we won't have one bit of positive news between now and May..pessimistic I am,today, nothing MAJOR goes right with this company it seems
Data, that's my fear exactly. While I am thrilled that the Dallas Detectives have uncovered some very good stuff, I can't for the life of me understand why ERICY can't see the same thing. Is there more to this than meets the eye? By all appearances ERICY should have settled some time ago unless as some have stated, they rolled the dice thinking IDCC would go away. Now they have just been holding out for the best rate possible and maybe settle for 50% less than they really owe?....just seems strange given the uphill battle they seem to be facing..
teecee. I would agree with that strongly desire that nice steady upward trend as opposed to leaps and bounds. I don't think the announcements themselves will reveal much in the way of dollar figures (do you?) but we will figure it out in following SEC filings I would imagine. Also the nice steady rise will be strengthened when the rates for Nokia and Samsung can finally be established and the dollars that have been accumulating are finally being revealed. It may be a very stressful few weeks here but if things go as I think they will its going to be a nice next couple of years to be in this stock. One question for you, how would a settlement need to be structured to get the other infringers to the table?
Mickey thanks for the positive attitude and entertaining post...however, the fact that mediation has gone on would tell us that both parties wanted to get it settled. So, if ERICY has absolutely 0% chance of winning as you have alluded to why would they have not settled? Right now they could get a much better deal from Harry/Howard than the max that the jury/judge/treble award could amount to. I guaranteee you that if Harry/Howard and Co. would receive a $700 mill over 5 years with 3G all inclusive offer, along with a statement from ERICY on the validdity of those patents (to bring all the others to the table) to boot they would take it and run.
I firmly believe IDCC is the one playing hardball on a settlement which is fine, as I think IDCC and us shareholders are entitled to it. However I competely disagree with you regarding ERICY's chances of a win. If they were even remotely CERTAIN that they were going to lose their legal team would have said "this looks horrible", settle this damn thing or you may lose your entire company. I still say they will settle but I don't think it's fair to throw the newbies a post like that that makes it look like ERICY has absolutely no chance of prevailing that simply IS NOT TRUE. IMO.

I looked at a portion of the info and it did look like most of what I saw was OLD info. I just wondered if I might have missed something (I probably read 20%) that RECENTLY came to light for ERICY's attorney's. I guess I shall remain as I am in a state of guarded optimism. Nothing goes on this long unless both sides think they are right or can at least convince a jury that they are...

How much of this info was just released to ERICY attorney's? It makes me wonder if things look so positive for IDCC if maybe IDCC is holding out VERY stubbornly for the ultimate settlement. Their confidence may be so high they say "ultimate settlement or trial, it doesn't matter to us" like the saying goes pay me now or pay me later. I asked the question about when ERICY attorneys became aware of much of JK's info. Obviously they will be looking at this through a different pair of glasses but if much of this just was released to them wouldn't one feel that they are even more likely to suggest a settlement and the quicker the better if it truly becomes X$ + Y$ after the 27th, as opposed to just X$ now. Ah the roller coaster will continue folks
mickey I love ya man but I will give you a simple four letter word why ericy CAN win-------JURY. I am hoping for a settlement at the steps. It might stress me waiting that long but the longer it goes on the more I think IDCC would get out of a settlement

You can take this to the bank. She has decided the HRS case. She has undoubtedly met with her law clerks and told them her decision and charged them with the obligation of preparing an opinion for filing. That having been done, she is preparing for IDCC with a clear mind. She would have been meticulous in making sure that the date of that meeting is clearly established. Her purpose would be to assure herself that she is not acting with any bias towards ERICY, during the IDCC trial.
It would not surprise me if she is working on IDCC with the assistance of Barefoot's law clerks and the magistrate judge who has handled much of the case. She might even have old Barefoot helping her.

OT: Analyst downgrade effects? I somehow think IDCC needs a downgrade (Tounge in Cheek), been following ELN and AG. Edwards downgraded it last week at $2.46. Today its up 12% to $3.22 on nearly 10 million shares...just goes to show you what can happen when the shorts get burnt like they may very well here in old IDCC.....somebody here once said that if the analyst's are saying sell they are probably really buying and vice versa...could be. Hope its not in our case.
sjratty, as far as I am concerned keep posting...you have already figured out that some don't like a contrary OPINION. We are all a bit stressed right now so it might be best if all of us, including me be a little more open minded and tolerant of other views. Chill my friends we are close, we have come thus far together no need to start the bullets flying

I was just curious as to how the last 5 trading days compared with IDCC/ERICY. That doesn't mean I think it means something in particular, just interesting. ERICY's only down day the last 5 was the bad overallmarket day on (Tuesday?).

no not the same it was for around 13000 shares if I remember right. The more and more this happenes I really think it has to be more of a defensive or safeguard against what might via trial. If they are unloading because they know something well they will definitely have someone bigger than this board to answer to.

10-4 Danny, I guess you have your opinion and I have mine concering this. If you think "chastising them" is befitting of my post, so be it. The intent of my comment was to say that ALL the insider sales over the last 3 months have caused SHORT TERM drop in stock price. Heck maybe that isn't negative it allows people to buy on those dips. Secondly, I was stating that I THOUGHT the stock price would have a nice gradual rise going towards trial but that if we continue to see insider sells it might slow that momentum or trend. I have publicly stated that I will be parting with some shares prior to trial as a safeguard. All this was meant as statements and opinions not derogatory remarks.
ronnie, thanks for the clarification and your opinion. I know it's not popular with some here but the fact is when these alerts pop up it HAS a short term affect on share price. I guess folks even like TC thought the selling was done. Some may argue, but yeah this is different they sold to exercise options. Regardless unless you are digging deep into this most folks will seemingly say "more insider sales from IDCC mgmt". Let people defend the practice all they want perception is what has an affect. We aren't the only nervous one's going into Feb 10th. As a side note I firmly believed we would see a gradual runup this month before the trial, I hope it still happens but if we keep getting these intermitent sells I think it will stall any momentum. Do I read this form 4 correctly, did Mr. Miller sell 13890 shares at between $16.22 and 16.40, and then exercize options on 9000 shares at $5.19 and 9.60, looks like he pocketed a little and stashed some for taxes but bought back in....Fine by me...if I have read that right

Jimlur, that is a billion dollar PLUS question. I brought it up about 4 months ago when I believe it was Data Rox(right again) said that the cummulative amount of all the patents that might be deemed "essential" by the patent holders themselves was going to be very high. Can you imagine that even if they limit it to a 20% figure (as opposed to the 5% thrown out back in Nov) how detrimental that would be to patent holders. Might trim the 1/2-1 1/2% talked about here to a tenth of a percent. This is a very serious issue to my simple mind for the longterm profitabilty of certain companies that live on their IPR.

Would it be as easy as calling the clerk at the courthouse and asking 3 possible questions? 1: if it was indeed due yesterday 2: was it filed and not yet entered due to backlog 3: why it wasn't entered. I think JK may be on to something here but could it be cleared up with a call to the clerk?
Loop, I am glad you are here and posting some reality check. It's odd, I watched the little "made for TV movie" on Enron last night and had a lot of dreams last night regarding the IDCC secrecy. I know they are not at all one in the same but I think it did open my eyes a little further for investigating what is going on. I hated the part about all stock options being granted when the company wasn't making any money....hhhmmmm...Anyway I am quite nervous about the upcoming trial and hope that a settlement hits, otherwise I believe I will "lighten my load" of IDCC shares prior to trial. If I guessed right after all these years I can retire, if I am wrong its not a happy next several years, I don't choose to live with that kind of pressure.
